সরকারের আর্থিক প্রস্তাবাবলী কার্যকরকরণ এবং কতিপয় আইন সংশোধনকল্পে প্রণীত আইন

(ঞ) paragraph 45 এর-(অ) “2015” সংখ্যাগুলির পরিবর্তে “2019” প্রতিস্থাপিত হইবে;(আ) sub-paragraph (i) এবং sub-paragraph (ii) এর পরিবর্তে নিম্নরূপ sub-paragraph (i) এবং sub-paragraph (ii) প্রতিস্থাপিত হইবে, যথা:-(i) Dhaka or Chittagong divisions (excluding city corporation area and Rangamati, Bandarban and Khagrachari districts) for a period of five years beginning with the month of commencement of commercial production :
(ii) Rajshahi, Khulna, Sylhet, Rangpur and Barisal divisions (excluding city corporation area) and Rangamati, Bandarban and Khagrachari districts for a period of ten years beginning with the month of commencement of commercial exhibition :
(ট) paragraph 47 এর পর নিম্নরূপ নুতন paragraphs 48, 49, 50, 51 ও 52 সংযোজিত হইবে, যথা:-“48. Any income earned in abroad by an individual assessee being a Bangladeshi citizen and brought any such income into Bangladesh as per existing laws applicable in respect of foreign remittance.49. Income of an assessee donated in an income year by a crossed cheque to any girls’ school or girls’ college approved by the Ministry of Education of the government.50. Income of an assessee donated in an income year by a crossed cheque to any Technical and Vocational Training Institute approved by the Ministry of Education of the government.51. Income of an assessee donated in an income year by a crossed cheque to any national level institution engaged in the Research & Development (R&D) of agriculture, science, techonology and industrial development.”।
Preamble
যেহেতু সরকারের আর্থিক প্রস্তাবাবলী কার্যকরকরণ এবং নিম্নবর্ণিত উদ্দেশ্যসমূহ পূরণকল্পে কতিপয় আইন সংশোধন করা সমীচীন ও প্রয়োজনীয়;সেহেতু এতদ্বারা নিম্নরূপ আইন করা হইল:-Sections/Articles
সংক্ষিপ্ত শিরোনাম ও প্রবর্তন
১। (১) এই আইন অর্থ আইন, ২০১৪ নামে অভিহিত হইবে।(২) The Provisional Collection of Taxes Act, 1931 (Act No. XVI of 1931) এর অধীন জনস্বার্থে জারীকৃত ঘোষণা সাপেক্ষে, এই আইন ২০১৪ সনের ১ জুলাই তারিখে কার্যকর হইবে।Stamp Act, 1899 (Act No. II of 1899) এর Schedule I এর সংশোধন
২। Stamp Act, 1899 (Act No. II of 1899) এর Schedule I এর Article No. 48 এর বিপরীতে column (2) এর clause (c) এর শেষে উল্লিখিত ‘‘and” শব্দ ও Explanation এর “Schedule bank” শিরোনামাধীন সংজ্ঞার শেষে উল্লিখিত “and” শব্দ বিলুপ্ত হইবে এবং অতঃপর উক্ত clause এর পরে নূতন clause (cc) এবং উহার বিপরীতে column (3) এ নিম্নরূপ এন্ট্রি সন্নিবেশিত হইবে, যথা:- | “(cc) When an irrevocable power of attorney comprising immovable property is executed without any consideration as defined by section 2, clause (2), of the Power of Attorney Act, 2012, authorizing the attorney to sell, to make contract for sale or to execute mortgage deed in favour of a bank or a financial institution in respect of a loan; and | One thousand Taka.” । |Act No. IV of 1969 এর section 192C এর সংশোধন
৩। Customs Act, 1969 (Act No. IV of 1969), অতঃপর Customs Act বলিয়া উল্লিখিত, এর section 192C এর-(ক) sub-section (1) এর-(অ) clause (a) এর sub-clause (ii) এর প্রান্তস্থিত “and” শব্দটি বিলুপ্ত হইবে;(আ) clause (b) এর-(i) প্রান্তস্থিত ‘(.)’ ফুলস্টপ’ চিহ্নটির পরিবর্তে ”; and” সেমিকোলন ও শব্দটি প্রতিস্থাপিত হইবে; এবং(ii) পর নিম্নরূপ নূতন clause (c) সংযোজিত হইবে, যথাঃ-”(c) penalty related pending disputes including those of customs classification under mandatory pre-shipment inspection system.”;(খ) sub-section (2) এর clause (d) তে উল্লিখিত ‘‘ goods ’’ শব্দটির পর‘‘, except disputes related to customs classification and penalty thereof, pending under mandatory pre-shipment inspection system’’ কমাগুলি ও শব্দগুলি সন্নিবেশিত হইবে।Act No. IV of 1969 এর FIRST SCHEDULE এর প্রতিস্থাপন
৪। Customs Act এর “FIRST SCHEDULE” এর পরিবর্তে এই আইনের তফসিল-১ এ উল্লিখিত “FIRST SCHEDULE” (পৃথকভাবে মুদ্রিত) প্রতিস্থাপিত হইবে।Ordinance No. XXXVI of 1984 এর section 2 এর সংশোধন
৫। Income-tax Ordinance, 1984 (Ord. No. XXXVI of 1984), অতঃপর উক্ত Ordinance বলিয়া উল্লিখিত, এর section 2 এর clause (15) এর-(ক) sub-clause (a) এর সেমিকোলন এর পর “and” শব্দ সন্নিবেশিত হইবে;(খ) sub-clause (b) এর প্রান্ত:স্থিত সেমিকোলন এর পর উল্লিখিত “and” শব্দ বিলুপ্ত হইবে; এবং(গ) sub-clause (c) বিলুপ্ত হইবে।Ordinance No. XXXVI of 1984 এর section 16CCC এর সংশোধন
৬। উক্ত Ordinance এর section 16CCC এর “zero point five zero (0.50%)” শব্দগুলি, সংখ্যা, চিহ্ন ও বন্ধনীগুলির পরিবর্তে “zero point three zero (0.30%)” শব্দগুলি, সংখ্যা, চিহ্ন ও বন্ধনীগুলি প্রতিস্থাপিত হইবে।Ordinance No. XXXVI of 1984 এর section 19 এর সংশোধন
৭। উক্ত Ordinance এর section 19 এর-(ক) sub-section (11) এর proviso তে উল্লিখিত “Bangladesh Shilpa Bank or Bangladesh Shilpa Rin Sangstha” শব্দগুলির পরিবর্তে ‘Bangladesh Development Bank Ltd.’ শব্দগুলি প্রতিস্থাপিত হইবে;(খ) sub-section (15) এর clause (aa) এর “Bangladesh Shilpa Bank or the Bangladesh Shilpa Rin Sangstha” শব্দগুলির পরিবর্তে “Bangladesh Development Bank Ltd.” শব্দগুলি প্রতিস্থাপিত হইবে;(গ) sub-section (26) এর প্রান্ত:স্থিত ফুলষ্টপ এর পরিবর্তে কোলন প্রতিস্থাপিত হইবে এবং অত:পর নিম্নরূপ নূতন proviso সংযোজিত হইবে, যথা:- “Provided that where the loan or part thereof referred to in this sub-section is repaid in a subsequent income year, the amount so repaid shall be deducted in computing the income for that subsequent year”.।Ordinance No. XXXVI of 1984 এর section 19D এর বিলোপ

