Preamble

যেহেতু সরকারের আর্থিক প্রস্তাবাবলী কার্যকরকরণ এবং নিম্্নবর্ণিত উদ্দেশ্যসমূহ পূরণকল্পে কতিপয় আইন সংশোধন করা সমীচীন ও প্রয়োজনীয়;সেহেতু এতদ্‌দ্বারা নিম্নরূপ আইন করা হইল:-

সংক্ষিপ্ত শিরোনামা ও প্রবর্তন

১৷ (১) এই আইন অর্থ আইন, ২০০০ নামে অভিহিত হইবে৷(২) The Provisional Collection of Taxes Act, 1931 (XVI of 1931) এর অধীনে জারীকৃত ঘোষণা এবং উপ-ধারা (৩) ও উপ-ধারা (৪) এর বিধান সাপেতেগ, এই আইন ২০০০ সনের ১লা জুলাই তারিখে কার্যকর হইবে৷(৩) সরকার, সরকারী গেজেটে প্রজ্ঞাপন দ্বারা, যে তারিখ নির্ধারণ করিবে সেই তারিখে এই আইনের ধারা ৮ এর দফা (ক) এর উপ-দফা (আ), (ই), (ঈ) ও (উ), ধারা ১০ এর দফা (ক), ধারা ১৬ এর দফা (ক) এর উপ-দফা (আ) এবং দফা (গ), ধারা ১৭, ধারা ১৯, ধারা ২০ এর দফা (ক), ধারা ২১ এবং ধারা ৩৫ এর দফা (গ) কার্যকর হইবে৷(৪) ২০০১ সনের ১লা জানুয়ারী তারিখে এই আইনের ধারা ৫২ কার্যকর হইবে৷

২৷ Act No. II of 1899 এর section 7 এর সংশোধন

২৷ The Stamp Act, 1899 (II of 1899), অত:পর Stamp Act বলিয়া উল্লিখিত, এর section 7(1) এর “other than insurance as is referred to in section 506 of the Merchant Shipping Act, 1894” শব্দগুলি ও সংখ্যাগুলি বিলুপ্ত হইবে৷

৩৷ Act No. II of 1899 এ নূতন section 11A এর সন্নিবেশ

৩৷ The Stamp Act এর section 11 এর নিম্নরূপ নূতন section 11A সন্নিবেশিত হইবে, যথা:-“11A. Payment of stamp duties on insurance policy in certain cases by challan, pay order or bank draft.- Notwithstanding the other provisions of this Act or any other law for the time being in force, the Government may, by notification in the official gazette, direct that where the stamp duty payable on an insurance policy exceeds the amount specified in the notification, the entire stamp duty shall be paid only by treasury challan or account-payee pay order or account-payee bank draft in the manner prescribed by such notification or by rules.”৷

৪৷ Act No. II of 1899 এর Schedule I এর সংশোধন

৪৷ Stamp Act এর Schedule I এর Article 47 এর “POLICY OF INSURANCE” শিরোনামাধীন-(ক) উপ-শিরোনামা “A-Sea, Insurance” এবং তত্সংক্রান্ত্ম এন্ট্রিগুলির পরিবর্তে নিম্নরূপ উপ-শিরোনামা ও এন্ট্রিগুলি প্রতিস্থাপিত হইবে, যথা:-“A-Sea Insurance (see section 7)

(1) For or upon any voyage -
(i)    where the premium or consideration does not exceed the rate of twelve poisha or one-eighth (1/8) per centum of the amount insured by the policy.	Taka One;
(ii) in any other case, for every one thousand five hundred Taka or any part thereof of an insurance policy.	Taka One;
(2) For time -
(iii) for every one thousand Taka or for any part thereof of an insurance policy made for any time not exceeding 12 (twelve) months.	Taka One;”;

(খ) উপ শিরোনামা “C-Accident and Sickness Insurance” এবং তত্সংক্রান্ত্ম এন্ট্রিগুলির পরিবর্তে নিম্নরূপ উপ-শিরোনাম ও এন্ট্রিগুলি প্রতিস্থাপিত হইবে:-
“C-Accident and Sickness Insurance

Ben. Act I of 1932 এর FIRST SCHEDULE এর প্রতিস্থাপন

৫৷ Motor Vehicles Tax Act, 1932 (Ben. Act I of 1932) এর- FIRST SCHEDULE এর পরিবর্তে এই আইনের তফসিল-১ এ বর্ণিত FIRST SCHEDULE প্রতিস্থাপিত হইবে৷

৬৷ Act No. I of 1944 এর section 3 এর সংশোধন

৬৷ The Excises and Salt Act, 1944 (I of 1944), অত:পর Excises Act বলিয়া উল্লিখিত, এর section 3 এর sub-section (1) এর পর নিম্নরূপ “Explanation” সংযোজিত হইবে, যথা:-“Explanation- For the purpose of levy and collection of duties under this section, classification and description of excisable goods shall be as per First Schedule of the Customs Act, 1969 (IV of 1969).”৷

৭৷ Act No. I of 1944 এর FIRST SCHEDULE এর সংশোধন

৭৷ Excises Act এর FIRST SCHEDULE এর-Part I এর column 1 এ উল্লিখিত Heading No. 48.01 এবং তদ্‌বিপরীতে column 2, 3 ও 4 এ উল্লিখিত এন্ট্রিসমূহ বিলুপ্ত হইবে৷

Act IV of 1969 এর section 2 এর সংশোধন

৮৷ Customs Act, 1969 (IV of 1969), অত:পর Customs Act বলিয়া উল্লিখিত, এর-(ক) section 2 এর-(অ) clause (a) এর পরিবর্তে নিম্নরূপ clause (a) প্রতিস্থাপিত হইবে, যথা:-“(a) “agent” means any person, including a shipping agent, clearing and forwarding agent, cargo agent, freight forwarding agent and stevedore, licensed under section 207, or any person permitted to transact any business under section 208;”;(আ) clause (c) এর পরিবর্তে নিম্নরূপ clause (c) প্রতিস্থাপিত হইবে, যথা:-“(c) “bill of entry” means a bill of entry delivered under section 79, and includes, an electronically transmitted bill of entry in such cases and in such manner containing such particulars as the Board may specify;”;(ই) clause (d) এর পরিবর্তে নিম্নরূপ clause (d) প্রতিস্থাপিত হইবে, যথা:-“(d) “bill of export” means a bill of export delivered under section 131, and includes an electronically transmitted bill of export in such cases and in such manner containing such particulars as the Board may specify;”;(ঈ) clause (k) এর পর নিম্নরূপ clause (kk) সন্নিবেশিত হইবে, যথা:-“(kk) “export manifest” means an export manifest delivered under section 53, and includes an electronically transmitted export manifest in such cases and in such manner containing such particulars as the Board may specify;”;(উ) clause (l) এর পর নিম্নরূপ নূতন clause (ll) সন্নিবেশিত হইবে, যথা:-“(ll) “import manifest” means an import manifest delivered under sections 43 and 44, and includes an electronically transmitted import manifest in such cases and in such manner containing such particulars as the Board may specify;”;(ঊ) clause (t) এর পরিবর্তে নিম্নরূপ নূতন clauses (t) এবং (tt) প্রতিস্থাপিত হইবে, যথা:-“(t) “special bonded warehouse” means a warehouse mentioned in section 117A;(tt) “warehouse” means a place appointed under section 12 or a place licensed under section 13;”৷

৯৷ Act No. IV of 1969 এর section 17 এর সংশোধন

৯৷ Customs Act এর section 17 এর বিদ্যমান বিধান উক্ত section এর sub-section (1) রূপে সংখ্যায়িত হইবে, এবং উক্তরূপে সংখ্যায়িত sub-section (1) এর পর নিম্নরূপ নূতন sub-section (2) সংযোজিত হইবে, যথা:-“(2) Where any goods are detained under sub-section (1) and, within thirty days of such detention, a criminal case is not instituted nor a show cause notice in respect of the goods is issued under section 180, the appropriate officer shall assess the customs duty, if any, leviable on the goods as if the goods were lawfully imported or as the case may be, attempted to be exported, and on payment of such duty, if any, the officer shall release the goods:Provided that the Commissioner of Customs may, on the application of the appropriate officer and for reasons to be recorded in writing, extend the said period of thirty days by a period not exceeding fifteen days.”৷

১০৷ Act No. IV of 1969 এর section 18 এর সংশোধন

১০৷ Customs Act এর section 18 এর-(ক) sub-section (1) এর clause (c) এর শেষে অবস্থিত full stop এর পরিবর্তে colon প্রতিস্থাপিত হইবে এবং তত্পর নিম্নরূপ proviso সংযোজিত হইবে, যথা:-“Provided that no customs duty under this Act or other tax leviable by a customs officer under any other law for the time being in force shall be levied or collected in respect thereof, if-(a) in value of the goods in any one consignment do not exceed one thousand taka; and(b) the total amount of such duty and tax does not exceed taka one thousand.”; Ges(খ) sub-section (2) এর পরিবর্তে নিম্নরূপ নূতন sub-section (2) প্রতিস্থাপিত হইবে, যথা:-“(2) The Government may, by notification in the official Gazette, levy, subject to such conditions, limitations or restrictions as it may deem fit to impose, a regulatory duty on all or any of the goods specified in the First Schedule at the rate not exceeding the highest rate of customs duty for any goods specified in the said Schedule.”|

১১৷ Act No. IV of 1969 এর section 19 এর সংশোধন

১১৷ Customs Act এর section 19 এর sub-section (1) এর শেষে অবস্থিত full stop এর পরিবর্তে colon প্রতিস্থাপিত হইবে এবং তত্পর নিম্নরূপ নূতন proviso সংযোজিত হইবে, যথা:-“Provided that if, in a financial year, exemption under this sub-section is given in respect of any goods the rate of duty cannot be changed more than once in that year so as to increase that rate.”৷

১২৷ Act No. IV of 1969 এর section 25 এর সংশোধন

১২৷ Customs Act এর section 25 এর-(ক) sub-section (1) এর পর নিম্্নবর্ণিত Explanation সংযোজিত হইবে:-“Explanation.- For the purposes of this sub-section, the expression-(a) “the time of importation” means-(i) the date on which a bill of entry is presented under section 79 in case of goods cleared for home-consumption;(ii) the date on which the bonded goods are actually removed from the warehouse in case of goods cleared from a warehouse for home consumption under section 104;(iii) in the case of presentation of a bill of entry in anticipation of arrival of a vessel or aircraft by which the goods are imported, the date on which the manifest of the conveyance is delivered after its arrival;(iv) the date of payment of duty in the case of any other goods; and(b) “the time of exportation” means the time when the bill of export is delivered under section 131, or when export of the goods is allowed without a bill of export or in anticipation of the presentation of a bill of export, the time when the goods is taken to the customs port or customs airport or customs station for the purpose of export;(c) (i) “the place of importation” means the customs port or customs airport or the customs station at which the bill of entry is first submitted; and(ii) “place of exportation” means the customs port or the station at which the bill of export is submitted.”;(খ) sub-section (3) এর “tariff values” শব্দগুলির পর “or minimum values” শব্দগুলি সংযোজিত হইবে;(গ) sub-section (5) এর পর নিম্নরূপ নূতন sub-section (6) সংযোজিত হইেবঃ-“(6) For the purposes of sub-section (1)-(a) the value of any goods shall include the freight, insurance, commission and all other cost, charges and expenses incidental to the sale and delivery at the place of importation or exportation; and(b) the Board may, by notification in the official Gazette, fix the freight for the transportation of any goods or class of goods by aircraft that are delivered or could have been delivered at a Customs airport to the buyer.”|

