(2) The provisions of this section shall not apply to cases where any proceeding under any provision of this Ordinance or any other law has been drawn on or before the day of submission of return or revised return.”।

Preamble
যেহেতু সরকারের আর্থিক প্রস্তাবাবলি কার্যকরকরণ এবং নিম্নবর্ণিত উদ্দেশ্যসমূহ পূরণকল্পে কতিপয় আইন সংশোধন করা সমীচীন ও প্রয়োজনীয়; সেহেতু এতদ্দ্বারা নিম্নরূপ আইন করা হইল:-Sections/Articles
সংক্ষিপ্ত শিরোনাম ও প্রবর্তন
১। (১) এই আইন অর্থ আইন, ২০২০ নামে অভিহিত হইবে। (২) এই আইনের তৃতীয় অধ্যায় এবং পঞ্চমঅধ্যায়ের ধারা ৭৯, ৮০ ও ৮১ অবিলম্বে কার্যকর হইবে। (৩) এই আইনের দ্বিতীয় অধ্যায় এবং চতুর্থ অধ্যায় ও পঞ্চমঅধ্যায়ের ধারা ৭৯, ৮০ ও ৮১ ব্যতীত, অন্যান্য ধারাসমূহ এবং ষষ্ঠ অধ্যায় ২০২০ সনের ১ জুলাই তারিখে কার্যকর হইবে।Act No. I of 1944 এর section 2 এর সংশোধন
২। Excises and Salt Act, 1944 (Act No. I of 1944), অতঃপর উক্ত Act বলিয়া উল্লিখিত, এর section 2 এর— (ক) clause (a) এর পর নিম্নরূপ নূতন clause (aa) সন্নিবেশিত হইবে, যথা:— “(aa) “associate” means such a relation between two or more persons as would make one act or reasonably expected to act in accordance with the intention of the other or make both acts or reasonably expected to act in accordance with the intention of a third person, and it also includes the following persons, namely— (a) a partner of a partnership; (b) a shareholder of a company; (c) a Trust and a beneficiary of such Trust; or (d) a joint venture for property development and the landowner as a partner of that joint venture, builder, or other related person, but does not include the persons with employment relations;”; এবং (খ) clause (l) এর পর নিম্নরূপ নূতন clause (ll) সন্নিবেশিত হইবে, যথা:— “(ll) “government entity” means— (a) a government or any of its ministries, divisions, or attached departments; (b) a semi-government entity or an autonomous body; (c) a state-owned enterprise; or (d) a local authority, council, or a similar organization;”।Act No. I of 1944 এর section 3AA এর প্রতিস্থাপন
৩। উক্ত Act এর section3AA এর পরিবর্তে নিম্নরূপ section3AA প্রতিস্থাপিত হইবে, যথা:— “3AA. Determination of duty.— **(**1) The Commissioner of Excise may, after giving a person an opportunity of being heard, determine the amount of duty of excise payable by such person, if the Commissioner reasonably believes that the person has made false or untrue statement in respect of payable duty of excises or if such person fails to pay the payable duty within the prescribed time. (2) In the cases specified in sub-section (1), the Commissioner of Excise shall, within 45 (forty five) working days from the date of hearing, serve a notice of the determination of duty upon such person, which shall, along with other necessary particulars, contain the following matters, namely— (a) the reason for such determination, the amount of duty payable as a result of such determination and a description of the basis on or before such amount of duty is determined; (b) the date by which such duty shall be payable, but such date shall be at least 15 (fifteen) working days after the date on which the notice is served; and (c) the time and place of filing appeal against such determination of duty. (3) The Commissioner of Excise shall not make a determination of duty for a duty period at the expiry of 5 (five) years after such tax period, unless a person wilfully neglects or commits a fraud in order to evade payment of duty, conceals or distorts any information, and any other offences under Value Added Tax and Supplementary Duty Act, 2012 (Act No. 47 of 2012). (4) If a person fails to pay a payable duty on or before the due date of payment, he shall be liable to pay an interest at a simple rate of 2% (two percent) per month on the amount of payable duty, from the next day, after the date such payment becomes due until the date the payment is made. (5) Nothing in this section shall prevent a Commissioner of Excise from imposing a fine mentioned in section 9.”।Act No. I of 1944 এর section 9 এর সংশোধন
৪। উক্ত Act এর section 9 এর clause (g) তে উল্লিখিত “five thousand or ten times” শব্দগুলির পরিবর্তে “five lac or two times” শব্দগুলি প্রতিস্থাপিত হইবে।Act No. I of 1944 এর section 11 এর প্রতিস্থাপন
