সরকারের আর্থিক প্রস্তাবাবলী কার্যকরকরণ এবং কতিপয় আইন সংশোধনকল্পে প্রণীত আইন

Provided that where the Board, on an application made in this behalf, gives a certificate in writing that the person rendering such services is otherwise exempted from tax under any provision of this Ordinance, the payment referred to in this section shall be made without any deduction or with deduction at a lesser rate for that income year.’’।
Preamble
যেহেতু সরকারের আর্থিক প্রস্তাবাবলী কার্যকরকরণ এবং নিম্নবর্ণিত উদ্দেশ্যসমূহ পূরণকল্পে কতিপয় আইন সংশোধন করা সমীচীন ও প্রয়োজনীয়;সেহেতু এতদ্দ্বারা নিম্নরূপ আইন করা হইল:—Sections/Articles
সংক্ষিপ্ত শিরোনাম ও প্রবর্তন
১। (১) এই আইন অর্থ আইন, ২০১৫ নামে অভিহিত হইবে।(২) এই আইনের দ্বিতীয় অধ্যায়, তৃতীয় অধ্যায় এবং পঞ্চম অধ্যায় অবিলম্বে কার্যকর হইবে।(৩) এই আইনের চতুর্থ অধ্যায়ের ধারা ৯, ২০১৬ সনের ১ জুলাই তারিখে এবং ধারা১০ হইতে ৬৬, ২০১৫ সনের ১ জুলাই তারিখে কার্যকর হইবে।Act No. I of 1944 এর FIRST SCHEDULE এর সংশোধন
২। Excises and Salt Act, 1944 (Act No. I of 1944) এর FIRST SCHEDULE এর PART-II এর SERVICES এর কলাম (1) এর Service Code-(ক) E032.00 এর বিপরীতে কলাম (3) তে উল্লিখিত ””Taka 10,000.00 (ten thousand)”” শব্দগুলি, সংখ্যাগুলি, কমা এবং বন্ধনীর পরিবর্তে ””Taka 15,000.00 (fifteen thousand)”” শব্দগুলি, সংখ্যাগুলি, কমা এবং বন্ধনী প্রতিস্থাপিত হইবে;(খ) E033.00 এর বিপরীতে কলাম (3) তে উল্লিখিত ””Taka 1000.00 (one thousand)”” শব্দগুলি, সংখ্যাগুলি এবং বন্ধনীর পরিবর্তে ””Taka 1500.00 (one thousand five hundred)”” শব্দগুলি, সংখ্যাগুলি এবং বন্ধনী প্রতিস্থাপিত হইবে।Act No. IV of 1969 এর section 13 এর সংশোধন
৩। Customs Act, 1969 (Act No. IV of 1969), অতঃপর উক্ত Act বলিয়া উল্লিখিত, এর section 13 এর sub-section (3) এর clause (b) এর পর নিম্নরূপ নূতন clause (c) সংযোজিত হইবে, যথা:-””(c) In case of suspension under clause (b), the Business Identification Number (BIN) of the licensee issued under মূল্য সংযোজন কর আইন, ১৯৯১ (১৯৯১ সনের ২২ নং আইন) shall remain suspended till the disposal of the matter.”” ।Act No. IV of 1969 এর section 26A এর সংশোধন
৪। উক্ত Act এর section 26A-(ক) এ উল্লিখিত ””bank”” শব্দটির পর ””, operator as defined in section 2(19) of বাংলাদেশ টেলিযোগাযোগ নিয়ন্ত্রণ আইন, ২০০১ or any statutory authority”” কমাগুলি, সংখ্যাগুলি, শব্দগুলি ও বন্ধনী সন্নিবেশিত হইবে; এবং(খ) এর clause (a) তে উল্লিখিত ””records”” শব্দটির পর ””including any modes of communication using telecommunication or radio apparatus”” শব্দসমূহ সন্নিবেশিত হইবে।Act No. IV of 1969 এর section 156 এর সংশোধন
৫। উক্ত Act এর section 156 এর sub-section (1) এর TABLE এর কলাম (1) এর ক্রমিক নং -(ক) 59 এর বিপরীতে কলাম (2) এ উল্লিখিত ‘‘Taka’’ শব্দটির প্রান্তস্থিত ‘(.)’ ফুলস্টপ এর পূর্বে “and such goods shall also be liable to confiscation” শব্দগুলি সংযোজিত হইবে; এবং(খ) 62 এর বিপরীতে কলাম (2) এ উল্লিখিত ‘‘Taka’’ শব্দটির প্রান্তস্থিত ’(.)’ ফুলস্টপ এর পূর্বে ‘‘and such goods shall also be liable to confiscation’’শব্দগুলি সংযোজিত হইবে।Act No. IV of 1969 এর section 196 এর সংশোধন
৬। উক্ত Act এর section 196 এর এর sub-section (4) এ উল্লিখিত ””Tribunal”” শব্দটির পর ””who has practical experience in customs and related matters”” শব্দগুলি সন্নিবেশিত হইবে।Act No. IV of 1969 এর section 198 এর সংশোধন
৭। উক্ত Act এর section 198 এর sub-section (1) এ উল্লিখিত ‘‘or measure any goods’’ শব্দগুলির পরিবর্তে ‘‘or measure and detain any goods in the prescribed manner, place and time in part or full as he deems proper’’ শব্দগুলি প্রতিস্থাপিত হইবে।Act No. IV of 1969 এর FIRST SCHEDULE এর প্রতিস্থাপন