১৩৷ Act No. IV of 1969 এর section 26 এর সংশোধন

১৩৷ Customs Act এর section 26 এর পরিবর্তে নিম্নরূপ নূতন section 26, 26A, 26B, 26C, 26D ও 26E প্রতিস্থাপিত হইবে, যথা:-“26. Requisition to produce documents.- (1) Where-(a) an officer of Customs has reasons to believe that goods have been unlawfully imported, exported, under valued or overvalued, entered, removed, or otherwise unlawfully dealt with by any person contrary to this Act or that any person attempts to import, export, under or overvalue, enter, remove or otherwise deal with any goods; or(b) goods have been seized under this Act, an officer of Customs not below the rank of an Assistant Commissioner may, by notice in writing, require that person or any person whom the officer suspects to be or to have been the owner, importer or exporter of those goods, or agent thereof, as the case may be, as and when required, to produce and deliver to the officer or to any other specified Customs officer all books of account, invoice books, or other books, records or documents in which any entry or memorandum appears or may be supposed to appear in respect of the purchase, importation, exportation, cost, or value of, or payment for, the goods and any other goods so imported or exported or otherwise dealt with within a period of three years preceding the date of the notice.(2) In addition to the requirements of sub-section (1) of this section, an officer of Customs not below the rank of an Assistant Commissioner may require the owner or importer or exporter of those goods, or agent thereof, as the case may be, as and when required, to-(a) produce for the inspection of the officer or any specified Customs officer, and allow the officer to make copies of or extracts from, any of the documents, books, or records referred to in sub-section (1), and(b) answer any question concerning those documents, books, or records.26A. Further powers in relation to documents.- An officer of Customs not below the rank of Joint Commissioner may, by notice in writing, require any person (including any officer employed in or in connection with any Government department, Corporation, or local authority, or any officer employed in or in connection with any bank), as and when required to-(a) produce for inspection by an officer of Customs any documents or records that the Joint Commissioner considers necessary or relevant to an investigation or audit under this Act;(b) allow the officer of Customs to make copies of or extracts from any such documents or records;(c) appear before the Joint Commissioner of Customs and answer all questions put to him concerning any goods or any transactions relating to those goods that are the subject of any such investigation, or concerning the documents or records that are relevant to any such investigation.26B. A Customs officer may take possession of and retain documents and records.- (1) A Customs officer may take possession of and retain any document or record presented in connection with any entry or required to be produced under this Act.(2) Where the Customs officer takes possession of a document or record under sub-section (1) of this section, the said officer shall, at the request of the person otherwise entitled to the document or record, provide that person with a copy of the document certified by him or on his behalf under the seal of the Customs as a true copy.(3) Every copy so certified shall be admissible as evidence in all Courts as if it were the original.26C. Copying of documents obtained during search.- (1) Where an officer of Customs or an authorised person carries out any lawful search, inspection, audit, or examination under this Act, and has reasonable cause to believe that documents coming into his possession during such search, inspection, audit, or examination are evidence of the commission of an offence under this Act, he may remove the documents for the purpose of making copies.(2) The documents or records so removed must, as soon as practicable after copies thereof have been made, be returned to the person otherwise entitled to them.(3) A copy of any such document certified by or on behalf the officer of Customs under the seal of the Customs shall be admissible in evidence in all Courts as if it were the original.26D. Retention of documents and goods obtained during search.- (1) Where an officer of Customs or an authorised person carries out any lawful search, inspection, audit, or examination under this Act, and has reasonable cause to believe that any document or goods coming into his possession during such search, inspection, audit, or examination are evidence of the commission of an offence under this Act, or are intended to be used for the purpose of committing any offence under this Act, the officer or his authorised person may take possession of and retain the documents or goods, as the case may be.(2) Where an officer of Customs or his authorised person takes possession of a document under sub-section (1) of this section, he shall, at the request of the person otherwise entitled to the document, provide that person with a copy of the document certified by or on behalf of the Custom officer under the seal of the Customs as a true copy.(3) Every copy so certified shall be admissible in evidence in Courts as if it were the original.”|

১৪৷ Act No. IV of 1969 এর section 27 এর সংশোধন

১৪৷ Customs Act এর section 27 এর sub-section (1) এর clause (b) তে “, other than warehoused goods,” শব্দগুলি এবং কমাগুলি বিলুপ্ত হইবে৷

১৫৷ Act No. IV of 1969 এর section 30 এর সংশোধন

১৫৷ Customs Act এর section 30 এর clause (a) এর “that section” শব্দগুলির পর নিম্নরূপ শব্দসমূহ সন্নিবেশিত হইবে, যথা:-“and a bill of entry number is allocated thereto”৷

১৬৷ Act No. IV of 1969 এর section 32 এর সংশোধন

১৬৷ Customs Act এর section 32 এর-(ক) sub-section (1) এর-(অ) clause (b) এর শেষে comma এর পর “or” শব্দটি সংযোজিত হইবে;(আ) clause (b) এর পর নিম্নরূপ নূতন clause (c) সন্নিবেশিত হইবে, যথা:-“(c) transmits any statement, document, information or record through electronic device or produces soft copy thereof,”;(খ) sub-section (3) এর- “charge” শব্দটির পর “amounting to not less than one thousand taka” শব্দসমূহ সন্নিবেশিত হইবে;(গ) sub-section (4) এর শেষে full stop এর পরিবর্তে colon প্রতিস্থাপিত হইবে এবং তত্পর নিম্নরূপ proviso সংযোজিত হইবে, যথা:-“Provided that where the amount so determined is less than one thousand taka, the person concerned shall not be required to make the payment.”|

১৭৷ Act No. IV of 1969 এর section 45 এর সংশোধন

১৭৷ Customs Act এর section 45 এর sub-section (1) এর শেষে full stop এর পরিবর্তে colon প্রতিস্থাপিত হইবে এবং অত:পর নিম্নরূপ proviso সন্নিবেশিত হইবে, যথা:-“Provided that the manifest transmitted by a registered user under section 79C having unique user identifier allotted to him under section 79D shall not be required to be signed for the purpose of this section.”৷

১৮৷ Act No. IV of 1969 এর section 48 এর সংশোধন

১৮৷ Customs Act এর section 48 এ “crew” শব্দটির পর “, passengers” কমা ও শব্দটি সন্নিবেশিত হইবে৷

১৯৷ Act No. IV of 1969 এর section 53 এর সংশোধন

১৯৷ Customs Act এর section 53 এর sub-section (1) এর শেষে অবস্থিত semicolon এর পরিবর্তে colon প্রতিস্থাপিত হইবে, এবং তত্পর নিম্নরূপ proviso সন্নিবেশিত হইবে, যথা:-“Provided that the export manifest transmitted by a registered user under section 79C having unique user identifier allotted to him under section 79D shall not be required to be signed for the purpose of this section.”৷

২০৷ Act No. IV of 1969 এর section 79 এর সংশোধন

২০৷ Customs Act এর section 79 এর-(ক) sub-section (1) এর পর নিম্নরূপ নূতন sub-section (1A) সন্নিবেশিত হইবে, যথা:-“(1A) The Commissioner of Customs may within the period specified in sub-section (2) require the owner who has delivered or transmitted a bill of entry in electronic form to submit to the appropriate officer a paper bill of entry duly signed by the owner or his authorised agent, containing such information and documents as the said Commissioner may specify”;(খ) sub-section (2) এর proviso এর পরিবর্তে নিম্নরূপ নূতন proviso প্রতিস্থাপিত হইবে, যথা:-“Provided that the Commissioner of Customs may permit a bill of entry to be presented even before the delivery of the manifest if the vessel or the aircraft by which the goods have been shipped for importation into Bangladesh is expected to arrive within thirty days from the date of such presentation.”|

২১৷ Act No. IV of 1969 এ নূতন section 79B, 79C, 79D, 79E, 79F এবং 79G এর সন্নিবেশ

২১৷ Customs Act এর section 79A এর পর নিম্নরূপ নূতন section 79B, 79C, 79D, 79E, 79F এবং 79G সন্নিবেশিত হইবে, যথা:-“79B. Access to Customs computerised entry processing systems.- No person shall transmit to, or receive information from, a Customs computerised entry processing system unless that person is registered by the Commissioner of Customs as a user of that Customs computerised entry processing system.79C. Registered users.- (1) A person who wishes to be registered as a user of a Customs computerised entry processing system may apply in writing to the Commissioner of Customs in the prescribed form and shall provided such information in relation to the application as required by the Commissioner.(2) The said Commissioner may require an applicant for registration to give such additional information as the said Commissioner considers necessary for the purpose of the application.(3) The said Commissioner may-(a) grant the application subject to such conditions and limitations as the said Commissioner thinks fit; or(b) refuse the application.(4) The said Commissioner shall give notice in writing to the applicant of his decision.79D. Registered users to be allocated unique user identifier-(1) A person who is registered as a user of a Customs computerised entry processing system shall be allocated a unique user identifier for use in relation to that Customs computerised entry processing system by the Commissioner of Customs, in such form or of such a nature as the Commissioner of Customs may determine.(2) The unique user identifier allocated pursuant to sub-section (1) of this section shall be used by the registered user for the purpose of transmitting information to or receiving information from that Customs computerised entry processing system.(3) The Commissioner of Customs may, by notice in writing, impose conditions and limitations on a particular registered user, or on registered users generally, relating to the use and security of unique user identifiers.79E. Use of unique user identifier.- (1) Where information is transmitted to a Customs computerised entry processing system using a unique user identifier issued to a registered user by the Commissioner of Customs for that purpose, the transmission of that information shall, in the absence of proof to the contrary, be sufficient evidence that the registered user to whom the unique user identifier has been issued has transmitted that information.(2) Where a unique user identifier is used by an individual who is not entitled to use it, sub-section (1) of this section does not apply if the registered user to whom the unique user identifier was issued has, prior to the unauthorised use of the unique user identifier, notified the Commissioner of Customs in writing that the unique user identifier is no longer secure.79F. Cancellation of registration of registered user.- (1) Where at any time the Commissioner of Customs having jurisdiction is satisfied that a person who is a registered user of a Customs computerised entry processing system has-(a) failed to comply with a condition of registration imposed by the said Commissioner under section 79C (3) of this Act; or(b) failed to comply with, or acted in contravention of, any conditions imposed by the said Commissioner under section 79D(3) of this Act in relation to the use and security of the registered user’s unique user identifier; or(c) has been convicted of an offence under this Act in relation to improper access to or interference with a Customs computerised entry processing system,-the said Commissioner may cancel the registration of that individual as a registered user by giving notice in writing to that person setting out the reasons for the cancellation.79G. Customs to keep records of transmission.- (1) The Customs must keep a record of every transmission sent to or received from a registered user using a Customs computerised entry processing system.(2) The record described in sub-section (1) of this section must be kept for a period of five years from the date of the sending of or the receipt of the transmission, or for such other period as may be prescribed.”|