৮। উক্ত Ordinance এর section 25 এর sub-section (1) এর-(ক) clause (g) এর “with borrowed capital” শব্দগুলির পর “from bank or financial institution” শব্দগুলি সন্নিবেশিত হইবে;(খ) clause (gg) এর “with borrowed capital” শব্দগুলির পর “from bank or financial institution” শব্দগুলি সন্নিবেশিত হইবে।Ordinance No. XXXVI of 1984 এর section 28 এর সংশোধন
৯। উক্ত Ordinance এর section 28 এর sub-section (3) এর “Bangladesh Shilpa Bank, Bangladesh Shilpa Rin Sangstha” শব্দগুলি ও কমার পরিবর্তে “Bangladesh Development Bank Ltd.” শব্দগুলি প্রতিস্থাপিত হইবে।Ordinance No. XXXVI of 1984 এর section 29 এর সংশোধন
১০। উক্ত Ordinance এর section 29 এর sub-section (1) এর clause (xviiia) এ উল্লিখিত “Bangladesh Shilpa Bank or Bangladesh Shilpa Rin Songstha” শব্দগুলির পরিবর্তে “Bangladesh Development Bank Ltd.” শব্দগুলি প্রতিস্থাপিত হইবে।Ordinance No. XXXVI of 1984 এর section 30 এর সংশোধন
১১। উক্ত Ordinance এর section 30 এর-(ক) clause (e) এর “two lakh and fifty thousand” শব্দগুলির পরিবর্তে “three lakh and fifty thousand” শব্দগুলি প্রতিস্থাপিত হইবে;(খ) clause (g) এর “profit” শব্দের পরিবর্তে “net profit disclosed in the statement of accounts” শব্দগুলি প্রতিস্থাপিত হইবে;(গ) clause (h) এর “profit” শব্দের পরিবর্তে “net profit disclosed in the statement of accounts” শব্দগুলি প্রতিস্থাপিত হইবে;(ঘ) clause (j) এর “disclosed net profit” শব্দগুলির পরিবর্তে “net profit disclosed in the statement of accounts” শব্দগুলি প্রতিস্থাপিত হইবে;(ঙ) clause (m) এর sub-clause (iii) এর প্রান্ত:স্থিত ফুলষ্টপ এর পরিবর্তে সেমিকোলন প্রতিস্থাপিত হইবে এবং অত:পর নিম্নরূপ নূতন clause (n) সংযোজিত হইবে, যথা:-“(n) any payment by way of any rent of any property, whether used for commercial or residential purposes, otherwise than by a crossed cheque or bank transfer.”।Ordinance No. XXXVI of 1984 এর section 33 এর সংশোধন
১২। উক্ত Ordinance এর section 33 এর clause (d) এর “(21A) or (24) applies” সংখ্যাগুলি, শব্দগুলি ও বন্ধনীগুলির পরিবর্তে “(21A), (21B), (24), (26), (27) or (28) applies” সংখ্যাগুলি, শব্দগুলি ও বন্ধনীগুলি প্রতিস্থাপিত হইবে।Ordinance No. XXXVI of 1984 এর section 35 এর সংশোধন
১৩। উক্ত Ordinance এর section 35 এর-(ক) sub-section (2) এর পরিবর্তে নিম্নরূপ sub-section (2) প্রতিস্থাপিত হইবে, যথা:-“(2) Notwithstanding anything contained in sub-section (1), the Board may, in case of any business or profession, or class of business or profession, or any other source of income, or any class of persons or class of income, by a general or special order, direct that the accounts and other documents shall be maintained in such manner and form, and the mode of payments of commercial transactions recorded in such manner and form, as may be prescribed or as may be specified in such direction; and thereupon the income of the assessee shall be computed on the basis of the accounts maintained, payments made and transactions recorded accordingly.”;(খ) sub-section (3) এর “certified by a chartered accountant” শব্দগুলির পরিবর্তে “certified by a chartered accountant to the effect that the accounts are maintained according to the Bangladesh Accounting Standard (BAS) and reported in accordance with the Bangladesh Financial Reporting Standard (BFRS)” শব্দগুলি, শব্দ সংক্ষেপ ও বন্ধনীগুলি প্রতিস্থাপিত হইবে।Ordinance No. XXXVI of 1984 এর section 46B এর সংশোধন
১৪। উক্ত Ordinance এর section 46B এর-(ক) উপান্তটীকার “2015” সংখ্যার পরিবর্তে “2019” সংখ্যা প্রতিস্থাপিত হইবে;(খ) sub-section (1) -(অ) এ উল্লিখিত ‘‘2015” সংখ্যার পরিবর্তে ‘‘2019” সংখ্যা প্রতিস্থাপিত হইবে;(আ) এর clause (ii) এর পরিবর্তে নিম্নরূপ clause (ii) প্রতিস্থাপিত হইবে, যথা:-“(ii) Rajshahi, Khulna, Sylhet, Barisal and Rangpur divisions (excluding City Corporation area) and Rangamati, Bandarban and Khagrachari districts, for a period of ten years beginning with the month of commencement of commercial production of the said undertaking: | Period of Exemption | Rate of Exemption | | For the first and second year | 100% of income | | For the third year | 70% of income | | For the fourth year | 55% of income | | For the fifth year | 40% of income | | For the sixth year | 25% of income | | For the seventh to tenth year | 20% of income | Provided that any industry engaged in the production of item as referred to in clause (e) or clause (I) of sub-section (2) shall be entitled to exemption from tax under the provision of this section even if it is set up in the districts of Dhaka, Gazipur, Narayanganj or Chittagong.”;(গ) sub-section (2) এর clause (g) এর পর নিম্নরূপ নূতন clause (gg) সন্নিবেশিত হইবে, যথা:-“(gg) brick made of automatic Hybrid Hoffmann Kiln technology;“।Ordinance No. XXXVI of 1984 এর section 46C এর সংশোধন
১৫। উক্ত Ordinance এর section 46C এর-(ক) উপান্তটীকার “2015” সংখ্যার পরিবর্তে “2019” সংখ্যা প্রতিস্থাপিত হইবে;(খ) sub-section (1) এর “2015” সংখ্যার পরিবর্তে “2019” সংখ্যা প্রতিস্থাপিত হইবে।Ordinance No. XXXVI of 1984 এর section 49 এর সংশোধন
১৬। উক্ত Ordinance এর section 49 এর sub-section (1) এর-(ক) বিলুপ্ত clause (i) এর পর নিম্নরূপ নূতন clause (ii) সন্নিবেশিত হইবে, যথা:-“(ii) income derived on account of travel agency commission or incentive bonus;”;(খ) clause (zz) এর প্রান্ত:স্থিত ফুলস্টপ এর পরিবর্তে সেমিকোলন প্রতিস্থাপিত হইবে এবং অতঃপর নিম্নরূপ নূতন clauses (zza), (zzb), (zzc), (zzd) ও (zze) সংযোজিত হইবে, যথা:-“(zza) income derived from insurance policy;(zzb) deduction of tax from local letter of credit (L/C);(zzc) income derived from any fees, revenue sharing, etc. from cellular mobile phone operator;(zzd) income from transfer of share of any stock exchange;(zze) income from transfer of share of company listed in any stock exchange;(zzf) income derived from lease of property.”।Ordinance No. XXXVI of 1984 এর section 51 এর সংশোধন