৮। উক্ত Act এর ””FIRST SCHEDULE”” এর পরিবর্তে এই আইনের তফসিল-১ এ উল্লিখিত ””FIRST SCHEDULE”” (পৃথকভাবে মুদ্রিত) প্রতিস্থাপিত হইবে।Ordinance No. XXXVI of 1984 এর section 2 এর সংশোধন
৯। Income-tax Ordinance, 1984 (Ord. No. XXXVI of 1984), এর section 2 এর clause (35) এর পরিবর্তে নিম্নরূপ clause (35) প্রতিস্থাপিত হইবে, যথা:-””(35) “income year” means-(a) the period beginning with the date of setting up of a business and ending with the thirtieth day of June following the date of setting up of such business;(b) the period beginning with the date on which a source of income newly comes into existence and ending with the thirtieth day of June following the date on which such new source comes into existence;(c) the period beginning with the first day of July and ending with the date of discontinuance of the business or dissolution of the unincor- porated body or liquidation of the company, as the case may be;(d) the period beginning with the first day of July and ending with the date of retirement or death of a participant of the unincorporated body;(e) the period immediately following the date of retirement, or death, of a participant of the unincorporated body and ending with the date of retirement, or death, of another participant or the thirtieth day of June following the date of the retirement, or death, as the case may be;(f) in the case of bank, insurance or financial institution the period of twelve months commencing from the first day of January of the relevant year; or(g) in any other case the period of twelve months commencing from the first day of July of the relevant year;“;Ordinance No. XXXVI of 1984 এর section 16B এর প্রতিস্থাপন
১০। উক্ত Ordinance এর section 16B এর পরিবর্তে নিম্নরূপ section 16B প্রতিস্থাপিত হইবে, যথা :-””16B. Charge of additional tax.-Notwithstanding anything contained in any other provision of this Ordinance, where-(a) a public limited company, not being a banking or insurance company, listed with any stock exchange in Bangladesh, has not issued, declared or distributed dividend or bonus share equivalent to at least fifteen per cent (15%) of its paid up capital to its shareholders within a period of six months immediately following any income year, the company shall be charged additional tax at the rate of five per cent (5%) on the undistributed profit in addition to tax payable under this Ordinance; or(b) any person employs or allows, without prior approval of the Board of Investment or any competent authority of the Government, as the case may be, any individual not being a Bangladeshi citizen to work at his business or profession at any time during the income year, such person shall be charged additional tax at the rate of fifty per cent (50%) of the tax payable on his income or taka five lakh, whichever is higher in addition to tax payable under this Ordinance.Explanation.- For the purpose of clause (a), “undistributed profit” means accumulated profit including free reserve.””।Ordinance No. XXXVI of 1984 এর section 16CCC এর সংশোধন
১১। উক্ত Ordinance এর section 16CCC এর প্রান্ত:স্থিত ফুলস্টপ (.) এর পরিবর্তে কোলন (:) প্রতিস্থাপিত হইবে এবং অত:পর নিম্নরূপ proviso সংযোজিত হইবে, যথা:-””Provided that such rate of tax shall be zero point one zero per cent (0.10%) of such receipts for an industrial undertaking engaged in manufacturing of goods for the first three income years since commencement of its commercial production.””।Ordinance No. XXXVI of 1984 এর section 19 এর সংশোধন