২২৷ Act No. IV of 1969 এর section 80 এর সংশোধন

২২৷ Customs Act এর section 80 এর sub-section (1) এ “tested” শব্দটির পর “in the presence of the owner or his agent, unless due to any exceptional circumstance such presence cannot be allowed” শব্দগুলি ও কমা সন্নিবেশিত হইবে৷

২৩৷ Act No. IV of 1969 এ নূতন section 82A এর সন্নিবেশ

২৩৷ Customs Act এর section 82 এর পর নিম্নরূপ নতূন section 82A সন্নিবেশিত হইবে, যথা:-“82A. Procedure in case of goods not assessed or out-passed by Customs after presentation of the related bill of entry within a specified period.- If any goods, other than goods detained, seized, confiscated, under adjudication or appeal under the provisions of this Act, for which a bill of entry has duly been presented, are not assessed and out-passed within seven working days the owner of such goods may serve a notice upon the Commissioner to finalise the Customs formalities within three working days enabling him to pay duty and taxes and clear the goods, and the said Commissioner or any officer authorised on his behalf shall do so, if the import is in order, or issue a show cause notice if the import is not in order.Explanation.- For the purpose of this section “detained goods” include goods detained for chemical examination, radiation test, reference for resolution disputes on of classification, value, ITC aspect or any other legal disputes.” |

২৪৷ Act No. IV of 1969 এ নূতন section 83A, 83B এবং 83C এর সন্নিবেশ

২৪৷ Customs Act এর section 83 এর নিম্নরূপ নূতন section 83A, 83B এবং 83C সন্নিবেশিত হইবে, যথা:-“83A. Amendment of assessment.- (1) An officer of Customs not below the rank of an Assistant Commissioner of Customs may from time to time make or cause to be made such amendments to an assessment of duty or to the value taken for the purpose of assessment of duty as he thinks necessary in order to ensure the correctness of the assessment even though the goods to which the value or the duty relates have already passed out of Customs control or the duty originally assessed has been paid.(2) If the amendment has the effect of imposing a fresh liability or enhancing an existing liability, a demand notice in writing shall be given by the officer of Customs to the person liable for the duty.(3) Unless otherwise specified in this Act, the due date for payment against the aforesaid demand notice shall be thirty working days from the date of issue of such a written demand notice by the officer of Customs.83B. Limitation of time for amendment assessments.- (1) Where an assessment of duty has been made under this Act, the officer of Customs is not entitled to increase the amount of the assessment after the expiration of three years from the date on which the original assessment was made.(2) Notwithstanding sub-section (1) of this section, in any case where the entry or any declaration made in relation to the goods was fraudulent or wilfully misleading, the officer of Customs may amend the assessment at any time within five years from the date on which the original assessment was made so as to increase the amount of the assessment.83C. Audit or examination of records.- (1) An officer of Customs may at any time enter any premises or place where records are kept pursuant to section 211 of this Act and audit and examine those records either in relation to specific transactions or to the adequacy or integrity of the manual or electronic system or systems by which such records are created and stored.(2) For the purposes of sub-section (1) of this section, an officer of Custom shall have full and free access to all lands, buildings and places and to all books, records and documents, whether in the custody or under the control of the licensee, importer, exporter or any other person, for the purpose of inspecting any books, records, and documents and any property, process, or matter that the officer considers.-(a) necessary or relevant for the purpose of collecting any duty under the Act or for the purpose of carrying out any other function lawfully conferred on the officer, or(b) likely to provide any information otherwise required for the purposes of this Act or for the discharge of any functions under this Act.(3) The officer of Customs may make extracts from or copies of any such books, documents or records.(4) Notwithstanding sub-section (2) and (3) of this section, an officer of Customs shall not enter any private dwelling except with the consent of an occupier or owner thereof or pursuant to a warrant issued under this Act.”|

২৭৷ Customs Act এর section 101 এর sub-section (4) এর পর নিম্নরূপ sub-section (5) সংযোজিত হইবে৷ যথা:-“(5) Notwithstanding anything contained in the aforesaid sub-sections, the Commissioner of Customs may prescribe such conditions as he deems fit for the removal of warehoused goods from special bonded warehouse.”|

২৮৷ Customs Act এর section 104 এর দফা (b) এর শেষ প্রান্ত্মস্থিত full stop এর পরিবর্তে colon প্রতিস্থাপিত হইবে এবং তত্পর নিম্নরূপ Proviso সংযোজিত হইবে, যথা:-“Provided that necessary permission will have to be taken from Commissioner of Customs fifteen days in advance in case of Special Bonded Warehouse for special purposes to be determined by the Commissioner of Customs.”৷

৩১৷ Customs Act এর section 112 এর sub-section (1) এর পরিবর্তে নিম্নরূপ নূতন sub-section (1) প্রতিস্থাপিত হইবে:-“(1) If any owner fails to pay any sum demanded under section 111, the appropriate officer may either proceed upon the bond executed under 86 or as prescribed by rules made under this Act or cause such portion of the owners goods in the warehouse or any plant or machinery or equipment used for the manufacture of goods or any other goods and properties belonging to such persons to be detained as he may consider adequate to recover the demand, and the notice in writing for such detention, shall immediately be given to the owner.”|

৩৪৷ Customs Act এর section 138 এর sub-section (1) এর পর নিম্নরূপ নূতন sub-section (1A) সন্নিবেশিত হইবে, যথা:-“(1A) The Commissioner of Customs in exceptional cases other than the cases mentioned in sub-section (1) may allow such re-exportation with the prior approval of the Board.”|

৩৫৷ Customs Act এর section 156 এর sub-section (1) এর TABLE এর-(ক) ক্রমিক 14 এর বিপরীতে কলাম 2 এ উল্লিখিত এন্ট্রির পরিবর্তে নিম্নরূপ এন্ট্রি প্রতিস্থাপিত হইবে, যথা:-“such person shall be liable to a penalty not exceeding fifty thousand Taka or three times the value of the goods in respect of which such offence is committed, whichever be higher and such goods shall also be liable to confiscation; and upon conviction by a Magistrate such person shall further be liable to rigorous imprisonment for a term not exceeding five years or to a fine not exceeding taka fifty thousand or to both.”;(খ) ক্রমিক নং 11 এর পর ক্রমিক 11A এবং উহার বিপরীতে কলাম 1, 2 ও 3 এ নিম্নরূপ এন্ট্রি সন্নিবেশিত হইবে, যথা:-

	“11A.	If any person imports such goods without Pre-shipment Inspection which is not exempted from mandatory Pre-shipment Inspection	such person shall be liable to pay Pre-shipment Inspection service charge at the rate as determined by the Government by the Notification published in the official Gazette and a penalty not exceeding taka fifty thousand	25B”;

(গ) ক্রমিক নং 47 এর পর ক্রমিক 47A, 47B এবং 47C উহার বিপরীতে কলাম  1, 2 ও 3 এ নিম্নরূপ এন্ট্রি সংযোজিত হইবে, যাহা সরকার কর্তৃক সরকারী গেজেটে প্রজ্ঞাপন দ্বারা নির্ধারিত তারিখে কার্যকর হইবে, যথা:-

	“47A.	If any person-
		(i) without lawful authority gains access to, or attempts to gain access to, any Customs computerised entry processing system; or	such person shall, be liable to a penalty not exceeding twice the amount of duty taxes involved or three lakh taka; whichever is higher and on conviction before a Magistrate, shall be further liable to imprisonment for a term not exceeding two years, or to a fine not exceeding three lakh taka, or to both.	79B
		(ii) without lawful authority gains access to, or attempts to gain access to, any Customs computerised entry processing system, uses or discloses information obtained from such a computer system for a purpose that is not authorised; or	such person shall, be liable to a penalty not exceeding five lakh taka; and on conviction before a Magistrate, shall be further liable to imprisonment for a term not exceeding two years, or to a fine not exceeding five lakh taka, or to both.	79B
		(iii) having lawful access to any Customs computerised entry processing system, uses or discloses information obtained from such a computer system for a purpose that is not authorised; or	such person shall, be liable to a penalty not exceeding two lakh taka; and on conviction before a Magistrate, shall be further liable to imprisonment for a term not exceeding two years, or to a fine not exceeding two lakh taka, or to both.	79B

	(iv) who is not authorised to do so, receives information obtained from any Customs computerised entry processing system, and uses, discloses, publishes or authorizes dissemination of such information.	such person shall, be liable to a penalty not exceeding two lakh taka; and on conviction before  a Magistrate, shall be further liable to imprisonment for a term not exceeding two years, or to a fine not exceeding two lakh taka, or to both.	79B
47B.	If any person
	(i) falsifies any record or information stored in any Customs computerised entry processing system, or	such person shall be liable to a penalty not exceeding five lakh taka; and on conviction before a magistrate, shall be further liable to imprisonment for a term not exceeding three years or to a fine not exceeding five lakh taka, or to both.	79B to 79G
	(ii) damages or impairs any Customs computerised entry processing system, or
	(iii) damages or impairs any duplicate tape or disc or other medium on which any information obtained from Customs computerised entry processing system is held or stored otherwise than with the permission of the Board,

৩৬৷ Customs Act এর section 156 এর sub-section (2) এর পরে নিম্নরূপ নূতন sub-section (3) ও (4) সংযোজিত হইবে, যথা:-“(3) Where there is provision in sub-section (1) for conviction and sentence by a Court for any offence, the Customs Authorities shall be competent to dispose of the goods as per the provisions of the Act, and the jurisdiction of the Court shall be limited only to the criminal proceedings instituted in relation to the goods.(4) The Customs Authorities may sell or otherwise dispose of the seized goods during pendency of the Court proceedings, if any, after keeping samples where practicable, with proper identification marks, and if it is decided by the Court that no offence was committed, the Customs Authorities shall, where the owner or proper claimant is available, return the goods or the sale proceeds of the goods or the proceeds if they are not otherwise liable to be confiscated.”|

৩৭৷ Customs Act এর section 158 এর পর নিম্নরূপ নূতন section 158A সন্নিবেশিত হইবে, যথা:-“158A. Conferring certain Powers of Magistrate 1st Class on Customs officers.- For the purposes of entry search, seizure and arrest under this Act, the Government may, by notification in the official Gazette, confer the powers of a Magistrate of the First Class described in Schedule III of the Code of Criminal Procedure, 1898 (Act V of 1898) on an officer of customs not below the rank of Assistant Commissioner.”|

৪২৷ Customs Act এর section 196G এর পরিবর্তে নিম্নরূপ নূতন section 196G প্রতিস্থাপিত হইবে, যথা:-“196G. Decision of the High Court Division on appeals.- (1) Where an appeal is preferred under section 196D, the High Court Division shall decide the points raised therein and such other points incidental thereto as are deemed necessary and shall deliver its judgement thereon,(2) The High Court Division, in its judgement, may award any costs upon any party to the appeal.(3) A copy of the judgement delivered under sub-section (1) shall, under the seal and signature of an officer of that Division, be sent to the Appellate Tribunal.”|