৫। উক্তAct এর section 11 এর পরিবর্তে নিম্নরূপ section 11 প্রতিস্থাপিত হইবে, যথা:— “11. Recovery of Government Dues.—(1) When under this Act or any rules made thereunder, a duty is payable to the Government by any person or a penalty is adjudicated against any person or a notice or demand is served upon any person calling for the payment of any amount unpaid which may be payable by way of duty, penalty or under any bond or other instrument executed under the rules and such duty, penalty or other sum is not paid within the time it was required to be paid, an Excise Officer, not below the rank of Assistant Commissioner, may at any time— (a) deduct or require any other Excise, Customs or Value Added Tax (VAT) Officer to deduct the amount so payable from any money owing to such person or due which may be in the hands or at the disposal orunder the control of such Officer or of the Government; (b) require, by a notice in writing, any person owing any money to the person from whom such duty or penalty or any other sum is recoverable or due, to pay to such officer the amount specified in the notice, or the whole of such money if it is less than the amount so recoverable or due, within 7 (seven) days of the receipt of the notice or within such longer time as may be allowed by such officer; (c) recover such amount by attachment and sale of excisable goods or any plant, machinery and equipment used for the manufacture of such goods or any other goods in the factory or bonded warehouse or in any premises where any excisable services are provided or rendered; (d) stop removal of any goods belonging to such person or his associates from Customs control in the sea port, airport, land port, any other Customs-station or from such factory, bonded warehouse or premises till such amount is paid or recovered in full; (e) require any officer of Customs to recover such amount by detaining and selling any goods belonging to such person which are under the control of the Customs authorities; (f) require, by a notice in writing, any Government Entity to stop any excisable services till such amount is paid or recovered in full; (g) require, by a notice in writing, any Scheduled Bank having deposit of money of the person from whom such duty or regulatory duty or penalty or any other sum is recoverable to pay to such officer the amount specified in the notice or to freeze the account or make the account inoperative on respect of the notice. (2) If the amount is not recovered from such person in the manner provided in sub-section (1), the Excise Officer may prepare a certificate signed by him specifying the amount due from the person liable to pay the same and send it to the Deputy Collector (DC) in which such person resides or owns any property or conducts his business and the said Collector shall, on receiving such certificate, proceed to recover the amount specified in the certificate as a public demand or as if it were an arrear of land revenue. (3) The Government may appoint one or more officers to exercise the powers of a Certificate-officer under the Public Demands Recovery Act, 1913 (Bengal Act III of 1913) for the purpose of recovering the amount specified in a certificate prepared under sub-section (2), and when more than one Certificate-officers are so appointed the Government may also specify their territorial or other jurisdiction.”।Act No. I of 1944 এর section 13 এর সংশোধন
৬ । উক্ত Act এর section 13 এর clause (g) তে উল্লিখিত “Superintendent” শব্দের পরিবর্তে “Revenue Officer” শব্দগুলি প্রতিস্থাপিত হইবে।Act No.I of 1944 এর FIRST SCHEDULE এর সংশোধন
৭। উক্ত Act এর FIRST SCHEDULE এর PART-II এর “SERVICES” শিরোনামাধীন টেবিলের কলাম (1) এর Service Code E032.00 এর বিপরীতে কলাম (3) তে উল্লিখিত “Taka 30,000.00 (thirty thousand)” শব্দগুলি, সংখ্যাটি, কমা এবং বন্ধনীর পরিবর্তে “Taka 40,000.00 (forty thousand)” শব্দগুলি, সংখ্যাটি, কমা এবং বন্ধনী প্রতিস্থাপিত হইবে।Act No.IV of 1969 এর section 3 এর সংশোধন
৮ । Customs Act,1969 (Act No. IV of 1969), অতঃপর উক্ত Act বলিয়া উল্লিখিত, এর section 3 এর clause (d) এর পর নিম্নরূপ নূতন clause (dd) সন্নিবেশিত হইবে, যথা:— “(dd) a Commissioner of Customs (Single Window);”।Act No. IV of 1969 এর section 18 এর সংশোধন
৯। উক্তAct এর section 18 এর sub-section (1) এর proviso এর পরিবর্তে নিম্নরূপ proviso প্রতিস্থাপিত হইবে, যথা:— “Provided that no customs duty and regulatory duty under this Act or any other tax leviable under any other law for the time being in force shall, subject to such conditions, limitations or restrictions as the Board may, from time to time, by notification in the official Gazette, impose, be levied or collected in respect thereof, if the value of the goods for assessment purpose in any one consignment does not exceed two thousand taka.”।Act No. IV of 1969 এর section79 এর সংশোধন