১৭। উক্ত Ordinance এর section 51 এর-(ক) sub-section (1) এর-(অ) “ten per cent (10%)” শব্দগুলি, সংখ্যা, চিহ্ন ও বন্ধনীগুলির পরিবর্তে “five per cent (5%)” শব্দগুলি, সংখ্যা, চিহ্ন ও বন্ধনীগুলি প্রতিস্থাপিত হইবে;(আ) প্রান্ত:স্থিত কোলন এর পরিবর্তে ফুলস্টপ প্রতিস্থাপিত হইবে এবং অত:পর proviso টি বিলুপ্ত হইবে;(খ) sub-section (3) বিলুপ্ত হইবে।Ordinance No. XXXVI of 1984 এর section 52 এর সংশোধন

১৯। উক্ত Ordinance এর section 52A এর sub-section (3) এর-(ক) clause (a) এর “Taxpayer’s Identification Number” শব্দগুলির পরিবর্তে “twelve-digit Taxpayer’s Identification Number” শব্দগুলি প্রতিস্থাপিত হইবে;(খ) clause (b) এর “Taxpayer’s Identification Number” শব্দগুলির পরিবর্তে “twelve-digit Taxpayer’s Identification Number” শব্দগুলি প্রতিস্থাপিত হইবে;(গ) “Explanation” এর clause (a) এর “advertising” শব্দটির পর “or actuarial service” শব্দগুলি সন্নিবেশিত হইবে।Ordinance No. XXXVI of 1984 এর section 52D এর সংশোধন
২০। উক্ত Ordinance এর section 52D এর proviso এর প্রান্ত:স্থিত ফুলস্টপ এর পরিবর্তে কোলন প্রতিস্থাপিত হইবে এবং অত:পর নিম্নরূপ নূতন proviso সংযোজিত হইবে, যথা:-“Provided further that no tax shall be deducted under this section where the cumulative investment at the end of the income year in the pensioners’ savings certificate or wage earners development bond does not exceed five lakh taka.”।Ordinance No. XXXVI of 1984 এর section 52F এর সংশোধন
২১। উক্ত Ordinance এর section 52F এর clauses (a), (b) ও (c) এর পরিবর্তে নিম্নরূপ clauses (a), (b), (c) ও (d) প্রতিস্থাপিত হইবে, যথা:-“(a) taka forty five thousand for one section brick field;(b) taka seventy thousand for one and half section brick field;(c) taka ninety thousand for two section brick field;(d) taka one lakh and fifty thousand for brick field producing bricks through automatic machine.”।Ordinance No. XXXVI of 1984 এ নূতন section 52JJ এর সন্নিবেশ
২২। উক্ত Ordinance এর বিলুপ্ত section 52J এর পর নিম্নরুপ নূতন section 52JJ সন্নিবেশিত হইবে, যথা:-“52JJ”. Collection of tax from travel agent.- Any person responsible for paying to a resident, any sum by way of commission or discount or incentive bonus or any other benefits convertible into money, called by whatever name, for selling tickets of an airline, or for carrying cargo by air, shall deduct or collect advance tax at the rate of three per cent at the time of paying such commission or incentive bonus or any other benefits or allowing discount.”।Ordinance No. XXXVI of 1984 এর section 52N এর সংশোধন
২৩। উক্ত Ordinance এর section 52N এর “four per cent” শব্দগুলির পরিবর্তে “six per cent” শব্দগুলি প্রতিস্থাপিত হইবে।Ordinance No. XXXVI of 1984 এর section 52S এর সংশোধন
২৪। উক্ত Ordinance এর section 52S এর-(ক) উপান্তটীকার “soft drink” শব্দগুলির পর ”, etc.” কমা ও শব্দ সন্নিবেশিত হইবে;(খ) দুইবার উল্লিখিত “soft drinks” শব্দগুলির পর, উভয়স্থানে, “or mineral or bottled water” শব্দগুলি সন্নিবেশিত হইবে।Ordinance No. XXXVI of 1984 এ নূতন sections 52T, 52U ও 52V এর সংযোজন
২৫। উক্ত Ordinance এর section 52S এর পর নিম্নরুপ নূতন sections 52T, 52U ও 52V সংযোজিত হইবে, যথা:-“52T. Deduction of tax from any payment in excess of premium paid on life insurance policy. - Any person responsible for paying to a resident, any sum in excess of premium paid for any life insurance policy maintained with any life insurance company, shall deduct, at the time of payment of such excess amount to the policy holder, income tax at the rate of five per cent on such sum:Provided that no deduction of tax shall be made in case of death of such policy holder.52U. Deduction from payment on account of local letter of credit. - The bank or financial institution, through which any local letter of credit or any financing agreement, called by whatever name, is made between two or more persons within the country for purchasing or procuring of any goods and proceeds of such goods are paid, shall deduct tax at the rate of three per cent, on the total proceeds exceeding five lakh taka, at the time of paying or crediting such proceeds to the account of the person or persons providing such goods:Provided that no tax shall be deducted under this section from the payment related to local letter of credit (L/C) and any other financing agreement in respect of purchase or procurement of rice, wheat, potato, onion, garlic, peas, chickpeas, lentils, ginger, turmeric, dried chillies, pulses, maize, coarse flour, flour, salt, edible oil, sugar, black pepper, cinnamon, cardamom, clove, date, cassia leaf and all kinds of fruits.52V. Deduction from payment by cellular mobile phone operator.- The Principal Officer of a cellular mobile phone operator company responsible for making any payment, on account of any revenue sharing or any license fees or any other fees or charges, called by whatever name, to the regulatory authority, shall deduct tax at the rate of ten percent of such payment at the time of credit to the payee or at the time of payment thereof, whichever is earlier.”।Ordinance No. XXXVI of 1984 এর section 53A এর সংশোধন
২৬। উক্ত Ordinance এর section 53A এর sub-section (1) এর “any college or school” শব্দগুলির পর “or hospital or clinic or diagnostic centre” শব্দগুলি সন্নিবেশিত হইবে।Ordinance No. XXXVI of 1984 এর section 53DDD এর সংশোধন