৪৩৷ Customs Act এর section 198 এর বর্তমান বিধান উক্ত section এর sub-section (1) রূপে সংখ্যায়িত হইবে, এবং উক্তরূপে সংখ্যায়িত sub-section (1) এর পর নিম্নরূপ নূতন sub-section (2) সংযোজিত হইবে, যথা:-“(2) The owner of such goods or his authorised representative may be allowed to inspect such goods before the presentation or transmission of the bill of entry or the bill of export thereof, as the case may be, subject to the conditions laid down by an officer of customs not below the rank of Assistant Commissioner.”৷

৪৪৷ Customs Act এর section 199 এর sub-section (3) এর পর নিম্নরূপ নূতন sub-section (4) সংযোজিত হইবে, যথা:-“(4) The owner of any imported or exportable goods or his authorised representative may draw samples before presentation or transmission of bill of entry or bill of export thereof, as the case may be, subject to the conditions laid down by an officer of customs not below the rank of Assistant Commissioner.”৷

৪৫৷ Customs Act এর section 204 এর পর নিম্নরূপ নূতন section 204A সন্নিবেশিত হইবে, যথা:-“204A. Supply of information pertaining to customs law, etc.- On an application by any interested person the Board may, within a reasonable period and on payment of such fee as the Board may determine for this purpose, provide him with information pertaining to including in electronic form of up-to-date Customs Laws including Rules, notification, circulars, orders and other instruments issued for general use under this Act.”|

৪৬৷ Customs Act এর section 211 এর পরিবর্তে নিম্নরূপ নূতন section 211 প্রতিস্থাপিত হইবে, যথা:-“211. Keeping of business record.- (1) Every licencee, importer, exporter or his agent must keep or cause to be kept such records and accounts for such period not exceeding five years, as may be specified by the Board.(2) Every such person must, as and when required by an officer of Customs.-(a) make the records and accounts available to Customs;(b) provide copies of the records and accounts as required; and(c) answer any question relevant to the matters arising under this Act asked by any officer of Customs in respect of them.(3) Where for the purpose of complying with sub-section (2) of this section, information is recorded or stored by means of an electronic or other device, the licensee, importer, exporter, or its agent, shall, at the request of an officer of Customs, operate the device, or cause it to be operated, to fulfil the requirements of sub-sections (2).”|

৪৭৷ Act No. IV of 1969 এ নূতন section 215A এর সন্নিবেশ

৪৭৷ Customs Act এর section 215 এর পর নিম্নরূপ নূতন section 215A সন্নিবেশিত হইবে, যথা:-“215A. Supply of information relating to decision, etc.- Upon an application of a person directly interested in a decision taken or omitted to have been taken by a customs officer, the Commissioner of Customs shall inform that person in writing within a period of 60 days of the application the reasons for such decision or omission.”|

৪৮৷ Act No. IV of 1969 এ নূতন section 217A এর সন্নিবেশ

৪৮৷ Customs Act এর section 217 এর পর নিম্নরূপ নূতন section 217A সন্নিবেশিত হইবে, যথা:-“217A. Reward for detection etc. of evasion of duties or violation of laws.- Notwithstanding anything contained to the contrary in this Act or any other law for time being in force, the Board may, in such manner and in such circumstances and to such extent as may be prescribed by rules, grant reward to the following persons:-(a) a person giving information to Customs Authorities with regard to evasion or attempted evasion of customs duties or violation of any provision of this Act or any other law for the time being in force under which a customs officer is authorised to collect tax or other revenue;(b) a Customs Officer or an officer or employee of any other government agency or of a local authority who detects or unearths the evasion or attempted evasion of customs duties or violation of this Act or that other law;if such supply of information, the act of detection of or unearthing the evasion or attempted evasion of customs duty or violation of law leads to:-(i) the seizure and confiscation of goods or other things in relation to which the evasion or attempted evasion or violation takes place; or(ii) the realisation of customs duty or other revenue leviable under this Act or that other law for the time being in force or the realisation of a penalty or fine imposed under the relevant law; or(iii) conviction of and sentence imposed on the person liable for such evasion, attempted evasion or violation.”|

৪৯৷ Act No. IV of 1969 এ নূতন section 219A এর সন্নিবেশ

৪৯৷ Customs Act এর section 219 এর পর নিম্নরূপ নূতন section 219A সন্নিবেশিত হইবে, যথা:-“219A. Power to make customs rulings.- (1) On an application by any person or on a reference by an officer of customs not below the rank of Commissioner or of its own motion, the Board may make customs rulings in respect of any matter specified in the application or reference, as the case may be, if the point raised in the application or reference relates to application of any provision of this Act or the rules to a specific situation or if such point relates to any tariff classification or duty rates or valuation of any goods for customs assessment purpose.(2) A customs ruling may be made within thirty working days of the receipt of the application or the reference, as the case may be.(3) The Board may decline to make a customs ruling on the ground of insufficient information furnished or in the absence of conclusive evidence provided in support of the contentions in the application or the reference.(4) The rulings made by the Board shall be binding upon the concerned persons and officers.(5) The Board may from time to time review and amend a customs ruling to correct any error contained in that ruling.”|

৫২৷ The Stamp Duties (Additional Modes of Payment) Act, 1974 (LXXI of 1974) এর section 2 এর-(ক) “sub-section (1) এর clause (b) এর শেষ প্রান্ত্মস্থিত full-stop এর পরিবর্তে “; or” সেমিকোলন ও শব্দ প্রতিস্থাপিত হইবে এবং তত্পর নিম্নরূপ নূতন clause (c) এবং “proviso” সন্নিবেশিত হইবে, যথা:-“(c) by an account-payee pay order or an account-payee bank draft issued by a scheduled bank specified by or under rules :Provided that the Government may, by notification in the official gazette, direct that any stamp duty in excess of the amount specified in the notification shall be paid only by such pay order, bank draft or challan”;(খ) sub-section (2) এর পরিবর্তে নিম্নরূপ sub-section (2) প্রতিস্থাপিত হইবে, যথা:-“(2) Where an instrument is presented to a registering officer for registration and the stamp duty is paid to him in cash or is shown to have been paid by challan pay order or bank draft under sub-section (1), that officer shall endorse the payment of the stamp duty on the instrument in the manner prescribed by rules, and upon such endorsement the instrument shall be deemed to have been duly stamped within the meaning of the said Act.”|

৫৩৷ Ordinance No. XXXVI of 1984 এর section 2 এর সংশোধন

৫৩৷ Income-tax Ordinance, 1984 (XXXVI of 1984), অতঃপর Income-tax Ordinance বলিয়া উল্লিখিত, এর section 2 এর-(ক) clause (12) এ “the Banking Companies Ordinance, 1962 (LVII of 1962)” শব্দগুলি, সংখ্যাগুলি ও বন্ধনীগুলির পরিবর্তে “ব্যাংক-কোম্পানী আইন, ১৯৯১ (১৯৯১ সনের ১৪ নং আইন)” শব্দগুলি, সংখ্যাগুলি ও বন্ধনীগুলি প্রতিস্থাপিত হইবে;(খ) clause (30) এর পরিবর্তে নিম্নরূপ clause (30) প্রতিস্থাপিত হইবে, যথা:-“(30) “fair market value” means, in relation to capital asset-(a) the price which such asset would ordinarily fetch on sale in the open market on the relevant day, and, where such price is not ascertainable, the price which the Deputy Commissioner of Taxes may, with the approval in writing of the Inspecting Joint Commissioner, determine;(b) the residual value received from the lessee in case of an asset leased by a financial institution having license from the Bangladesh Bank on termination of lease agreement on maturity or otherwise subject to the condition that such residual value plus amount realised during the currency of the lease agreement towards the cost of the asset is not less than the cost of acquisition to the lessor financial institution.”|

৫৪৷ Ordinance No. XXXVI of 1984 এর section 19B এর সংশোধন

৫৪৷ Income-tax Ordinance এর section 19B এর clauses (a), (b) ও (c) এর পরিবর্তে নিম্নরূপ clauses (a), (b), (c) ও (d) প্রতিস্থাপিত হইবে, যথা:-“(a) taka seventy five per square meter in the case of a building or apartment the plinth area of which does not exceed seventy square meter;(b) taka one hundred and twenty per square meter in the case of a building or apartment the plinth area of which exceeds seventy square meter but does not exceed one hundred and forty square meter;(c) taka one hundred and eighty per square metre in the case of a building or apartment the plinth area of which exceeds one hundred and forty square meter but does not exceed two hundred and thirty square meter, and(d) taka two hundred and fifty per square meter in the case of a building or apartment the plinth area of which exceeds two hundred and thirty square meter.”|

৫৫৷ Income-tax Ordinance এর section 25 এর sub-section (1) এর clause (h) এর পরিবর্তে নিম্নরূপ clause (h) প্রতিস্থাপিত হইবে, যথা:-“(h) an amount equal to one fourth of the annual value of the property in respect of expenditure for repairs, collection of rent, water and sewerage, electricity and salary of darwan, security guard, pump-man, lift-man and caretaker and all other expenditure related to maintenance and provision of basic services.”|

Collection of tax on account of bonus.- The principal officer of any company registered under the Companies Act, 1913 (VII of 1913) or কোম্পানী আইন, ১৯৯৪ (১৯৯৪ সনের ১৮ নং আইন) shall, at the time of issuing any bonus to its shareholders, collect Income-tax at the rate of ten per cent on the amount of the bonus.”৷

৬৫৷ Income-tax Ordinance এর section 53E এর পর নিম্নরূপ নূতন section 53EE সন্নিবেশিত হইবে, যথা:-“53EE. Deduction of tax from commission or remuneration paid to agent of foreign buyer.- Where, in accordance with the terms of the letter of credit or under any other instruction, a bank, through which an exporter receives payment for export of goods, pays any amount out of the export proceeds to the credit of any person being an agent or a representative of the foreign buyer, as commission, charges or remuneration by whatever name it may be called, the bank shall deduct or collect tax in advance at the rate of two and half per cent on the commission, charges or remuneration so paid at the time of such payment.”|

Deduction at source from fees, etc. of Surveyors of general insurance company.- A person responsible for paying to a resident any sum by way of remuneration or fees for conducting any survey regarding settlement of claim of an insurance shall, at the time of payment, deduct income-tax on such sum at the rate five per cent.”৷