১২। উক্ত Ordinance এর section 19 এর—(ক) sub-section (21) এর “crossed cheque drawn on a bank” শব্দগুলির পর ””or bank transfer”” শব্দগুলি সন্নিবেশিত হইবে;(খ) sun-section (27) এ, দুইস্থানে উল্লিখিত, ””paid up capital”” শব্দগুলির পরিবর্তে, উভয় স্থানে, ””paid up capital together with reserve and accumulated profit”” শব্দগুলি প্রতিস্থাপিত হইবে;(গ) sub-section (28) এর পর নিম্নরূপ নূতন sub-sections 29, 30 এবং 31 সংযোজিত হইবে, যথা :-“(29) Where an assessee, not being an assessee engaged in real estate business during any income year, purchases on credit any material for the purpose of construction of building or house property or its unit and fails to pay the sum or any part thereof representing the liability in respect of such purchase, the sum or any part thereof, which has not been paid in the following year in which such purchase was made, shall be deemed to be the income of the assessee for that income year classifiable under the head “Income from other sources”.(30) Where an assessee, in the course of any proceedings under this Ordinance, is found to have any sum or part thereof allowed or deducted but not spent in accordance with the provision of clause (h) of sub-section (1) of section 25 of this Ordinance, such unspent sum or part thereof shall be deemed to be the income of such assessee for that income year classifiable under the head “Income from house property”.(31) Where an assessee files a revised return under sections 78 or 93 and shows tax exempted income or income that is subject to reduced tax rate, so much of the excess as it exceeds the amount shown in the original return shall be deemed to be income for that income year classifiable under the head “Income from other sources”.”” ।Ordinance No. XXXVI of 1984 এর section 19BBBBB এর সংশোধন
১৩। উক্ত Ordinance এর section 19BBBBB এর sub-section (1) এর-(ক) clause (d) এর-(অ) sub-clause (i) এর ””taka one thousand”” শব্দগুলির পরিবর্তে ””taka six hundred”” শব্দগুলি প্রতিস্থাপিত হইবে;(আ) sub-clause (ii) এর ””taka one thousand and five hundred”” শব্দগুলির পরিবর্তে ””taka eight hundred”” শব্দগুলি প্রতিস্থাপিত হইবে;(খ) clause (e) এর-(অ) sub-clause (i) এর ””taka seven hundred”” শব্দগুলির পরিবর্তে ””taka four hundred”” শব্দগুলি প্রতিস্থাপিত হইবে;(আ) sub-clause (ii) এর ””taka one thousand”” শব্দগুলির পরিবর্তে ””taka six hundred”” শব্দগুলি প্রতিস্থাপিত হইবে।Ordinance No. XXXVI of 1984 এর section 19E এর সংশোধন
১৪। উক্ত Ordinance এর section 19E এর sub-section (3) এর-(ক) clause (c) এর প্রান্তস্থিত ””or”” শব্দটি বিলুপ্ত হইবে;(খ) clause (d) এর প্রান্তস্থিত ফুলস্টপ (.)এর পরিবর্তে সেমিকোলন (;) এবং ” or ” শব্দটি প্রতিস্থাপিত হইবে এবং অত:পর নিম্নরূপ নূতন clause (e) সন্নিবেশিত হইবে, যথা :-“(e) any income declared under this section which is ”(i) exempted from tax in the concerned income year; or(ii) chargeable to tax at a reduced rate in accordance with section 44 of this Ordinance” ।Ordinance No. XXXVI of 1984 এর section 28 এর সংশোধন
১৫। উক্ত Ordinance এর section 28 এর sub-section (3) এর ””Investment Corporation of Bangladesh”” শব্দগুলির পর ””, any financial institution”” কমা ও শব্দগুলি প্রতিস্থাপিত হইবে।Ordinance No. XXXVI of 1984 এর section 29 এর সংশোধন
১৬।উক্ত Ordinance এর section 29 এর sub-section (1) এর clause (xi) এর ””or plant”” শব্দগুলির পরিবর্তে ””, plant or any other fixed asset not being imported software” কমা ও শব্দগুলি প্রতিস্থাপিত হইবে।Ordinance No. XXXVI of 1984 এর section 30 এর সংশোধন
