> ## Documentation Index > Fetch the complete documentation index at: https://laws.sayed.app/llms.txt > Use this file to discover all available pages before exploring further. # Public Examinations (Offences) (Amendment) Act, 2026 > Public Examinations (Offences) Act, 1980 এর অধিকতর সংশোধনকল্পে প্রণীত আইন **Status:** Active **Date of Publication:** ১৬ জুলাই, ২০২৬ **Act No:** ২০২৬ সনের ১০০ নং আইন যেহেতু নিম্নবর্ণিত উদ্দেশ্যসমূহ পূরণকরে [Public Examinations (Offences) Act, 1980](/laws/act-610 "Act 610") (Act No. XLII of 1980) এর অধিকতর সংশোধন সমীচীন ও প্রয়োজনীয়; সেহেতু এতদ্দ্বারা নিম্নরূপ আইন করা হইল:- ### সংক্ষিপ্ত শিরোনাম ও প্রবর্তন ১। (১) এই আইন [Public Examinations (Offences) (Amendment) Act, 2026](/laws/act-1729 "Act 1729") নামে অভিহিত হইবে। (২) ইহা অবিলম্বে কার্যকর হইবে। ### Act No. XLII of 1980 এর section 2 এর সংশোধন ২। [Public Examinations (Offences) Act, 1980](/laws/act-610 "Act 610") (Act No. XLII of 1980), অতঃপর উক্ত Act বলিয়া উল্লিখিত, এর section 2 এর clause (a) এর পর নিম্নরূপ নূতন clause (aa) সন্নিবেশিত হইবে, যথা:- "(aa) "digital manipulation" includes unauthorized access to, hacking, alteration, modification, deletion or suppression of any public examination database; "। ### Act No. XLII of 1980 এ নূতন section 3A এর সন্নিবেশ ৩। উক্ত Act এর section 3 এর পর নিম্নরূপ নূতন section 3A সন্নিবেশিত হইবে, যথা:- "3A. Entrance with electronic devices and violation of directions.- Whoever, without lawful authority, enters or attempts to enter an examination hall or examination center while in possession of any electronic device prohibited by the authority concerned in connection with the conduct of public examination, or willfully violates any lawful direction, instruction or regulation issued by such authority, shall be punishable with imprisonment for a term which may extened to five years, and shall also be liable to fine."। ### Act No. XLII of 1980 এর section 4 এর সংশোধন 8 । উক্ত Act এর section 4 এ উল্লিখিত "Whoever discloses, publishes or distributes, by any means whatsoever," শব্দগুলি ও কমাগুলির পরিবর্তে "Whoever possesses, discloses, publishes or distributes, by any means whatsoever including online platform," শব্দগুলি ও কমাগুলি এবং "ten years" শব্দগুলির পরিবর্তে "five years" শব্দগুলি প্রতিস্থাপিত হইবে। ### Act No. XLII of 1980 এ নূতন section 5A এর সন্নিবেশ ৫। উক্ত Act এর section 5 এর পর নিম্নরূপ নূতন section 5A সন্নিবেশিত হইবে, যথা- "5A. Punishment for digital manipulation.- Whoever commits digital manipulation, shall be punishable with imprisonment for a term which may extend to five years, and shall also be liable to fine."। ### Act No. XLII of 1980 এর section 6 এর সংশোধ ৬। উক্ত Act এর section 6 এ উল্লিখিত "seven years" শব্দগুলির পরিবর্তে "five years" শব্দগুলি প্রতিস্থাপিত হইবে। ### Act No. XLII of 1980 এর section 8 এর সংশোধন ৭। উক্ত Act এর section ৪ এ উল্লিখিত "ten years" শব্দগুলির পরিবর্তে "five years" শব্দগুলি প্রতিস্থাপিত হইবে। ### Act No. XLII of 1980 এ নূতন section 9A এর সন্নিবেশ ৮। উক্ত Act এর section 9 এর পর নিম্নরূপ নূতন section 9A সন্নিবেশিত হইবে, যথা:- "9A. Organized examination crime.- Whoever enters into, offers to enter into, or acts upon any contract, agreement or arrangement, whether written or oral, with an examinee or with any person on his behalf, for the purpose of assisting such examinee by applying any unfair means in a public examination, shall be punishable with imprisonment for a term which may extend to five years, and shall also be liable to fine."। ### Act No. XLII of 1980 এ নূতন section 10A এর সন্নিবেশ ৯। উক্ত Act এর section 10 এর পর নিম্নরূপ নূতন section 10A সন্নিবেশিত হইবে, যথা:- "10A. Undue assessment of answer scripts.- Whoever over-assesses or under-assesses any public examination answer scripts, shall be punishable with imprisonment for a term which may extend to two years, or with fine, or with both: Provided that no person shall be convicted of an offence under this section unless such over-assessment or under-assessment is determined by a third examiner."। ### Act No. XLII of 1980 এ নূতন section 12A এর সন্নিবেশ ১০। উক্ত Act এর section 12 এর পর নিম্নরূপ নূতন section 12A সন্নিবেশিত হইবে, যথা- "12A. Liability of institutions and service providers.- Where any offence under this Act is committed due to aiding, collusion or willful act of any institution or service provider related with conducting public examinaiton, such institution or service provider shall be liable to fine and may also be subject to debarment, suspension of license, or blacklisting, as the case may be."। ### Act No. XLII of 1980 এ নূতন section 13A ও 13B এর সন্নিবেশ ১১। উক্ত Act এর section 13 এর পর নিম্নরূপ নূতন section 13A ও 13B সন্নিবেশিত হইবে, যথা:- "13A. Special provision for children in conflict with this Act.-Notwithstanding anything contained in any other provision of this Act, if a child is in conflict with any provision of this Act, he shall be dealt with the provisions of the Children Act, 2013 (Act No. XXIV of 2013). 13B. Whistleblower protection.- (1) Whoever provides credible. information regarding any offence relating to examination, shall be protected from disclosure of identity, legal liability and retaliation. (2) Whoever violates the provision of sub-section (1), shall be punishable with imprisonment for a term which may extend to six months, or with fine, or with both."। ### Act No. XLII of 1980 এর section 14 এর প্রতিস্থাপন ১২। উক্ত Act এর section 14 এর পরিবর্তে নিম্নরূপ section 14 প্রতিস্থাপিত হইবে, যথা:- "14. Procedure.- Notwithstanding anything contained in the [Code of Criminal Procedure, 1898](/laws/act-75 "Act 75") (Act No. V of 1898),- (a) an offence under this Act shall be congnizable; (b) no Court other than that of a Metropolitan Magistrate in metropolitan area or a Senior Judicial Magistrate (Magistrate of the first class) other than in metropolitan area shall try an offence under this Act; and (c) a Court trying an offence under this Act shall try the offence summarily in accordance with the procedure laid down in the said Code for summary trial of summons cases."। ### Act No. XLII of 1980 এ নূতন section 14A এর সন্নিবেশ ১৩। উক্ত Act এর section 14 এর পর নিম্নরূপ নূতন, section 14A সন্নিবেশিত হইবে, যথা:- "14A.