৬৯৷ Income-tax Ordinance এর section 82 এর-(ক) বিদ্যমান বিধানটি উক্ত section এর sub-section (1) রূপে সংখ্যায়িত হইবে এবং উক্তরূপে সংখ্যায়িত sub-section (1) এর দ্বিতীয় proviso এর clause (b) এর প্রান্ত্মস্থিত সেমিকোলনের পরিবর্তে ফুলষ্টপ প্রতিস্থাপিত হইবে এবং বিদ্যমান clause (c) বিলুপ্ত হইবে;(খ) সংখ্যায়িত sub-section (1) এর পর নিম্নরূপ নূতন sub-section (2) সংযোজিত হইবে, যথা:-“(2) Notwithstanding anything contained in sub-section (1) and section 93, the Board or any authority subordinate to the Board, if so authorised by the Board in this behalf, may select, in the manner to be determined by the Board, a portion, not exceeding ten per cent of the return filed under first proviso in sub-section (1) showing loss or lesser income than the last assessed income or assessment on the basis of which result in refund, and refer the returns so selected to the Deputy Commissioner of Taxes for the purpose of audit and the Deputy Commissioner of Taxes shall thereupon proceed, if so required, to make the assessment under section 83 or section 84 as the case may be.”|

৭০৷ Ordinance No. XXXVI of 1984 এর section 82C এর সংশোধন

৭০৷ Income-tax Ordinance এর section 82C এর sub-section (1) এর-(ক) sub-section (2) এর-(অ) clause (f) বিলুপ্ত হইবে;(আ) বিলুপ্ত clause (f) এর পর নিম্নরূপ নূতন clauses (g), (h), (i), (j), (k), (l) ও (m) সংযোজিত হইবে, যথা:-000000“(g) the amount of interest on saving deposits or fixed deposits or any term deposit on which tax is deductible under section 53F;(h) the amount on account of winnings referred to in section 19 (13) on which tax is deductible under section 55;(i) the amount received on account of export of manpower on which tax is deductible under section 53B;(j) the amount of remuneration or reward, whether by way of commission or otherwise payable to an insurance agent on which tax is deductible under section 53G;(k) the amount of auction purchase on which tax is collectible under section 53C;(l) the amount representing the payment on account of survey by surveyor of a general insurance company on which tax is deductible under section 53GG;(m) the amount of commission or discount received by a travel agent from an airlines on which tax is deductible or collectible under section 52J.”;(ই) proviso এর পরিবর্তে নিম্নরূপ proviso প্রতিস্থাপিত হইবে, যথা:-“Provided that provision of sub-section (1) shall not be applicable in the case of-(i) clause (a) of this sub-section with respect to a contractor of an oil company or a sub-contractor to the contractor of an oil company as referred to in rule 39 of the Income-tax Rules, 1984;(ii) clause (d) of this sub-section with respect to any investment made under sub-section (10) of section 32; and(iii) clause (g) of this sub-section with respect to any interest received by a company.”|(খ) sub-section (4) এর “and business of real estate for the purpose of collection of tax under section 52H” শব্দগুলি ও সংখ্যাগুলির পরিবর্তে “interest under section 53F, winnings under section 55, export of manpower under section 53B, remuneration or reward under section 53G, auction purchase under section 53C, payment on account of survey under section 53GG and commission or discount under section 52J” শব্দগুলি, কমাগুলি ও সংখ্যাগুলি প্রতিস্থাপিত হইবে৷”৷

৭২৷ Income-tax Ordinance এর section 83AA এর পর নিম্নরূপ নূতন section 83AAA সন্নিবেশিত হইবে, যথা:-“83AAA. Assessment on the basis of report of a chartered accountant.- (1) Where a return or revised return is filed under Chapter VIII by an assessee being a company and the Board has reasonable cause to believe that the return or revised return is incorrect or incomplete, the Board may appoint a registered chartered accountant to examine the accounts of that assessee.(2) The chartered accountant appointed under sub-section (1) shall exercise the powers and functions of the Deputy Commissioner of Taxes as referred to in section 79 and clauses (a), (b), (c), (d) and (e) of section 113.(3) The chartered accountant, after examination of the accounts of that assessee, shall submit a report in writing to the Board along with findings within a time as may be specified by the Board.(4) On receipt of the report referred to in sub-section (3), the Board shall forthwith forward the report to the concerned Deputy Commissioner of Taxes for consideration.(5) On receipt of the report under sub-section (4), the Deputy Commissioner of Taxes shall serve a notice upon the assessee under sub-section (1) of section 83.(6) The Deputy Commissioner of Taxes shall, after hearing the person appearing and considering the evidences produced including the findings stated in the report received under sub-section (5) and also considering the other evidences, by an order in writing, assess within thirty days after the completion of hearing or consideration, as the case may be, the total income of an assessee and shall determine the sum payable by the assessee on the basis of such assessment, and communicate the said order to the assessee within thirty days from the date of such order.”|

৭৩৷ Income-tax Ordinance এর section 135 এর sub-section (1) এর পরে নিম্নরূপ sub-section (1A) সন্নিবেশিত হইবে, যথা:-“(1A). Where any amount of tax is refundable in consequence of any order, except an order passed under section 83A and 83AA in pursuance of this Ordinance, the Deputy Commissioner of Taxes shall specify in the notice referred to in sub-section (1) the sum refundable to the assessee together with a copy of an assessment order and a refund voucher unless such refund is set off against tax as per provision of section 152.”|

Tax-payer’s identification number (TIN) in certain documents, etc.- The Board may, with the prior approval of the Government and by notification in the official Gazette, specify any class of documents where a tax-payer’s identification number (TIN) is to be mentioned.”|

৮২৷ Income-tax Ordinance এর SIXTH SCHEDULE এর(ক) Part A এর-(অ) paragraph 1 এর- “other legal obligation” শব্দগুলির পরে “or from operation of micro credit by such trust or obligation” শব্দগুলি সন্নিবেশিত হইবে;(আ) paragraph 3 এর পরিবর্তে নিম্নরূপ paragraph 3 প্রতিস্থাপিত হইবে, যথা:-“3. ৮৩৷ (১) উপ-ধারা (২) এবং (৪) এর বিধানাবলী সাপেতেগ, ২০০০ সালের ১লা জুলাই এবং ২০০১ সালের ১লা জুলাই তারিখে আরদ্ধ কর বত্সরের জন্য কোন কর নির্ধারণের ক্ষেত্রে এই আইনের তফসিল-৩ এ নির্দিষ্ট কর হার অনুযায়ী আয়কর ধার্য হইবে৷(২) ২০০০ সালের ১লা জুলাই এবং ২০০১ সালের ১ লা জুলাই তারিখে আরদ্ধ কর বত্সরে বাংলাদেশে নিবাসী কোন করদাতা যদি বাংলাদেশের বাহিরে উদ্ভূত কোন আয় সরকারী মাধ্যম (official channel) এ বাংলাদেশে আনয়ন করেন এবং উহা বাংলাদেশে স্থাপিত কোন নূতন শিল্প প্রতিষ্ঠানে সরাসরি বিনিয়োগ করেন, অথবা সরকারী মালিকানাধীন কোন প্রতিষ্ঠান কর্তৃক নিলামে বিক্রিত শিল্প প্রতিষ্ঠান, ষ্টক, শেয়ার, সরকারী বন্ড বা সিকিউরিটি ক্রয়ে বিনিয়োগ করেন, তাহা হইলে তাহার ঐ আয়ের উপর কোন আয়কর প্রদেয় হইবে না৷(৩) যে সকল ক্ষেত্রে Income-tax Ordinance, 1984 (XXXVI of 1984) এর SECOND SCHEDULE (মূলধনী মুনাফা ও লটারী আয় সংক্রান্ত) প্রযোজ্য হইবে সে সকল ক্ষেত্রে আরোপণযোগ্য কর উক্ত SCHEDULE অনুসারেই ধার্য্য করা হইবে, কিন্তু করের হার নির্ধারণের ক্ষেত্রে উপ-ধারা (১) এর বিধান প্রয়োগ করিতে হইবে৷(৪) Income-tax Ordinance, 1984 (XXXVI of 1984) এর Chapter VII অনুসারে কর কর্তনের নিমিত্ত তফসিল -৩এ (আয়কর হার সংক্রান্ত্ম) বর্ণিত হার ২০০০ সালের ১লা জুলাই তারিখে আরদ্ধ এবং ২০০১ সালের ৩০শে জুন তারিখে সমাপ্য এবং ২০০১ সালের ১লা জুলাই তারিখে আরদ্ধ এবং ২০০২ সালের ৩০শে জুন তারিখে সমাপ্য বত্সরের জন্য প্রযোজ্য হইবে৷(৫) এই ধারায় এবং এই ধারার অধীনে আরোপিত কর হারের উদ্দেশ্যে ব্যবহৃত “মোট আয় (total income)” বলিতে Income-tax Ordinance, 1984 (XXXVI of 1984) এর বিধান অনুসারে নিরূপিত মোট আয় (total income) বুঝাইবে৷

৮৪৷ Income-tax Ordinance, 1984 (XXXVI of 1984) এর আওতায় ২০০০ সালের ১লা জুলাই ও ২০০১ সালের ১লা জুলাই হইতে আরদ্ধ কর বত্সরের জন্য মোট কর নির্ধারণের ক্ষেত্রে এই আইনের তফসিল-৩ এর দ্বিতীয় অংশে নির্দিষ্ট হার অনুযায়ী সারচার্জ ধার্য হইবে৷

১৯৯১ সনের ২২ নং আইনের ধারা ২ এর সংশোধন

৮৫৷ মূল্য সংযোজন কর আইন, ১৯৯১ (১৯৯১ সনের ২২ নং আইন), অতঃপর মূল্য সংযোজন কর আইন বলিয়া উল্লিখিত, এর ধারা ২ এর-(ক) দফা (ছ) এর পরিবর্তে নিম্নরূপ দফা (ছ) প্রতিস্থাপিত হইবে, যথা:-“(ছ) “করযোগ্য সেবা” অর্থ দ্বিতীয় তফসিলে অন্ত্মর্ভুক্ত নহে এইরূপ কোন সেবা”;(খ) দফা (ঝ) এর “কালেক্টরের” শব্দটির পরিবর্তে “কমিশনারের” শব্দটি প্রতিস্থাপিত হইবে;(গ) দফা (ঞ) এর পরিবর্তে নিম্নরূপ দফা (ঞ) প্রতিস্থাপিত হইবে, যথা:-“(ঞ) “চালানপত্র” অর্থ ধারা ৩২ এর অধীন প্রদত্ত চালানপত্র”;(ঘ) দফা (ণ) এর পর নিম্নরূপ একটি নতুন দফা (ণণ) সন্নিবেশিত হইবে, যথা:-“(ণণ) “ণণ” অর্থ পণ্য সরবরাহ বা সেবা প্রদানের বিপরীতে প্রাপ্ত অথবা প্রাপ্য সমুদয় অর্থ অথবা অর্থের মাধ্যমে পরিমাপযোগ্য মূল্য”;(ঙ) দফা (দদ) এর পর নিম্নরূপ দুইটি নতুন দফা (দদদ) ও (দদদদ) সন্নিবেশিত হইবে, যথা:-“(দদদ) “বিল অব এন্টি” অর্থ Customs Act, 1969 (IV of 1969) এর section 2(c) তে সংজ্ঞায়িত “bill of entry”;(দদদদ) “বিল অব এক্সপোর্ট” অর্থ Customs Act, 1969 (IV of 1969) এর section 2(d) তে সংজ্ঞায়িত “bill of export”৷