১৭। উক্ত Ordinance এর section 30 এর clause (e) এর ””three lakh and fifty thousand”” শব্দগুলির পরিবর্তে ””four lakh and fifty thousand”” শব্দগুলি প্রতিস্থাপিত হইবে।Ordinance No. XXXVI of 1984 এর section 33 এর সংশোধন
১৮। উক্ত Ordinance এর section 33 এর clause (d) এর ‘‘or (28)’’ শব্দ, সংখ্যা ও বন্ধনীর পরিবর্তে ‘‘, (28), (29) or (31)’’ কমা, সংখ্যাগুলি, শব্দ ও বন্ধনীগুলি প্রতিস্থাপিত হইবে।কমা, সংখ্যাগুলি, শব্দ ও বন্ধনীগুলি প্রতিস্থাপিত হইবে।Ordinance No. XXXVI of 1984 এর section 37 এর সংশোধন
১৯। উক্ত Ordinance এর section 37 এর-(ক) দ্বিতীয় provisoএর প্রান্ত:স্থিত ফুলস্টপ (.) এর পরিবর্তে কোলন (:) প্রতিস্থাপিত হইবে; এবং(খ) তৃতীয় proviso এর প্রান্তস্থিত ফুলস্টপ (.) এর পরিবর্তে কোলন (:) প্রতিস্থাপিত হইবে; এবং অত:পর নিম্নরূপ নূতন proviso সংযোজিত হইবে, যথা :-“Provided further that any loss in respect of any income from any head shall not be so set off against any income from manufacturing of cigarette.” ।Ordinance No. XXXVI of 1984 এর section 46B এর সংশোধন
২০। উক্ত Ordinance এর section 46B এর-(ক) sub-section (2) এর-(অ) clause (a) এর পর নিম্নরূপ নূতন clause (aa) সন্নিবেশিত হইবে, যথা :-“(aa) automobile manufacturing industry;”;(আ) clause (d) এর পর নিম্নরূপ নূতন clause (dd) সন্নিবেশিত হইবে, যথা :-“(dd) bi-cycle manufacturing industry;”;(ই) clause (gg) এর “Hoffmann Kiln” শব্দগুলির পর “or Tunnel Kiln” শব্দগুলি সন্নিবেশিত হইবে;(ঈ) clause (q) এর ”or” শব্দটি বিলুপ্ত হইবে, এবং অত:পর clause (q) এর পর নিম্নরূপ নূতন clause (qq) সন্নিবেশিত হইবে, যথা :-“(qq) tyre manufacturing industry; or ”;(খ) sub-section (11) এর “are not fulfilled” শব্দগুলির পর “or any individual not being a Bangladeshi citizen is employed or allowed to work without prior approval of the Board of Investment or any competent authority of the Government, as the case may be, for this purpose” শব্দগুলি ও কমাগুলি সন্নিবেশিত হইবে।Ordinance No. XXXVI of 1984 এর section 46C এর সংশোধন
২১। উক্ত Ordinance এর section 46C এর sub-section (9) এর ””are not fulfilled”” শব্দগুলির পর ””or any individual not being a Bangladeshi citizen is employed or allowed to work without prior approval of the Board of Investment or any competent authority of the Government, as the case may be, for this purpose”” শব্দগুলি ও কমাগুলি সন্নিবেশিত হইবে।Ordinance No. XXXVI of 1984 এর section 47 এর সংশোধন

২৩। উক্ত Ordinance এর section 49 এর sub-section (1)এর clause (zzf) এর প্রান্তস্থিত ফুলস্টপ (.) এর পরিবর্তে সেমিকোলন (;) প্রতিস্থাপিত হইবে; এবং উক্ত clause এর পর নিম্নরূপ clause (zzff) সন্নিবেশিত হইবে, যথা :-“(zzff) deduction of tax from any sum paid by real estate developer to land owner.”।Ordinance No. XXXVI of 1984 এর section 50 এর সংশোধন
২৪। উক্ত Ordinance এর section 50 এর-(ক) sub-section (1) এর পর নিম্নরূপ নূতন sub-sections (1A) এবং (1B) সন্নিবেশিত হইবে, যথা :-‘‘(1A) Notwithstanding the provision of sub section (1), where any Government official is acting as Drawing and Disbursing Officer (DDO) or making or signing a bill for himself or for any other official subordinate to him to draw salary from the Government or any authority, as the case may be, he shall, at the time of making or signing such bill, deduct tax at a rate representing the average of the rates applicable to the estimated total income of such officials if such annual salary chargeable to tax exceeds the taxable limit for that income year.; এবং(1B) For the purposes of sub-section (1A), respective Government Accounts Office shall issue a tax deduction certificate in prescribed form within