২৯। উক্ত Ordinance এর section 53F এর sub-section (1) এর -(ক) clause (a) এর “Taxpayer’s Identification Number” শব্দগুলির পরিবর্তে “twelve-digit Taxpayer’s Identification Number” শব্দগুলি প্রতিস্থাপিত হইবে;(খ) clause (b) এর “Taxpayer’s Identification Number” শব্দগুলির পরিবর্তে “twelve-digit Taxpayer’s Identification Number” শব্দগুলি প্রতিস্থাপিত হইবে।Ordinance No. XXXVI of 1984 এর section 53H এর সংশোধন
৩০। উক্ত Ordinance এর section 53H এর পরিবর্তে নিম্নরূপ section 53H প্রতিস্থাপিত হইবে, যথা:-“53H. Collection of tax on transfer, etc. of property. - (1) Any registering officer responsible for registering any document of a person under the provisions of clause (b), (c) or (e) of sub-section (1) of section 17 of the Registration Act, 1908 (XVI of 1908) shall not register any document unless tax is paid at such rate as may be prescribed in relation to the property to which the document relates and on which stamp-duty is chargeable under Stamp Act, 1899 (II of 1899) by the person whose right, title or interest is sought to be transferred, assigned, limited or extinguished thereby, at the time of registration of such document:Provided that the rate of tax shall not exceed taka ten lakh and eighty thousand per katha (1.65 decimal) for land, taka six hundred per square meter for any structure, building, flat, apartment or floor space on the land, if any, or four per cent of the deed value, whichever is higher.(2) Nothing in this section shall apply to a document relating to:(a) sale by a bank or any financial institution as a mortgagee empowered to sell;(b) mortgage of any property to any bank or any financial institution against any loan.Explanation.- For the purpose of this sub-section,“financial institution” shall mean the Bangladesh House Building Finance Corporation or the Bangladesh Development Bank Ltd.”।Ordinance No. XXXVI of 1984 এ নূতন section 53HH এর সন্নিবেশ
৩১। উক্ত Ordinance এর section 53H এর পর নিম্নরূপ নূতন section 53HH সন্নিবেশিত হইবে, যথা:-“53HH. Collection of tax from lease of property. - Any registering officer responsible for registering under the Registration Act, 1908 (XVI of 1908) any document in relation to any lease of immovable property for not less than ten years from any authority formed or established under any law shall not register such document unless tax is paid at a rate of four per cent by the lessor on the lease amount of such property.Explanation:-For the purpose of this section, “any authority” shall mean Rajdhani Unnayan Kartripakkha (RAJUK), Chittagong Development Authority (CDA), Rajshahi Development Authority (RDA), Khulna Development Authority (KDA) or National Housing Authority.”।Ordinance No. XXXVI of 1984 এর section 53K এর সংশোধন
৩২। উক্ত Ordinance এর section 53K এর-(ক) উপান্তটীকার “private radio station” শব্দগুলির পর ”, etc.” কমা ও শব্দ সন্নিবেশিত হইবে;(খ) “private radio station on account of advertisement of purchasing airtime of private television channel or radio station” শব্দগুলির পরিবর্তে “private radio station or any web site on account of advertisement of purchasing airtime of private television channel or radio station or such web site” শব্দগুলি প্রতিস্থাপিত হইবে।Ordinance No. XXXVI of 1984 এ নূতন section 53N ও 53O এর সন্নিবেশ
৩৩। উক্ত Ordinance এর section 53M এর পর নিম্নরূপ নূতন sections 53N ও 53O সন্নিবেশিত হইবে; যথা:-“53N. Collection of tax from transfer of share of shareholder of Stock Exchanges.-(1) The Principal Officer of a stock exchange shall deduct tax at the rate of fifteen per cent on any profits and gains arising from the transfer of share of a shareholder of stock exchange established under ‘‘এক্সচেঞ্জেস ডিমিউচ্যুয়ালাইজেশন আইন, ২০১৩, (২০১৩ সনের ১৫ নং আইন)’’ [Exchanges Demutualisation Act, 2013 (Act No. 15 of 2013)] at the time of transfer or declaration of transfer or according consent to transfer of such share, whichever is earlier.(2) For the purpose of the computation of profits and gains of share under sub-section (1), the cost of acquisition of such share shall be the cost of acquisition incurred before ‘‘এক্সচেঞ্জেস ডিমিউচ্যুয়ালাইজেশন আইন, ২০১৩, (২০১৩ সনের ১৫ নং আইন)’’ [Exchanges Demutualisation Act, 2013 (Act No. 15 of 2013)] came into force.53O. Deduction of tax from gains of securities traded in the Stock Exchanges.-(1) The Principal Officer of a company holding Trading Right Entitlement Certificate (TREC) under ‘‘এক্সচেঞ্জেস ডিমিউচ্যুয়ালাইজেশন আইন, ২০১৩, (২০১৩ সনের ১৫ নং আইন)’’ of any stock exchange dealing in shares or securities listed with such stock exchange or a bank or merchant bank or financial institution maintaining account of any investor of shares or securities shall deduct tax at the rate of ten percent of the realised gains derived by any compay, as defined in clause (20) of section 2 of this Ordinance, or firm before closing of a financial year.(2) For the purpose of calculation of the realised gain of a share or security under sub-section (1), proportionate average cost of such share or security including all commissions, fees or interest of any loan or advance paid or charged in relation to the transfer of share or security shall be deducted from the sale value of such shares or securities.”।Ordinance No. XXXVI of 1984 এর section 54 এর সংশোধন

৩৫। উক্ত Ordinance এর section 74 এর sub-section (1) এর পরিবর্তে নিম্নরূপ নূতন sub-section (1) প্রতিস্থাপিত হইবে, যথা:-“(1) Every person who is required to file a return under section 75, 77, 78, 89(2), 91(3) or 93(1) shall, on or before the date on which he files the return, pay the amount of tax payable by him on the basis of such return or as per provision of section 16CCC, which ever is higher, as reduced by the amount of any tax deducted from his income or paid by him in accordance with the provisions of this Chapter.”।Ordinance No. XXXVI of 1984 এর section 75 এর সংশোধন