৮৬৷ মূল্য সংযোজন কর আইন এর ধারা ৩ এর-(ক) উপ-ধারা (১) এ “দ্বিতীয় তফসিলে উল্লিখিত” শব্দগুলির পরিবর্তে “দ্বিতীয় তফসিলে উল্লিখিত সেবাসমূহ ব্যতীত” শব্দগুলি প্রতিস্থাপিত হইবে;(খ) উপ-ধারা (৩) এর পর নিম্নরূপ একটি নতুন উপ-ধারা (৩ক) সন্নিবেশিত হইবে, যথা:-“(৩ক) ধারা ১৫ এর অধীন নিবন্ধিত ব্যক্তি পণ্য সরবরাহ ও সেবা প্রদানকালে পণ্য বা সেবা মূল্যের সহিত ক্রেতার নিকট হইতে উপ-ধারা (১) এ ধার্য্যকৃত মূল্য সংযোজন কর আদায় করিবেন৷”;(গ) উপ-ধারা (৪) এর পর নিম্নরূপ একটি নতুন উপ-ধারা (৫) সংযোজিত হইবে, যথা:-“(৫) এই ধারার উদ্দেশ্য পূরণকল্পে বোর্ড, জনস্বার্থে, সরকারী গেজেটে প্রজ্ঞাপন দ্বারা-(ক) যে কোন করযোগ্য পণ্য বা পণ্য শ্রেণীকে করযোগ্য সেবা এবং যে কোন করযোগ্য সেবাকে করযোগ্য পণ্য হিসাবে ঘোষণা করিতে পারিবে; এবং(খ) করযোগ্য যে কোন সেবার, পরিধি নির্ধারণের লক্ষ্যে, ব্যাখ্যা প্রদান করিতে পারিবে৷”৷

৮৭৷ মূল্য সংযোজন কর আইন এর ধারা ৫ এর উপ-ধারা (২) এর “ব্যবসায়ীর যাবতীয় ব্যয় ও তত্কর্তৃক প্রযোজ্য ক্ষেত্রে, প্রদত্ত কমিশন, চার্জ ও সম্পূরক শুল্কসহ সকল শুল্ক ও কর (মূল্য সংযোজন কর ব্যতীত) অন্ত্মর্ভুক্ত থাকিবে” শব্দগুলি, কমাগুলি ও বন্ধনীর পরিবর্তে “ব্যবসায়ী কর্তৃক ক্রয়কৃত উপকরণ মূল্য, যাবতীয় ব্যয় ও তত্কর্তৃক প্রযোজ্য ক্ষেত্রে, প্রদত্ত কমিশন, চার্জ, ফি ও সম্পূরক শুল্কসহ সকল শুল্ক ও কর (মূল্য সংযোজন কর ব্যতীত) এবং মুনাফা অন্ত্মর্ভুক্ত থাকিবে” শব্দগুলি, কমাগুলি ও বন্ধনী প্রতিস্থাপিত হইবে৷

১৯৯১ সনের ২২ নং আইনের ধারা ৬ এর সংশোধন

৮৮৷ মূল্য সংযোজন কর আইন এর ধারা ৬ এর-(ক) উপ-ধারা (৪ক) এর পরিবর্তে নিম্নরূপ দুইটি নতুন উপ-ধারা যথাক্রমে (৪ক) ও (৪কক) প্রতিস্থাপিত হইবে, যথা:-“(৪ক) উপ-ধারা (৪) এ যাহা কিছুই থাকুক না কেন বোর্ড, সরকারী গেজেট প্রজ্ঞাপন দ্বারা, উক্ত প্রজ্ঞাপনে নির্ধারণকৃত তারিখ হইতে যে কোন পণ্য বা পণ্য শ্রেণীর উপর প্রযোজ্য মূল্য সংযোজন কর বা, তেগত্রমত, মূল্য সংযোজন কর এবং সম্পূরক শুল্ক আদায়ের উদ্দেশ্যে নির্দিষ্টকৃত মূল্য মানের নিরাপত্তামূলক ব্যবস্থা সম্বলিত বিশেষ আকার ও ডিজাইনের স্ট্যাম্প (Stamp) বা ব্যাণ্ডরোল (Bandrol) বা বিশেষ চিহ্ন বা ছাপ উক্ত পণ্যের মোড়ক বা ধারক বা পাত্রের গায়ে ব্যবহার করার নির্দেশ প্রদান করিতে পারিবে; এবং এইরূপ স্ট্যাম্প বা ব্যাণ্ডরোল বা বিশেষ চিহ্ন বা ছাপ এর ব্যবহার, বিতরণ, সংরপক্ষণ, তদারকি, পর্যবেপক্ষণ, হিসাব সংরপক্ষণ ও মোড়কজাতকরণ বিষয়ে সংশ্লিষ্ট সকল পদ্ধতি নির্ধারণ করিতে পারিবে৷[ব্যাখ্যাঃ এই উপ-ধারায় ব্যাণ্ডরোল অর্থে বোর্ড কর্তৃক নির্দিষ্ট রং, ডিজাইন, পরিমাপ ও নিরাপত্তামূলক ব্যবস্থা সম্বলিত দলিল (Security Instrument)- েক বুঝাইবে৷];(৪কক) এই ধারার অন্যান্য বিধানাবলী সত্বেও, কোন নির্মাণ সংস্থা, ইনডেন্টিং সংস্থা, ট্রাভেল এজেন্সি, মোটর গাড়ীর গ্যারেজ ও ওয়ার্কসপ এবং ডকইয়ার্ড এবং সরকার কর্তৃক সরকারী গেজেটে প্রজ্ঞাপন দ্বারা এতদুদ্দেশ্যে সময় সময়, নির্ধারিত কোন সেবা প্রদানকারী ব্যক্তি কর্তৃক প্রদেয় মূল্য সংযোজন কর সেবা গ্রহণকারী বা, তেগত্রমত মূল্য বা কমিশন পরিশোধকারী ব্যক্তিকে সেবা মূল্য বা কমিশন পরিশোধকালে বোর্ড কর্তৃক প্রদত্ত আদেশ দ্বারা নির্ধারিত পদ্ধতিতে উত্সে আদায়, কর্তন ও সরকারী ট্রেজারীতে জমা করিতে হইবে :তবে শর্ত থাকে যে, বৈদেশিক সাহায্যপুষ্ট কোন প্রকল্পের আওতায় কোন সেবা প্রদানকারী ব্যক্তি কর্তৃক প্রদেয় মূল্য সংযোজন কর যদি সেবা গ্রহণকারী বা তেগত্রমত, সেবা মূল্য বা কমিশন পরিশোধকারী ব্যক্তি সেবা মূল্য বা কমিশন পরিশোধকালে বোর্ড কর্তৃক আদেশ দ্বারা নির্ধারিত পদ্ধতিতে উত্সে আদায় এবং কর্তনপূর্বক সরকারী ট্রেজারীতে জমা করেন এবং উক্ত সেবা প্রদানকারী ব্যক্তি কর্তৃক উক্ত সমুদয় সেবা অথবা উহার অংশবিশেষ প্রদানের ক্ষেত্রে কোন সাব-কন্ট্রাক্টর বা এজেন্ট অথবা অন্য কোন সেবা প্রদানকারী ব্যক্তিকে নিয়োগ করেন সেই ক্ষেত্রে উক্ত মূল সেবা প্রদানকারীর সাব-কন্ট্রাক্টর, এজেন্ট অথবা নিয়োগকৃত অন্য কোন সেবা প্রদানকারী ব্যক্তির নিকট হইতে, উক্ত সেবার উপর প্রাথমিক পর্যায়ে প্রযোজ্য মূল্য সংযোজন কর আদায় বা কর্তন এবং সরকারী ট্রেজারীতে জমা প্রদানের দালিলিক প্রমাণাদি উপস্থাপন সাপেতেগ, পুনরায় উত্সে মূল্য সংযোজন কর আদায় করা যাইবে না৷”৷