the thirty first day of July following the financial year.’’;(খ) sub-section (2) এর ‘‘sub-section (1)’’ শব্দ, সংখ্যা ও বন্ধনীগুলির পরিবর্তে ‘‘sub-sections (1) and (1A)” শব্দ, সংখ্যা ও বন্ধনীগুলি প্রতিস্থাপিত হইবে;(গ) sub-section (2A) এর ‘‘sub-section (1)’’ শব্দ, সংখ্যা ও বন্ধনীগুলির পরিবর্তে ‘‘sub-section (1) and (1A)” শব্দ, সংখ্যা ও বন্ধনীগুলি প্রতিস্থাপিত হইবে;(ঘ) sub-section (3) এর ‘‘sub-section (1)’’ শব্দ, সংখ্যা ও বন্ধনীগুলির পরিবর্তে ‘‘sub-section (1) and (1A)” শব্দ, সংখ্যা ও বন্ধনীগুলি প্রতিস্থাপিত হইবে।Ordinance No. XXXVI of 1984 এর section 51 এর সংশোধন

২৮। উক্ত Ordinance এর section 52AA এর পরিবর্তে নিম্নরূপ section 52AA প্রতিস্থাপিত হইবে, যথা :-””52AA. Deduction from the payment of certain services.-The Government or any other authority, corporation or body, including its units, the activities of which are authorised by any law or any company as defined in clause (20) of section 2 of this Ordinance or any banking company or any insurance company or any co-operative bank or any financial institution or any Non-Government Organisation registered with the NGO Affairs Bureau, or any school or any college or any university or any hospital or any clinic or any diagnostic centre responsible for making any payment which constitutes income of the payee shall deduct income tax at the rate specified below :| SL. ২৯। উক্ত Ordinance এর section 52B এর বিদ্যমান বিধান sub-section (1) হিসাবে সংখ্যায়িত হইবে এবং উক্তরূপ সংখ্যায়িত sub-section (1) এর পর নিম্নরূপ sub-section (2) সংযোজিত হইবে, যথা :-‘‘(2) Any person responsible for collecting Value Added Tax (VAT) in accordance with মূল্য সংযোজন কর আইন, ১৯৯১ (১৯৯১ সনের ২২ নং আইন) from cigarette manufacturers shall collect tax at the rate of three per cent (3%) of Maximum Retail Price (MRP) of such cigarette at the time of collection of such VAT.” ।Ordinance No. XXXVI of 1984 এর section 52D এর সংশোধন
৩০। উক্ত Ordinance এর section 52D এর দ্বিতীয় proviso এর-(ক) “or wage earners development bond” শব্দগুলি বিলুপ্ত হইবে;(খ) প্রান্তস্থিত ফুলস্টপ (.) এর পরিবর্তে কোলন (:) প্রতিস্থাপিত হইবে এবং অত:পর নিম্নরূপ নূতন proviso সংযোজিত হইবে, যথা :-‘‘Provided further that no tax shall be deducted from interest or profit arising from Wage earners development bond, US dollar premium bond, US dollar investment bond, Euro premium bond, Euro investment bond, Pound sterling investment bond or Pound sterling premium bond.”।Ordinance No. XXXVI of 1984 এর section 52JJ এর প্রতিস্থাপন
৩১। উক্ত Ordinance এর section 52JJ এর পরিবর্তে নিম্নরূপ section 52JJ প্রতিস্থাপিত হইবে, যথা :-“52JJ. Collection of tax from travel agent.- Any person responsible for paying on behalf of any airlines to a resident any sum by way of commission or discount or incentive bonus or any other benefits convertible into money called by whatever name for selling tickets of an airline or for carrying cargo by air shall deduct or collect advance tax at the rate of zero point three zero per cent (0.30%) of the total value of the tickets of the airlines or any charge for carrying cargo by air at the time of payment to such resident.Explanation.- For the purpose of computation of value of tickets or charge, any payment made in respect of any embarkation fees, travel tax, flight safety insurance, security tax and airport tax shall not be included in such value or charge.”।Ordinance No. XXXVI of 1984 এর section 52S এর সংশোধন