৩৯। উক্ত Ordinance এর section 82BB এর-(ক) sub-section (2) এর পরিবর্তে নিম্নরূপ sub-section (2) প্রতিস্থাপিত হইবে, যথা:-“(2) A return shall be taken to be completed, if-(a) it is filed in accordance with provision of sub-section (2) or sub-section (3) of section 75;(b) tax has been paid in accordance with provision of section 74; and(c) twelve-digit Taxpayer’s Identification Number (TIN) is mentioned in it.”;(খ) sub-section (3) এর প্রান্ত:স্থিত ফুলস্টপ এর পরিবর্তে কোলন প্রতিস্থাপিত হইবে এবং অত:পর নিম্নরূপ proviso সংযোজিত হইবে, যথা:-“Provided that a return of income filed under this section shall not be selected for audit where such return shows at least twenty per cent higher income than the income assessed or shown in the return of the immediately by preceding assessment year and such return-(a) is accompanied by corroborative evidence in support of income exempted from tax;(b) is accompanied by a copy of bank statement or account statement, as the case may be, in support of any sum or aggregate of sums of loan exceeding taka five lakh taken from any person during the income year;(c) does not show receipt of gift during the year;(d) does not show any income chargeable to tax at a rate reduced under section 44; or(e) does not show or result any refund.”।Ordinance No. XXXVI of 1984 এর section 82C এর সংশোধন
৪০। উক্ত Ordinance এর section 82C এর sub-section (2) এর-(ক) clause (a) এর “or local Letter of Credit (L/C)” শব্দগুলি, শব্দসংক্ষেপ, চিহ্ন ও বন্ধনীগুলি বিলুপ্ত হইবে;(খ) clause (ee) এর পর নিম্নরূপ নূতন clause (eee) সন্নিবেশিত হইবে, যথা:-” (eee) the amount received as interest from pensioners’ savings certificate or wage earners development bond for which tax has been deducted under section 52D;” ;(গ) clause (s) এর পর নিম্নরূপ নূতন clauses (ss) ও (sss) সন্নিবেশিত হইবে, যথা:-“(ss) income derived from transfer of share of Stock Exchange on which tax is deducted under section 53N;(sss) income derived from transfer of share or securities traded in the stock exchange for which tax is deducted under section 53O;(ঘ) proviso এর পরিবর্তে নিম্নরূপ proviso প্রতিস্থাপিত হইবে, যথা:-“Provided that provisions of sub-section (1) shall not be applicable in the case of clause (a) of this sub-section with respect to-(a) a contractor of an oil company or a sub-contractor to the contractor of an oil company as may be prescribed;(b) oil marketing companies and its dealer or agent excluding petrol pump station;(c) any company engaged in oil refinery;(d) any company engaged in gas transmission.”।[বিলুপ্ত]

Penalty for not maintaining accounts in the prescribed manner-(1) Where any person, not having income from house property, has, without reasonable cause, failed to comply with the provisions of any order or rule made in pursuance of, or for the purposes of section 35(2), the Deputy Commissioner of Taxes, may impose upon him a penalty at the rate of a sum not exceeding-(a) one and a half times the amount of tax payable by him;(b) one hundred Taka where the total income of such person does not exceed the maximum amount on which tax is not chargeable.(2) Where any person, having income from house property, has, without reasonable cause, failed to comply with the provisions of any order or rule made in pursuance of, or for the purposes of section 35(2), the Deputy Commissioner of Taxes, shall impose upon him a penalty of fifty percent of taxes payable on house property income or five thousand taka, whichever is higher.”।Ordinance No. XXXVI of 1984 এর section 128 এর সংশোধন

Penalty for incorrect or false audit report by chartered accountant.- Where, in the course of any proceeding under this Ordinance, the Deputy Commissioner of Taxes, the Appellate Joint Commissioner, the Commissioner of Taxes (Appeals) or the Appellate Tribunal is satisfied beyond reasonable doubt that the audit report-(a) is not certified by a chartered accountant to the effect that the accounts are maintained according to the Bangladesh Accounting Standard (BAS) and reported in accordance with the Bangladesh Financial Reporting Standard (BFRS), or(b) is false or incorrect,he shall impose upon such chartered accountant a penalty of a sum not less than fifty thousand taka but not more than two lakh taka.”।Ordinance No. XXXVI of 1984 এর section 163 সংশোধন

৪৯। উক্ত Ordinance এর section 184A পরিবর্তে নিম্নরূপ section 184A প্রতিস্থাপিত হইবে, যথা:“184A. Requirement of certificate or acknowledgment receipt containing twelve-digit Taxpayer’s Identification Number of return of income in certain cases.