১৯৯১ সনের ২২ নং আইনের ধারা ৯ এর সংশোধন

৮৯৷ মূল্য সংযোজন কর আইন এর ধারা ৯ এর-(ক) উপ-ধারা (১) এর পরিবর্তে নিম্নরূপ উপ-ধারা (১) প্রতিস্থাপিত হইবে, যথা:-“(১) করযোগ্য পণ্যের সরবরাহকারী, ব্যবসায়ী বা করযোগ্য সেবা প্রদানকারী প্রতি কর মেয়াদে তত্কর্তৃক সরবরাহকৃত পণ্য বা প্রদত্ত সেবার উপর প্রদেয় উত্পাদ করের (output tax) বিপরীতে, নিম্বর্ণিত ক্ষেত্র ব্যতীত, উপকরণ কর রেয়াত গ্রহণ করিতে পারিবেন, যথা:-(ক) অব্যাহতিপ্রাপ্ত পণ্য উত্পাদনে ব্যবহৃত উপকরণের উপর পরিশোধিত মূল্য সংযোজন কর;(খ) টার্ণওভার করের আওতাভুক্ত করদাতার নিকট হইতে সংগৃহীত উপকরণের উপর পরিশোধিত টার্ণওভার কর;(গ) পণ্য উত্পাদন বা সেবা প্রদানে ব্যবহৃত উপকরণের উপর পরিশোধিত সম্পূরক শুল্ক;(ঘ) প্রথমবার ব্যতীত অন্য কোন দফায় পুনঃ ব্যবহারযোগ্য মোড়কের উপর পরিশোধিত মূল্য সংযোজন কর;(ঙ) করযোগ্য পণ্য উত্পাদন বা করযোগ্য সেবা প্রদানের সহিত সরাসরি সম্পৃক্ত হইলেও কোন দালানকোঠা বা অবকাঠামো বা স্থাপনা নির্মাণ, সুষমীকরণ, আধুনিকীকরণ, পুনঃসংস্কারকরণ ও মেরামতকরণ, সকল প্রকার আসবাবপত্র, ষ্টেশনারী দ্রব্যাদি, এয়ারকন্ডিশনার, ফ্যান, আলোক সরঞ্জাম, জেনারেটর, ইত্যাদি ক্রয় বা মেরামতকরণ, স্থাপত্য পরিকল্পনা ও নক্‌শা, ইত্যাদির সহিত সংশ্লিষ্ট পণ্য এবং সেবার উপর পরিশোধিত মূল্য সংযোজন কর;(চ) করযোগ্য পণ্য উত্পাদন বা সরবরাহ বা করযোগ্য সেবা প্রদানের সহিত সরাসরি সম্পৃক্ত এবং সম্পৃক্ত নহে এইরূপ স্থান বা স্থাপনায় ব্যক্তিগত এবং ব্যবসায়ে যৌথভাবে ব্যবহৃত পণ্যাগার, বিজ্ঞাপন, টেলিফোন, টেলিপ্রিন্টার, ফ্যাক্স, ইন্টারনেট, ফ্রেইট ফরোয়াডার্স, ক্লিয়ারিং ও ফরোয়াডিং এজেন্ট, ওয়াসা, বীমা, অডিট ও একাউন্টিং ফার্ম, যোগানদার, সিকিউরিটি সার্ভিসেস, আইন পরামর্শক, পরিবহন ঠিকাদার, ঋণপত্র সেবা ও বিদ্যুত্ বিতরণ সেবার উপর পরিশোধিত মূল্য সংযোজন করের ষাট শতাংশের অতিরিক্ত মূল্য সংযোজন কর;(ছ) ভ্রমণ, আপ্যায়ন, কর্মচারীর কল্যাণ ও উন্নয়নমূলক কাজের ব্যয়ের বিপরীতে পরিশোধিত মূল্য সংযোজন কর;(জ) ধারা ৫ এর উপ-ধারা (৪) এর বিধান অনুযায়ী কোন নির্দিষ্ট সেবা প্রদানকারী কর্তৃক ক্রীত উপকরণের উপর পরিশোধিত মূল্য সংযোজন কর;(ঝ) ধারা ৫ এর উপ-ধারা (৭) এর বিধান অনুযায়ী নির্ধারিত ট্যারিফ মূল্যের ভিত্তিতে পণ্য সরবরাহকারী কর্তৃক ক্রীত উপকরণের উপর পরিশোধিত মূল্য সংযোজন কর;(ঞ) নিবন্ধন সংখ্যা, নাম ও ঠিকানা ব্যতীত অন্য কোন নিবন্ধন সংখ্যা, নাম ও ঠিকানা সম্বলিত বিল অব এন্ট্রি বা চালানপত্রে উল্লিখিত উপকরণ কর; এবং(ট) অন্যের অধিকারে, দখলে, তত্ত্বাবধানে রতিগত পণ্যের উপর পরিশোধিত মূল্য সংযোজন কর:তবে শর্ত থাকে যে, চালানপত্র বা বিল অব এন্ট্রিসহ উহাতে বর্ণিত সমুদয় উপকরণ যে তারিখে করদাতার উত্পাদন, সরবরাহ বা সেবা প্রদান স্থলে প্রবেশ করিবে উক্ত তারিখের কর মেয়াদেই করদাতাকে সমুদয় উপকরণ কর রেয়াত গ্রহণ করিতে হইবে:আরো শর্ত থাকে যে, উপকরণের সাথে সম্পৃক্ত দলিলাদি করদাতা তাহার অধিকার পাওয়া সত্ত্বেও যুক্তিসংগত কোন কারণে একই কর মেয়াদে সমুদয় উপকরণ তাহার উত্পাদন, সরবরাহ বা সেবা প্রদান স্থলে প্রবেশ করাইতে ব্যর্থ হইলে উক্ত উপকরণ উত্পাদন, সরবরাহ বা সেবা প্রদান স্থলে সম্পূর্ণভাবে প্রবেশ করানো সাপেতেগ পরবর্তী কর মেয়াদের যে কোন তারিখে উক্ত উপকরণ কর রেয়াত গ্রহণ করা যাইবে৷”;(খ) উপ-ধারা (১ক) এর পরিবর্তে নিম্নরূপ উপ-ধারা (১ক) প্রতিস্থাপিত হইবে, যথা:-“(১ক) মূলধনী যন্ত্রপাতির ক্ষেত্রে উপকরণ কর রেয়াত বিধি দ্বারা নির্ধারিত পদ্ধতিতে গ্রহণ করিতে হইবে৷”;(গ) উপ-ধারা (২) এর পরিবর্তে নিম্নরূপ উপ-ধারা (২) প্রতিস্থাপিত হইবে, যথা:-“(২) উপ-ধারা (১) এ বর্ণিত তেগত্রসমূহে উপকরণ কর রেয়াত গ্রহণের অধিকার না থাকা সত্ত্বেও কোন ব্যক্তি উক্তরূপ কর রেয়াত গ্রহণ করিলে সশ্লিষ্ট কর্মকর্তা, ধারা ৩৭ এ যাহা কিছুই থাকুক না কেন, গৃহীত রেয়াত নাকচ করিয়া চলতি হিসাব বা দাখিলপত্রে প্রয়োজনীয় সমন্বয় সাধনের নির্দেশ দিতে পারিবেন৷”৷

১৯৯১ সনের ২২ নং আইনের ধারা ১৩ এর সংশোধন

৯০৷ মূল্য সংযোজন কর আইন এর ধারা ১৩ এর উপ-ধারা (১) এ “যে কোন ব্যক্তি” শব্দগুলির পূর্বে “Customs Act, 1969 (IV of 1969) এর Chapter VI এর বিধানাবলীতে যাহা কিছুই থাকুক না কেন, এই ধারার অধীনে” শব্দগুলি, সংখ্যাগুলি, কমাগুলি সন্নিবেশিত হইবে৷

১৯৯১ সনের ২২ নং আইনের ধারা ২৪ এর সংশোধন

৯১৷ মূল্য সংযোজন কর আইন এর ধারা ২৪ এর-(ক) উপ-ধারা (১) এ “যে কোন সদস্য এবং” শব্দগুলির পর “ইউনিয়ন পরিষদ, উপজেলা পরিষদ, পৌরসভা, জেলা পরিষদ, সিটি কর্পোরেশন এর কর্তৃপপক্ষ” শব্দগুলি ও কমাগুলি সন্নিবেশিত হইবে;(খ) উপ-ধারা (২) এ “সদস্য বা” শব্দগুলির পরিবর্তে, “সদস্য, কর্তৃপপক্ষ বা কর্মকর্তা” শব্দগুলি এবং কমা প্রতিস্থাপিত হইবে৷

৯২৷ মূল্য সংযোজন কর আইন এর ধারা ২৬ এর-(ক) উপ-ধারা (১) এ “নথিপত্র ও বাণিজ্যিক দলিলাদি পরীতগা করিতে এবং প্রয়োজনবোধে উহা দাখিল করিবার নির্দেশ দান করিতে বা আটক করিতে পারিবেন” শব্দগুলির পরিবর্তে “পুস্তক, নথিপত্র ও বাণিজ্যিক দলিলাদিসহ ব্যবসা সংক্রান্ত সকল কাগজাদি পরীক্ষা-নিরীক্ষা (অডিট) করিতে, প্রয়োজনবোধে উহা দাখিল করিবার নির্দেশ দান করিতে বা আটক করিতে এবং এতদউদ্দেশ্যে প্রয়োজনীয় অন্যান্য কার্য করিতে পারিবেন” শব্দগুলি, কমাগুলি, বন্ধনী প্রতিস্থাপিত হইবে;(খ) উপ-ধারা (১) এর প্রথম শর্তাংশের কোলনের পরিবর্তে দাঁড়ি প্রতিস্থাপিত হইবে এবং দ্বিতীয় শর্তাংশটি বিলুপ্ত হইবে;(গ) উপ-ধারা (৩) এ “আদেশ দ্বারা” শব্দগুলির পরিবর্তে “আদেশ দ্বারা, যুক্তিসংগত পারিশ্রমিক নির্ধারণ ও শর্তাদি স্থির ক্রমে,” শব্দগুলি ও কমাগুলি প্রতিস্থাপিত হইবে;(ঘ) উপ-ধারা (৪) এর পরিবর্তে নিম্নরূপ তিনটি উপ-ধারা যথাক্রমে (৪), (৫) ও (৬) প্রতিস্থাপিত হইবে, যথা:-“(৪) কমিশনার যদি এই মর্মে সন্তুষ্ট হন যে, কোন করযোগ্য পণ্যের সরবরাহকারী বা সেবা প্রদানকারী পণ্য সরবরাহ বা সেবা প্রদানের বিপরীতে প্রাপ্য পণ সঠিকভাবে নথিপত্র ও বাণিজ্যিক দলিলাদিতে উল্লেখ বা দাখিলপত্রে ঘোষণা প্রদান করেন না, অথবা পণ্য সরবরাহ বা সেবা প্রদানের বিপরীতে চালানপত্র ইস্যু করেন না বা চালানপত্র ইস্যু করিলেও আইনানুগভাবে ইস্যু করেন না অথবা কর প্রদানের দায়-দায়িত্ব পরিহারের উদ্দেশ্যে মূল্য সংযোজন কর কর্তৃপপক্ষকে করযোগ্য পণ্য ও সেবার লেনদেন বা বিক্রয় সংক্রান্ত্ম তথ্য প্রদান করেন না অথবা অসত্য তথ্য প্রদান করেন, তাহা হইলে তিনি উক্ত ব্যক্তির প্রকৃত করের দায়-দায়িত্ব নিরূপণের লতেগ্য এক বা একাধিক কর মেয়াদে উক্ত ব্যক্তির পণ্য সরবরাহ বা সেবা প্রদান বা ব্যবসায় স্থলে পর্যবেপক্ষণ ও নজরদারীর জন্য এক বা একাধিক মূল্য সংযোজন কর কর্মকর্তা নিয়োগ করিতে পারিবেন৷(৫) উপ-ধারা (৪) এর অধীন নিযুক্ত কর্মকর্তা উক্ত উপ-ধারায় উল্লিখিত করদাতার পণ্য সরবরাহ অথবা সেবা প্রদান কার্যক্রম পর্যবেপক্ষণ ও নজরদারী করিতে পারিবেন এবং এইরূপ পর্যবেপক্ষণ বা নজরদারীর মাধ্যমে প্রাপ্ত করযোগ্য পণ্য বা সেবার লেনদেন বা বিক্রয় সংক্রান্ত তথ্য কমিশনারের নিকট উপস্থাপন করিবেন যাহার ভিত্তিতে কমিশনার উক্ত করদাতার সংশ্লিষ্ট কর মেয়াদ বা অন্য যে কোন কর মেয়াদের কর নির্ধারণ করিতে পারিবেন৷(৬) যদি কমিশনের বিশ্বাস করিবার যুক্তিসঙ্গত কারণ থাকে যে, কোন করযোগ্য পণ্যের সরবরাহকারী বা সেবা প্রদানকারী ধারা ৩২ অনুযায়ী চালানপত্র প্রদান করেন না বা অসত্য চালানপত্র প্রদান করেন অথবা ধারা ৩১ মোতাবেক রতিগত হিসাবপত্রে বা ধারা ৩৫ এর অধীনে প্রদত্ত কোন কর মেয়াদের দাখিলপত্রে বিক্রয় মূল্য বা সর্বমোট প্রাপ্তি সঠিকভাবে প্রদর্শন করেন নাই, সেইক্ষেত্রে তিনি উক্ত করযোগ্য পণ্যের সরবরাহকারী বা সেবা প্রদানকারীর সহিত তুলনীয় অভিন্ন অবস্থান, পরিবেশ ও পরিস্থিতিসম্পন্ন অনুরূপ করযোগ্য পণ্যের সরবরাহকারী বা সেবা প্রদানকারীর বিক্রয় মূল্য বা সর্বমোট প্রাপ্তি বা অন্যান্য প্রাসঙ্গিক তথ্যাদি বিবেচনাপূর্বক প্রথম লব্ধ ধারণার ভিত্তিতে বিবেচ্য করযোগ্য পণ্যের সরবরাহকারী বা সেবা প্রদানকারীর জন্য প্রতি কর মেয়াদে ন্যুনতম বিক্রয়ের পরিমাণ, মূল্য সংযোজনের পরিমাণ, প্রদেয় করের ভিত্তিমূল্য বা প্রদেয় করের পরিমাণ নির্ধারণ করিতে পারিবেন:তবে শর্ত থাকে যে উপ-ধারা (৪), (৫) ও (৬) এর বিধান কার্যকর করার ক্ষেত্রে করদাতার অনুকূলে শুনানীর সুযোগদান সংক্রান্ত্ম আইনের অন্যান্য বিধানাবলী অতগুন্ন থাকিবে৷”৷