৪৪। উক্ত Ordinance এর section 54 এর পরিবর্তে নিম্নরূপ section 54 প্রতিস্থাপিত হইবে, যথা :-“54. Deduction of tax from dividends.- The principal officer of a company registered in Bangladesh, or of any other company, shall, at the time of paying any dividend to a shareholder, deduct tax on the amount of such dividend, in the case of a resident or a non-resident Bangladeshi,-(a) if the shareholder is a company, at the rate applicable to a company ;(b) if the shareholder is a person other than a company, at the rate of ten per cent (10%) where the person receiving such dividend furnishes his twelve-digit Taxpayer’s Identification Number (TIN) to the payer or fifteen per cent (15%) where the person receiving such dividend fails to furnish his twelve-digit Taxpayer’s Identification Number (TIN) to the payer.” ।Ordinance No. XXXVI of 1984 এর section 56 এর সংশোধন

৪৭। উক্ত Ordinance এর section 82BB এর sub-sections (1) এবং (2) এর পরিবর্তে নিম্নরূপ sub-sections (1) এবং (2) প্রতিস্থাপিত হইবে, যথা :-“(1) Subject to sub-sections (2) or (3) and section 93, where an assessee, either manually or electronically, furnishes a return of income mentioning twelve-digit Taxpayers Identification Number (TIN) in compliance with the conditions and within time specified in sub-section (2) of section 75 and pays tax in accordance with section 74, he shall be issued by the Deputy Commissioner of Taxes or any other official authorised by him, an acknowledgement of receipt of the return and such acknowledgement shall be deemed to be an order of the Deputy Commissioner of Taxes for the purpose of assessment.(2) On receipt of such return under sub-section (1), the Deputy Commissioner of Taxes shall”(a) process such return in the following manner, namely:”(i) the income shall be computed after making the adjustments in respect of any arithmetical error in the return and any incorrect claim, if such incorrect claim is apparent from the existence of any information in the return;(ii) the tax shall be computed on the basis of the income computed under sub-clause (i); and(iii) the sum payable by, or the amount of refund due to, the assessee shall be determined after adjustment of the tax and interest, if any, computed under sub-clause (ii) by any tax deducted at source, any tax collected at source, any advance tax paid, any tax paid under section 74 and any other amount paid by way of tax and interest;(b) send, after processing such return in accordance with the provision of clause (a), a notice of demand along with an intimation to the assessee specifying the income so computed, the liability to pay tax on such income, the amount of tax credit allowed, the sum determined to be payable by, or refundable to, him and such other particulars within thirty days of such computation as may be specified:Provided that no such intimation shall be sent after the expiry of a period of twelve months from the end of the financial year in which the return is furnished:Provided further that no demand notice requiring the assessee to pay more taxes shall be made unless the assessee is given an opportunity in writing in this regard.Explanation.-For the purposes of this section, “an incorrect claim apparent from the existence of any information in the return” shall mean a claim, on the basis of an entry, in the return”(i) of an item, which is inconsistent with another entry of the same, or some other item, in such return; or(ii) in respect of a deduction, where such deduction exceeds the specified statutory limit which may have been expressed as monetary amount, percentage, ratio or fraction.””।Ordinance No. XXXVI of 1984 এর section 82C এর সংশোধন