- (1) Notwithstanding anything contained in this Ordinance, a person shall be required to submit an acknowledgement receipt containing twelve-digit Taxpayer’s Identification Number of the return of income filed for the immediate preceding assessment year or a certificate from the concerned Deputy Commissioner of Taxes or a computer generated certificate communicated by a computer system as may be authorised by the Board in this behalf or, in case of an old assessee, a certificate by the Deputy Commissioner of Taxes containing twelve-digit Taxpayer’s Identification Number and assessment completion information to the concerned authority, by any person at the time of-(a) opening a letter of credit for the purpose of import;(aa) submitting an application for the purpose of obtaining an import registration certificate;(b) renewal of trade license in the area of a city corporation or of a Paurashava ;(c) submitting tender documents for the purpose of supply of goods, execution of a contract or for rendering services;(d) submitting an application for membership of a club registered under কোম্পানী আইন, ১৯৯৪ (১৯৯৪ সনের ১৮ নং আইন);(e) issuance or renewal of license or enlistment of a surveyor of general insurance;(f) registration for purchase of land, building or an apartment situated within any city corporation or any paurashava of a district headquarter, deed value of which exceeds one lakh taka;(ff) provisions of clause (f) shall not apply in case of registration for purchase of land, building or an apartment situated within any city corporation, by a non resident Bangladeshi;(g) registration , change of ownership or renewal of fitness of a car, jeep or a microbus;(h) sanction of loan exceeding five lakh taka to a person by a commercial bank or a leasing company;(i) issue of credit card;(j) issue of practicing license to a doctor, a chartered accountant, a cost and management accountant, a lawyer or an income tax practitioner;(k) giving ISD connection to any kind of telephone;(l) being director of a company or sponsor shareholder of a company;(m) submission of application for a license as a Nikah Registrar under the Muslim Marriages and Divorces (Registration) Act. 1974 (LII of 1974):Provided that a person who has already obtained the license of a Nikah Registrar shall be required to obtain such certificate within three months from the date of commencement of this provision;(n) applying for or renewal of membership of any trade body;(o) submitting a plan for construction of building for the purpose of obtaining approval from Rajdhani Unnayan Kartipakkha (Rajuk), Chittagong Development Authority (CDA), Khulna Development Authority (KDA) and Rajshahi Development Authority (RDA);(p) issuance of drug license ;(q) applying for connection of gas for commercial purpose in a city corporation, paurashava or cantonment board;(r) applying for connection of electricity for commercial purpose in a city corporation, paurashava or cantonment board;(s) registration, change of ownership or renewal of fitness of a bus, truck, prime mover, lorry etc., plying for hire ;(t) issuance or renewal of survey certificate of a water vessel including launch, steamer, fishing trawler, cargo, coaster and dump-burge etc., plying for hire;(u) registration or renewal of certificate as agent of an insurance company;(v) permission or renewal of permission for the manufacture of bricks by Deputy Commissioner’s office in a district or Directorate of Environment, as the case may be;(w) submitting nomination form for any election in upazilla, paurasabha, city corporation or Jatiya Sangsad.(2) Having received the certificate or acknowledgement receipt of return of income as mentioned in sub-section (1), the concerned authority shall verify the authenticity of the twelve-digit Taxpayer’s Identification Number (TIN) as may be prescribed by the Board.।“Ordinance No. XXXVI of 1984 এর section 184AA এর সংশোধন

৫১। উক্ত Ordinance এর section 184B এর-(ক) sub-section (1) এর পরিবর্তে নিম্নরূপ sub-section (1) প্রতিস্থাপিত হইবে, যথা:-“(1) Every assessee or any person who applies manually or electronically for a Taxpayer’s Identification Number will be issued a certificate containing twelve-digit Taxpayer’s Identification Number and such other particulars in such manner as may be prescribed:Provided that twelve-digit Tax-payer’s Identification Number may be issued without any application where any income tax authority has found a person having taxable income during the year and possesses such necessary information of that person for issuance of twelve-digit Tax-payer’s Identification Number. ”;(খ) sub-section (2) এর উল্লিখিত “thereafter issue a new” শব্দগুলির পর “twelve-digit” শব্দগুলি সন্নিবেশিত হইবে;(গ) sub-section (2) এর পর নিম্নরূপ নূতন sub-section (3) সংযোজিত হইবে, যথা:-“(3) Every existing assessee having ten-digit Tax-payer’s Identification Number or a Temporary Registration Number (TRN) shall have to obtain twelve-digit Tax-payer’s Identification Number (TIN) before the last date of submission of return of income as required under section 75.”।Ordinance No. XXXVI of 1984 এর section 184C এর সংশোধন

৫৪। উক্ত Ordinance এর THIRD SCHEDULE এর-(ক) paragraph 3 এর TABLE এর-(অ) column 1 এর serial number 2 এবং উহার বিপরীতে column 2 এবং 3 এ উল্লিখিত এন্ট্রিসমূহের পর নিম্নরূপ নূতন serial number 2A এবং উহার বিপরীতে, যথাক্রমে, column 2 এবং 3 তে নিম্নরূপ এন্ট্রিসমূহ সন্নিবেশিত হইবে, যথা:-“2A. Office equipment-------------10”;(আ) column 1 এর serial number 3 এর বিপরীতে column 2 এর আওতাধীন এন্ট্রি 2(e) এর পরিবর্তে নিম্নরূপ এন্ট্রি 2(e) প্রতিস্থাপিত হইবে, যথা:-“(e) physical infrastructure-(i) Bridge ---------------------------- 2(ii) Road ----------------------------- 2(iii) Fly over ------------------------- 2(iv) Pavement runway, taxiway 2.5(v) Apron, termac 2.5(vi) Boarding bridge 10(vii) Communication, Navigation aid and other equipments 5.”।(খ) paragraph 7A এর পর নিম্নরূপ নূতন paragraph 7B সংযোজিত হইবে, যথা:-“7B. Accelerated depreciation allowance on machinery and plant.