# THE CHITTAGONG HILL TRACTS PETROLEUM REGULATION, 1957

> A Regulation to apply the Petroleum Act, 1934 , to the Chittagong Hill-tracts.

**Act No:** EAST PAKISTAN REGULATION NO. II OF 1957

WHEREAS it is expedient to apply the [Petroleum Act, 1934](/laws/act-166 "Act 166") , to the Chittagong Hill-tracts;

AND WHEREAS by clause (3) of Article 103 of the Constitution of the Islamic Republic of Pakistan, the <sup><a id="fnref-1" href="#fn-1">1</a></sup> \[Government] is empowered to make regulations for the peace and good Government of any area in which is for the time being and excluded area;

NOW, THEREFORE, the <sup><a id="fnref-2" href="#fn-2">2</a></sup> \[Government] in exercise of the said power and all other powers enabling him in that behalf, is pleased to make the following Regulation, namely:-

### Short title and commencement

1\. (1) This Regulation may be called the Chittagong Hill-tracts Petroleum Regulation, 1957.

(2) It shall come into force at once.

### 2. Application of Act No. XXX of 1934 to the Chittagong Hill- tracts

2\. The [Petroleum Act, 1934](/laws/act-166 "Act 166") , shall apply to the Chittagong Hill-tracts, subject to the amendments shown below:-

**AMENDMENTS.**

1. In section 1, sub-section (3) shall be *omitted.*
2. In section 2-

*(* I *) for* clause (d), the following shall be *substituted,* namely:-

“(d) “to transport” petroleum means to move petroleum from one place in <sup><a id="fnref-3" href="#fn-3">3</a></sup> \[Bangladesh] to another in the Chittagong Hill-tracts and *vice versa* ,

and includes moving petroleum from one place to another within the area of the Chittagong Hill tracts.”

(ii) for clause (e), the following shall be substituted, namely:-

“(e) “to import” petroleum means to bring it within the area of the Chittagong Hill-

tracts.”

### 3. Amendment of section 28 of Act No. XXX of 1934

3\. In section 28, the words, figures and commas “unless section 8 of the Coroner’s Act, 1871, is applicable to the circumstances,” shall be omitted.