Penalty for failure to verify Taxpayer”s Identification Number.- Where a person, responsible for verification of the authenticity of twelve-digit Taxpayer”s Identification Number (TIN) in accordance with the provision of sub-section (2) of section 184A of this Ordinance, has, without reasonable cause, failed to comply with such requirement under that provision, the Deputy Commissioner of Taxes or any other income tax authority authorised by the Board for this purpose, as the case may be, may impose upon such person a penalty not exceeding taka fifty thousand.”””Ordinance No. XXXVI of 1984 এর section 127 এর সংশোধন

Income from dividend received from a company listed in any stock exchange in Bangladesh up to twenty five thousand taka.””;(খ) paragraph 20 এর পরিবর্তে নিম্নরূপ paragraph 20 প্রতিস্থাপিত হইবে, যথা :-””20. Any income up to taka two crore fifty lakh received by an assessee as gratuity””;(গ) paragraph 21 এর sub-paragraph (d) এর পরিবর্তে নিম্নরূপ sub-paragraph (d) প্রতিস্থাপিত হইবে, যথা :-“(d) a workers participation fund established under বাংলাদেশ শ্রম আইন, ২০০৬ (২০০৬ সনের ৪২ নং আইন) and received by a worker as defined in section 2(65) of the said Act.”;(ঘ) paragraph 22A এর ””dividend of”” শব্দগুলি বিলুপ্ত হইবে;(ঙ) paragraph 24 এর পর নিম্নরূপ নূতন paragraph 24A সংযোজিত হইবে, যথা:—””24A. ৬৫। (১) উপ-ধারা (৩) এর বিধানাবলী সাপেক্ষে, ২০১৫ সালের ১ জুলাই তারিখে আরব্ধ কর বৎসরের জন্য কোন কর নির্ধারণের ক্ষেত্রে এই আইনের তফসিল-২ এ নির্দিষ্ট কর হার অনুযায়ী আয়কর ধার্য হইবে।(২) যে সকল ক্ষেত্রে Income-tax Ordinance, 1984 (Ord. No. XXXVI of 1984) এর SECOND SCHEDULE (লটারী আয় সংক্রান্ত) প্রযোজ্য হইবে সে সকল ক্ষেত্রে আরোপণযোগ্য কর উক্ত SCHEDULE অনুসারেই ধার্য করা হইবে, কিন্তু করের হার নির্ধারণের ক্ষেত্রে উপ-ধারা (১) এর বিধান প্রয়োগ করিতে হইবে।(৩) Income-tax Ordinance, 1984 (Ord. No. XXXVI of 1984) এর Chapter VII অনুসারে কর কর্তনের নিমিত্ত তফসিল-২ এ (আয়কর হার সংক্রান্ত) বর্ণিত হার ২০১৫ সালের ১ জুলাই তারিখে আরব্ধ এবং ২০১৬ সালের ৩০ জুন তারিখে সমাপ্য বৎসরের জন্য প্রযোজ্য হইবে।(৪) এই ধারায় এবং এই ধারার অধীন আরোপিত আয়কর হারের উদ্দেশ্যে ব্যবহৃত ‘‘মোট আয় (total income)”” বলিতে Income-tax Ordinance, 1984 (Ord. ৬৭। মূল্য সংযোজন কর আইন, ১৯৯১ (১৯৯১ সনের ২২ নং আইন), অত:পর উক্ত আইন বলিয়া উল্লিখিত, এর ধারা ১৯ক এ উপান্তটীকাসহ উল্লিখিত ‘‘নিবন্ধন ব্যতীত’’ শব্দগুলির পরিবর্তে উভয়স্থানে ‘‘নিবন্ধন বা টার্নওভার তালিকাভুক্ত ব্যতীত’’ শব্দগুলি প্রতিস্থাপিত হইবে।১৯৯১ সনের ২২ নং আইনের ধারা ২৪ এর সংশোধন

৭১। উক্ত আইনের ধারা ৩৭ এর উপ-ধারা (২) এর-(ক) দফা (ক) এর পর নিম্নরূপ নূতন দফা (কক) সন্নিবেশিত হইবে, যথা:—‘‘(কক) নিবন্ধিত হওয়া সত্ত্বেও কর চালানপত্র ব্যতীত পণ্য বা সেবা গ্রহণ করেন, অথবা’’;(খ) দফা (ঙ) এ উল্লিখিত ‘‘২৪ ঘন্টার মধ্যে’’ সংখ্যা ও শব্দগুলির পরিবর্তে ‘‘৪৮ ঘন্টার মধ্যে’’ সংখ্যা ও শব্দগুলি প্রতিস্থাপিত হইবে।১৯৯১ সনের ২২ নং আইনের ধারা ৪৮ এর সংশোধন
৭২। উক্ত আইনের ধারা ৪৮ এ উল্লিখিত ‘‘পদমর্যাদায় সহকারী কমিশনার, মূল্য সংযোজন কর এর’’ শব্দগুলি ও কমার পরিবর্তে ‘‘সহকারী কমিশনার বা সহকারী পরিচালক, মূল্য সংযোজন কর পদমর্যাদার’’ শব্দগুলি ও কমা প্রতিস্থাপিত হইবে।১৯৯১ সনের ২২ নং আইনের দ্বিতীয় তফসিলের সংশোধন
৭৩। উক্ত আইনের দ্বিতীয় তফসিলের অনুচ্ছেদ ২ এর দফা (জ) এর প্রান্তস্থিত দাঁড়ির পরিবর্তে সেমিকোলন প্রতিস্থাপিত হইবে এবং অত:পর নিম্নরূপ নূতন দফা (ঝ) সংযোজিত হইবে, যথা:—‘‘(ঝ) সরকারি ও বেসরকারি এতিমখানা।’’।Footnotes