-(1) In the case of any machinery or plant (other than office appliances and road transport vehicles) which, not having been previously used in Bangladesh, has been or is used in an industrial undertaking as referred to in section 46B of the Ordinance and set up in Bangladesh between the first day of July, 2014 and the thirtieth day of June, 2019 (both days inclusive), an amount by way of accelerated depreciation allowance shall, subject to the conditions set out in sub-paragraph (2), be allowed and computed as follows, namely :- | (a) for the first year in which the undertaking starts commercial production | fifty per cent of the actual cost of plant and machinery to the assessee | | (b) for the second year — | thirty per cent of the actual cost of plant and machinery to the assessee | | (c) for the third year — | twenty per cent of the actual cost of plant and machinery to the assessee. | (2) The industrial undertaking referred to in sub-paragraph (1) shall fulfil the following conditions, namely:-(a) that the industrial undertaking is owned and managed by a Bangladeshi company, or a body corporate formed in pursuance of an Act of Parliament, having its registered office in Bangladesh;(b) that it belongs to the industrial undertaking as specified in sub-section (2) of section 46B;(c) that the particulars required for the purpose of entitlement to, or claiming accelerated depreciation allowance under this paragraph have been furnished; and(d) that the application in the prescribed form for accelerated depreciation allowance under this paragraph, as verified in the prescribed manner, is made to the Board within six months from the end of the month of commencement of commercial production; and the application is accompanied by a declaration in writing that the undertaking has not been approved for, and that no application in respect of the undertaking has been made or shall be made to the Board for approval of, exemption from payment of tax under section 46B or 46C of this Ordinance for any period.(3) The machinery or plant on which accelerated depreciation has been allowed under this paragraph shall not be entitled to any other depreciation allowance under this Ordinance.”;(গ) paragraph 10A এর-(অ) sub-paragraph (1) এর “license fees on or after” শব্দগুলির পরিবর্তে “license fees before or after” শব্দগুলি প্রতিস্থাপিত হইবে;(আ) sub-paragraph (2) এর “Spectrum Assignment fees” শব্দগুলির পর “,GSM license fees, license acquisition fees or license renewal fees” শব্দগুলি সন্নিবেশিত হইবে;(ই) sub-section (2) এর প্রান্ত:স্থিত ফুলস্টপ এর পরিবর্তে কোলন প্রতিস্থাপিত হইবে এবং অত:পর নিম্নরূপ Proviso সংযোজিত হইবে, যথা:-“Provided that the amortization of fees shall be allowed from assessment year 2013-2014.”।Ordinance No. XXXVI of 1984 এর SIXTH SCHEDULE, PART A এর সংশোধন
৫৫। উক্ত Ordinance এর SIXTH SCHEDULE, PART A এর-(ক) paragraph 1A এর পরিবর্তে নিম্নরূপ paragraph 1A প্রতিস্থাপিত হইবে, যথা:-“1A. Any service charge derived from operation of micro credit by a non-government organisation registered with NGO Affairs Bureau.Explanation.- For the purpose of this paragraph, “service charge” means any financial charge or interest or share of profit, called by whatever name, paid or payable by the loan recipient for the amount borrowed under micro credit programme from the non-government organisation. ”;(খ) paragraph 2 এর “Any income of a religious or charitable institution derived from voluntary contributions” শব্দগুলির পরিবর্তে “Any voluntary contributions received by a religious or charitable institution” শব্দগুলি প্রতিস্থাপিত হইবে;(গ) paragraph 4 এর sub-paragraph (2) এর “Companies Profits (Workers Participation) Act, 1968 (XII of 1968)” শব্দগুলি, কমা, সংখ্যাগুলি ও বন্ধনীগুলির পরিবর্তে ‘‘ বাংলাদেশ শ্রম আইন, ২০০৬ (২০০৬ সনের ৪২ নং আইন), Bangladesh Labour Act, 2006 (Act No. XLII of 2006)” শব্দগুলি, কমাগুলি, সংখ্যাগুলি ও বন্ধনীগুলি প্রতিস্থাপিত হইবে;(ঘ) paragraph 11A এর “ten thousand” শব্দগুলির পরিবর্তে “twenty thousand” শব্দগুলি প্রতিস্থাপিত হইবে;(ঘঘ) paragraph 21 এর sub-paragraph (d) এর “Companies Profit (Workers Participation), Act, 1968 (XII of 1968)” শব্দগুলি, কমা, সংখ্যাগুলি ও বন্ধনীগুলির পরিবর্তে “বাংলাদেশ শ্রম আইন, ২০০৬ (২০০৬ সনের ৪২ নং আইন), Bangladesh Labour Act, 2006 (Act. Any sum or aggregate of sums received as interest from pensioners’ savings certificate or wage earners bond where the total accumulated investment at the end of the relevant income year in such certificate or bond does not exceed taka five lakh.”;(ছ) paragraph 33 এর-(অ) “software development and” শব্দগুলির পরিবর্তে “software development or Nationwide Telecommunica-tion Transmission Network (NTTN) or ” ’’শব্দগুলি, শব্দসংক্ষেপ ও বন্ধনীগুলি প্রতিস্থাপিত হইবে;(আ) “2015” সংখ্যার পরিবর্তে “2019” সংখ্যা প্রতিস্থাপিত হইবে;(জ) paragraph 34 এর sub-paragraph (a) এর পরিবর্তে নিম্নরূপ sub-paragraph (a) প্রতিস্থাপিত হইবে, যথা:-“(a) if such income exceeds taka one lakh and fifty thousand, the person shall invest an amount not less than ten percent of the said income in the purchase of bond or securities issued by the Government within six months from the end of the income year and hold such bond or securities till maturity of such bond or securities;”;(ঝ) paragraph 44 এর-(অ) “2015” সংখ্যাগুলির পরিবর্তে “2019” প্রতিস্থাপিত হইবে;(আ) sub-paragraph (ii) এর পরিবর্তে নিম্নরূপ sub-paragraph (ii) প্রতিস্থাপিত হইবে, যথা:-(ii) Rajshahi, Khulna, Sylhet, Rangpur and Barisal divisions and Rangamati, Bandarban and Khagrachari districts for a period of ten years beginning with the month of commencement of commercial exhibition :| Period of Exemption | Rate of Exemption |