১৯৯১ সনের ২২ নং আইনের ধারা ৩১ এর সংশোধন

৯৩৷ মূল্য সংযোজন কর আইন এর ধারা ৩১ এর দফা (ঙ) এর পর নিম্নরূপ একটি নতুন দফা (ঙঙ) সন্নিবেশিত হইবে, যথা:-“(ঙঙ) করযোগ্য ও অব্যাহতিপ্রাপ্ত পণ্য অথবা সেবা প্রদান সংক্রান্ত বাণিজ্যিক দলিলাদি;”৷

৯৪৷ মূল্য সংযোজন কর আইন এর ধারা ৩৪ এ “নথিপত্র” শব্দের পরিবর্তে “নথিপত্র, বাণিজ্যিক দলিলাদি, ইত্যাদি” শব্দগুলি ও কমাগুলি প্রতিস্থাপিত হইবে৷

৯৫৷ মূল্য সংযোজন কর আইন এর ধারা ৩৭ এর-(ক) উপ-ধারা (১) এ “অনধিক পঁচিশ হাজার” শব্দগুলির পরিবর্তে “অন্যুন পঁচিশ হাজার টাকা এবং অনূর্ধ্ব পঞ্চাশ হাজার” শব্দগুলি প্রতিস্থাপিত হইবে;(খ) উপ-ধারা (২) এর-(অ) দফা (ঞ) এর পর নিম্নরূপ একটি নতুন দফা (ঞঞ) সন্নিবেশিত হইবে, যথা:-“(ঞঞ) ধারা ৬ এর উপ-ধারা (৪ক) এর বিধান অনুযায়ী করণীয় কোন কিছু না করিলে বা করণীয় নয় এমন কিছু করেন; অথবা”;(আ) দফা (ট) তে উল্লিখিত “ঞ” অপক্ষরের পরিবর্তে “ঞঞ” অপক্ষরগুলি প্রতিস্থাপিত হইবে;(ই) দফা (ট) এর পর দণ্ড সম্পর্কিত বিধানের-(i) “আড়াই গুণ” শব্দগুলির পরিবর্তে “অন্যুন সমপরিমাণ এবং অনুর্ধ্ব আড়াই গুণ” শব্দগুলি প্রতিস্থাপিত হইবে;(ii) “অনধিক এক লপক্ষ টাকা” শব্দগুলির পরিবর্তে “মূল্য সংযোজন কর বা, তেগত্রমত, মূল্য সংযোজন কর ও সম্পূরক শুল্কের অন্যুন সমপরিমাণ এবং অনুর্ধ আড়াই গুণ” শব্দগুলি এবং কমাগুলি প্রতিস্থাপিত হইবে; এবং(iii) “পঁচিশ হাজার” শব্দগুলির পরিবর্তে “অন্যুন পঁচিশ হাজার এবং অনুর্ধ এক লপক্ষ” শব্দগুলি প্রতিস্থাপিত হইবে৷

৯৬৷ মূল্য সংযোজন কর আইন এর ধারা ৩৮ এর উপ-ধারা (২) এর দফা (খ) এ উল্লিখিত “আড়াই গুণ” শব্দগুলির পরিবর্তে “অন্যুন সমপরিমাণ এবং অনুর্ধ আড়াই গুণ” শব্দগুলি প্রতিস্থাপিত হইবে৷

১৯৯১ সনের ২২ নং আইনের ধারা ৪০ এর সংশোধন

৯৭৷ মূল্য সংযোজন কর আইন এর ধারা ৪০ এর দফা (খ) এর পরিবর্তে নিম্নরূপ দফা (খ) প্রতিস্থাপিত হইবে, যথা:-“(খ) মূল্য সংযোজন কর কর্মকর্তাগণ কর্তৃক সরবরাহ বা সেবা প্রদানের ক্ষেত্রে, নিম্নবর্ণিত টেবিল অনুযায়ী-

	সহকারী কমিশনার	পণ্য মূল্য অনধিক ১ (এক) লপক্ষ টাকা হইলে;
	সুপারিনটেনডেন্ট	পণ্য মূল্য অনধিক ২৫ (পঁচিশ) হাজার  টাকা হইলে;
(আ)   অর্থদণ্ড আরোপযোগ্য ন্যায় নির্ণয়নের ক্ষেত্রে৷	বিভাগীয় কর্মকর্তা	পূর্ণ পক্ষমতা৷
[ব্যাখ্যাঃ এই টেবিলে “পণ্য মূল্য” অর্থে আটককৃত পণ্য বহনকারী যানবাহনের মূল্য অন্ত্মর্ভুক্ত হইবে না৷]”৷

১৯৯১ সনের ২২ নং আইনের ধারা ৪২ এর সংশোধন

৯৮৷ মূল্য সংযোজন কর আইন এর ধারা ৪২ এর-(ক) উপ-ধারা (২) এর দফা (ক) এবং (খ) তে উল্লিখিত “দশ শতাংশ” এবং “পঁচিশ শতাংশ” শব্দগুলির পরিবর্তে যথাক্রমে “পাঁচ শতাংশ” এবং “দশ শতাংশ” শব্দগুলি প্রতিস্থাপিত হইবে;(খ) উপ-ধারা (৪) এ “ছয়” শব্দটির পরিবর্তে “বার” শব্দটি প্রতিস্থাপিত হইবে৷

৯৯৷ মূল্য সংযোজন কর আইন এর ধারা ৫৬ এর উপ-ধারা (১) এর দফা (গ) এ “বন্ধ” শব্দটির পর “বা ব্যবসায় প্রতিষ্ঠানের যানবাহন (পণ্যসহ বা ব্যতিরেকে) আটক” শব্দগুলি ও বন্ধনী সন্নিবেশিত হইবে৷

১০০৷ মূল্য সংযোজন কর আইন এর ধারা ৫৯ এ “ব্যবসায়ের মালিকানা” শব্দগুলির পরিবর্তে “ব্যবসায় প্রতিষ্ঠানের আওতাধীন কোন স্থাবর বা অস্থাবর সম্পত্তি বা মালিকানা” শব্দগুলি প্রতিস্থাপিত হইবে৷

১০১৷ মূল্য সংযোজন কর আইন এর ধারা ৭০ এ “ধারা ১৩, ৬৮ ও ৬৯” শব্দ ও সংখ্যাগুলির পরিবর্তে “ধারা ১৩ এর বিধান তগুণ্ন না করিয়া এবং ধারা ৬৮ এবং ৬৯” শব্দগুলি এবং সংখ্যাগুলি প্রতিস্থাপিত হইবে৷

১৯৯১ সনের ২২ নং আইনের ধারা ৭১কক এর সন্নিবেশ

১০২৷ মূল্য সংযোজন কর আইন এর ধারা ৭১ক এর পর নিম্নরূপ নূতন ধারা ৭১কক সন্নিবেশিত হইবে, যথা:-“৭১কক৷ কর ফাঁকি, আইন লংঘন ইত্যাদির উদ্‌ঘাটনের জন্য পুরস্কার প্রদান৷- এই আইন বা আপাততঃ বলবত্ অন্য কোন আইনে ভিন্নতর যাহা কিছুই থাকুক না কেন, বোর্ড বিধি দ্বারা নির্ধারিত ক্ষেত্রে, পদ্ধতিতে এবং সীমা সাপেতেগ, নিম্বর্ণিত ব্যক্তিগণকে পুরস্কার প্রদান করিতে পারে:-(ক) এমন কোন ব্যক্তি যিনি এই আইন বা আপাততঃ বলবত্ অন্য কোন আইনের বিধান লঙ্ঘন করার ব্যাপারে বা তদধীনে আদায়যোগ্য কর বা রাজস্ব ফাঁকি দেওয়া বা উহার প্রচেষ্টার ব্যাপারে মূল্য সংযোজন কর কর্মকর্তাকে তথ্য সরবরাহ করেন; বা(খ) এমন কোন মূল্য সংযোজন কর কর্মকর্তা বা অন্য কোন সরকারী সংস্থা বা স্থানীয় কর্তৃপতেগর কোন কর্মকর্তা বা কর্মচারী যিনি, এই আইন বা আপাততঃ বলবত্ অন্য কোন আইনের অধীন আদায়যোগ্য কর বা রাজস্ব ফাঁকি বা উহা ফাঁকি দেওয়ার চেষ্টা বা উক্ত আইনের কোন বিধানের লংঘন চিহ্নিত বা উদঘাটন করেন এবং যদি উক্তরূপ তথ্য সরবরাহ বা চিহ্নিতকরণ বা উদঘাটনের ফলে নিম্নরূপ পরিস্থিতির উদ্ভব হইয়া থাকে:-(অ) যে পণ্য বা অন্য কিছুর ব্যাপারে উক্ত কর বা রাজস্ব ফাঁকি দেওয়া হইয়াছে বা ফাঁকি দেওয়ার চেষ্টা করা হইয়াছে বা আইনের বিধান লংঘন করা হইয়াছে, সেই পণ্য আটক এবং বাজেয়াপ্ত হয়, বা(আ) এই আইন বা আপাততঃ বলবত্ অন্য কোন আইনের অধীনে মূল্য সংযোজন কর বা সংশ্লিষ্ট রাজস্ব আদায় হয়, বা ক্ষেত্রমত, দায়ী ব্যক্তির উপর আরোপিত জরিমানা আদায় হয়, বা(ই) এই আইন বা সংশ্লিষ্ট অন্য কোন আইনের অধীনে দায়ী ব্যক্তি দণ্ডিত হন৷”৷

১৯৯১ সনের ২২ নং আইনের ধারা ৭২(২) এর সংশোধন

১০৩৷ মূল্য সংযোজন কর আইন এর ধারা ৭২(২) এর দফা (ট) এর পরিবর্তে নিম্নরূপ দফা (ট) প্রতিস্থাপিত হইবে, যথা:-“(ট) ধারা ৭১কক এর বিধান অনুযায়ী পুরস্কার প্রদান৷”৷

১৯৯১ সনের ২২ নং আইনের প্রথম তফসিলের প্রতিস্থাপন

১০৪৷ মূল্য সংযোজন কর আইন এর প্রথম তফসিলের পরিবর্তে এই আইনের তফসিল-৪ এ বর্ণিত প্রথম তফসিল প্রতিস্থাপিত হইবে৷

১০৫৷ মূল্য সংযোজন কর আইন এর দ্বিতীয় তফসিলের পরিবর্তে এই আইনের তফসিল-৫ এ বর্ণিত দ্বিতীয় তফসিল প্রতিস্থাপিত হইবে৷
