WHEREAS it is expedient to provide for the regulation of the use of official vehicles and for matters connected herewith;NOW, THEREFORE, in pursuance of the Proclamation of the 24th March,1982, and in exercise of all powers enabling him in that behalf, the President is pleased to make and regulate the following Ordinance:-
In this Ordinance, unless there is anything repugnant in the subject or context,-(a) “official vehicle” means a vehicle belonging to, or provided by, the Government or a local authority;(b) “public servant” means a person in the service of the republic or of a local authority;(c) “vehicle” means a motor vehicle as defined in the Motor Vehicles Ordinance, 1983 (LV of 1983).
(1) The Government may, by notification in the official Gazette, make such rules as appear to it to be necessary or expedient for preventing the misuse of official vehicle by public servants.(2) Without prejudice to the generality of the foregoing powers, such rules may provide for-(a) inspection and checking of official vehicles by such person or authority and in such manner as may be specified in the rules;(b) imposition by the authority by which an official vehicle is allotted or by such other authority as may be specified in the rules of such penalty, not exceeding the value of the vehicle, as may be specified in the rules for the contravention of any provision of the rules;(c) the manner in which a penalty may be imposed and realised under the rules.(3) Without prejudice to the provisions of this Ordinance or the rules made thereunder, the contravention of any provision of such rules shall be deemed to be a misconduct punishable under any law relating to the discipline of the public servant concerned.
Any rule made under this Ordinance shall have effect notwithstanding anything inconsistent therewith contained in any other law for the time being in force other than this Ordinance or in any instrument or document.
The Government may, by general or special order to be notified in the official Gazette, exempt any public servant or class of public servants from the operation of all or any of the provisions of the rules made under this Ordinance.