৫৭। Income-tax Ordinance, 1984 (Ord. No. XXXVI of 1984) এর আওতায় ২০১৪ সালের ১ জুলাই হইতে আরদ্ধ কর বৎসরের জন্য কোন কর নির্ধারণের ক্ষেত্রে তফসিল-২ এর দ্বিতীয় অংশে নির্দিষ্ট হার অনুযায়ী সারচার্জ ধার্য হইবে।আয়কর
৫৬। (১) উপ-ধারা (৩) এর বিধানাবলী সাপেক্ষে, ২০১৪ সালের ১ জুলাই তারিখে আরদ্ধ কর বৎসরের জন্য কোন কর নির্ধারণের ক্ষেত্রে এই আইনের তফসিল-২ এ নির্দিষ্ট কর হার অনুযায়ী আয়কর ধার্য হইবে।(২) যে সকল ক্ষেত্রে Income-tax Ordinance, 1984 (Ord. No. XXXVI of 1984) এর SECOND SCHEDULE (লটারী আয় সংক্রান্ত) প্রযোজ্য হইবে সে সকল ক্ষেত্রে আরোপণযোগ্য কর উক্ত SCHEDULE অনুসারেই ধার্য করা হইবে, কিন্তু করের হার নির্ধারণের ক্ষেত্রে উপ-ধারা (১) এর বিধান প্রয়োগ করিতে হইবে।(৩) Income-tax Ordinance, 1984 (Ord. No. XXXVI of 1984) এর Chapter VII অনুসারে কর কর্তনের নিমিত্ত তফসিল-২ এ (আয়কর হার সংক্রান্ত) বর্ণিত হার ২০১৪ সালের ১ জুলাই তারিখে আরদ্ধ এবং ২০১৫ সালের ৩০ জুন তারিখে সমাপ্য বৎসরের জন্য প্রযোজ্য হইবে।(৪) এই ধারায় এবং এই ধারার অধীন আরোপিত আয়কর হারের উদ্দেশ্যে ব্যবহৃত ‘‘মোট আয় (total income)” বলিতে Income-tax Ordinance, 1984 (Ord. No. XXXVI of 1984) এর বিধান অনুসারে নিরূপিত মোট আয় (total income) বুঝাইবে।১৯৯১ সনের ২২ নং আইনের ধারা ৯ এর সংশোধন
৫৮। মূল্য সংযোজন কর আইন, ১৯৯১ (১৯৯১ সনের ২২ নং আইন), অতঃপর উক্ত আইন বলিয়া উল্লিখিত, এর ধারা ৯ এর উপ-ধারা (১) এর দফা (ক) তে উল্লিখিত ‘‘পণ্য উৎপাদনে’’ শব্দগুলির পর ‘‘বা সেবা প্রদানে’’ শব্দগুলি সন্নিবেশিত হইবে।১৯৯১ সনের ২২ নং আইনের ধারা ১৫ এর সংশোধন
৫৯। উক্ত আইনের ধারা ১৫ এর উপ-ধারা (৩ক) বিলুপ্ত হইবে।১৯৯১ সনের ২২ নং আইনের ধারা ২৪ এর সংশোধন
৬০। উক্ত আইনের ধারা ২৪ এর উপ-ধারা (১) এর পরিবর্তে নিম্নরূপ উপ-ধারা (১) প্রতিস্থাপিত হইবে, যথা:-‘‘(১) মূল্য সংযোজন কর কর্মকর্তাগণ এই আইনের অধীন তাহাদের দায়িত্ব পালনের জন্য নিম্নবর্ণিত কর্তৃপক্ষ, কর্মকর্তা বা সদস্যের সহায়তা যাচনা করিতে পারিবে এবং উহারা উক্তরূপ সহায়তা প্রদানে বাধ্য থাকিবে, যথা:-(ক) বাংলাদেশ পুলিশ, বর্ডার গার্ড বাংলাদেশ, বাংলাদেশ কোস্ট গার্ড ও আনসার বাহিনীর যে কোনো সদস্য;(খ) মূল্য সংযোজন কর, আবগারী শুল্ক, আয়কর ও মাদক দ্রব্য সংক্রান্ত কর্মকাণ্ড পরিচালনা ও নিয়ন্ত্রণকারী সকল কর্মকর্তা;(গ) গ্যাস, বিদ্যুৎ, পানি, টেলিফোন বা অনুরূপ সেবা প্রদানকারী সংস্থার সকল কর্মকর্তা;(ঘ) সকল ব্যাংক কর্মকর্তা;(ঙ) ইউনিয়ন পরিষদ, উপজেলা পরিষদ, পৌরসভা, জেলা পরিষদ ও সিটি কর্পোরেশনের কর্তৃপক্ষ; এবং(চ) অন্য যে কোনো সরকারী কর্মকর্তা।’’।১৯৯১ সনের ২২ নং আইনের ধারা ২৬ এর সংশোধন

৬২। উক্ত আইনের ধারা ৩৭ এর উপ-ধারা (২) এর দফা (ঙ) তে উল্লিখিত ‘‘উপকরণ ক্রয় সংক্রান্ত তথ্য’’ শব্দগুলির পর ‘‘২৪ ঘন্টার মধ্যে’’ সংখ্যা ও শব্দগুলি সন্নিবেশিত হইবে।১৯৯১ সনের ২২ নং আইনের ধারা ৪১ এর সংশোধন
৬৩। উক্ত আইনের ধারা ৪১ এ উল্লিখিত ‘‘উপযুক্ত জরিমানা প্রদানপূর্বক’’ শব্দগুলির পরিবর্তে ‘‘ফাঁকিকৃত করের সর্বনিম্ন এক চতুর্থাংশ হইতে সর্বোচ্চ অর্ধাংশ পর্যন্ত জরিমানা আরোপণপূর্বক’’ শব্দগুলি প্রতিস্থাপিত হইবে।১৯৯১ সনের ২২ নং আইনের দ্বিতীয় তফসিলের সংশোধন
৬৪। উক্ত আইনের দ্বিতীয় তফসিলের অনুচ্ছেদ ৭ এর -(ক) দফা (ঘ) বিলুপ্ত হইবে;(খ) দফা (ঙ) এর পরিবর্তে নিম্নরূপ দফা (ঙ) প্রতিস্থাপিত হইবে, যথা:-‘‘(ঙ) কৃষিকাজের সহিত সংশ্লিষ্ট পোকামাকড় দমন ও বালাইনাশক কার্যক্রম;’’;(গ) দফা (ছ) এর প্রান্তস্থিত দাঁড়ির পরিবর্তে সেমিকোলন প্রতিস্থাপিত হইবে, এবং অতঃপর নিম্নরূপ নূতন দফা (জ) সংযোজিত হইবে, যথা:-‘‘(জ) ইউনিয়ন পরিষদ কর্তৃক পরিচালিত কাজের বিনিময়ে খাদ্য (কাবিখা) কর্মসূচী এবং কাজের বিনিময়ে টাকা (কাবিটা) কর্মসূচী।’’।১৯৯১ সনের ২২ নং আইনের তৃতীয় তফসিলের প্রতিস্থাপন
৬৫। উক্ত আইনের তৃতীয় তফসিলের পরিবর্তে নিম্নরূপ তৃতীয় তফসিল প্রতিস্থাপিত হইবে, যথা:-স্বাস্থ্য উন্নয়ন সারচার্জ
৬৬। (১) বাংলাদেশে আমদানিকৃত ও উৎপাদিত তামাকজাত সকল ধরনের পণ্যের উপর মূল্যভিত্তিক ১% হারে স্বাস্থ্য উন্নয়ন সারচার্জ আরোপ করা হইবে।(২) Customs Act, 1969 (IV of 1969) এবং তদধীন প্রণীত বিধিমালার অধীন আমদানি শুল্ক (Customs duty) যে সময় এবং পদ্ধতিতে আরোপ ও আদায় করা হয় সেই একই সময় এবং পদ্ধতিতে বাংলাদেশে আমদানিকৃত তামাকজাত সকল পণ্যের ক্ষেত্রে উপ-ধারা (১) এর অধীন সারচার্জ আরোপ ও আদায়যোগ্য হইবে।(৩) মূল্য সংযোজন কর আইন, ১৯৯১ (১৯৯১ সনের ২২ নং আইন) এবং তদধীন প্রণীত বিধিমালার অধীন মূল্য সংযোজন কর যে সময় এবং পদ্ধতিতে আরোপ ও আদায় করা হয় সেই একই সময় এবং পদ্ধতিতে বাংলাদেশে উৎপাদিত তামাকজাত সকল পণ্যের ক্ষেত্রে উপ-ধারা (১) এর অধীন সারচার্জ আরোপ ও আদায়যোগ্য হইবে।(৪) এই ধারার উদ্দেশ্য পূরণকল্পে, জাতীয় রাজস্ব বোর্ড -(ক) সরকারি গেজেটে প্রজ্ঞাপন দ্বারা, বিধিমালা প্রণয়ন করিতে পারিবে; বা(খ) সাধারণ বা বিশেষ আদেশ জারী করিতে পারিবে।পরিবেশ সুরক্ষা সারচার্জ
৬৭। (১) পরিবেশ দূষণকারী শিল্প প্রতিষ্ঠান কর্তৃক বাংলাদেশে উৎপাদিত সকল ধরনের পণ্যের উপর মূল্যভিত্তিক ১% হারে পরিবেশ সুরক্ষা সারচার্জ আরোপ করা হইবে।(২) মূল্য সংযোজন কর আইন, ১৯৯১ (১৯৯১ সনের ২২ নং আইন) এবং তদধীন প্রণীত বিধিমালার অধীন মূল্য সংযোজন কর যে সময় এবং পদ্ধতিতে আরোপ ও আদায় করা হয় সেই একই সময় এবং পদ্ধতিতে পরিবেশ দূষণকারী শিল্প প্রতিষ্ঠান কর্তৃক বাংলাদেশে উৎপাদিত সকল ধরনের পণ্যের ক্ষেত্রে উপ-ধারা (১) এর অধীন সারচার্জ আরোপ ও আদায়যোগ্য হইবে।(৩) জাতীয় রাজস্ব বোর্ড, পরিবেশ ও বন মন্ত্রণালয়ের সহিত পরামর্শক্রমে, সরকারি গেজেটে প্রজ্ঞাপন দ্বারা, পরিবেশ দূষণকারী শিল্প প্রতিষ্ঠান নির্দিষ্ট করিবে।(৪) এই ধারার উদ্দেশ্য পূরণকল্পে, জাতীয় রাজস্ব বোর্ড-(ক) সরকারি গেজেটে প্রজ্ঞাপন দ্বারা, বিধিমালা প্রণয়ন করিতে পারিবে; বা(খ) সাধারণ বা বিশেষ আদেশ জারী করিতে পারিবে।(৫) এই ধারার কোনো বিধান বাংলাদেশ পরিবেশ সংরক্ষণ আইন, ১৯৯৫ (১৯৯৫ সনের ১নং আইন) এর কোনো বিধানকে ক্ষুণ্ণ করিবে না।তথ্য ও যোগাযোগ প্রযুক্তি উন্নয়ন সারচার্জ