১০। উক্ত Act এর section 79 এর sub-section (1A) এর পর নিম্নরূপ নূতন sub-section (1B) সন্নিবেশিত হইবে, যথা:— “(1B) A bill of entry under sub-section (1) shall be delivered within five working days since the arrival of goods: Provided that the Board may, by notification in the official Gazette, extend such time upon stipulating such conditions or limitations as it deems fit and proper.”।Act No. IV of 1969 এর section 156 এর সংশোধন
১১। Ac**t**N**o.**IV**of**1**969এর section**156এর সংশোধন ।**—**উক্ত Act এর Section 156 এর sub-section (1) এর Table এর Offences কলাম এর 14 নং ক্রমিকে বর্ণিত Offence এর বিপরীতে Penalties কলাম এর এন্ট্রির পরিবর্তে নিম্নরূপ এন্ট্রি প্রতিস্থাপিত হইবে, যথা:— “Such person shall be liable to a penalty at least twice but not exceeding four times the amount of the tax evaded in respect of which such offence is committed and such goods shall be liable to confiscation; and upon conviction by a Magistrate such person shall further be liable to rigorous imprisonment for a term not exceeding five years or to a fine not exceeding Taka fifty thousand or to both.”।Act No. IV of 1969 এর section 196 এর সংশোধন
১২। Ac**t**N**o.**IV**o**f**1**969এর section**196**এর সংশোধন।— উক্তAct এর section 196 এর পরিবর্তে নিম্নরূপ section 196 প্রতিস্থাপিত হইবে, যথা:— “196. Appellate Tribunal—(1) The Government shall constitute an Appellate Tribunal to be called the Customs, Excise and VAT Appellate Tribunal which shall consist of as many members as it thinks fit to exercise the powers and discharge the functions conferred on the Appellate Tribunal by this Act. (2) A person shall not be appointed as a member of the Customs, Excise and VAT Appellate Tribunal unless— (a) he was or is a member of the Board or holds the current charge of a member of the Board; or (b) he is a commissioner of Customs, Excise & VAT having experience of at least one year; or (c) he is, was or has been a District Judge. (3) The Government shall appoint one of the members of the Appellate Tribunal to be the President thereof, who is a member of the Board or holds the current charge of a member of the Board.”Act No. IV of 1969 এর section 196C এর সংশোধন
১৩। উক্তAct এর section 196C এর sub-section (2) ও (3) এর পরিবর্তে নিম্নরূপ sub-section (2) ও (3) প্রতিস্থাপিত হইবে, যথা:— “(2) Subject to the provisions of sub-sections (3) and (4), a Bench shall consist of any two members. (3) Every appeal against a decision or order relating, among other things, to the determination of any question having a relation to the rate of duty of customs or to the value of goods for purposes of assessment shall be heard by a special Bench constituted by the President for hearing such appeals and such Bench shall consist of not less than two members.”।Act No. IV of 1969 এর section 197D এর সন্নিবেশ
১৪। উক্তAct এর section 197C এর পর নিম্নরূপ নূতন section 197D সন্নিবেশিত হইবে, যথা:— “197D. Establishment of Bangladesh Single Window— (1) The Government may, by notification in the official Gazette, establish Bangladesh Single Window (BSW) which shall serve as the single electronic entry point and a platform for person involved in import, export, warehousing, transit or transhipment of goods. (2) There may be a Commissionerate to be called the Bangladesh Single Window Commissionerate which shall be responsible for the operation of the Bangladesh Single Window. (3) The Bangladesh Single Window Commissionerate shall consist of the Commissioner of Customs (Single Window) and other designated representative from the certificate, license and permit issuing agencies or bodies, as the case may be. (4) The functions of the Bangladesh Single Window Commissionerate shall be determined by the Board by notification in the official Gazette. (5) Any person intending to engage in import, export, warehousing, transit or transhipment of goods, shall submit data and documents electronically to the Bangladesh Single Window in such form and manner as may be prescribed by the Board. (6) The Board may, by notification in the official Gazette, constitute a Standing Committee with the following members, namely:— (a) Chairman, the National Board of Revenue, who shall also be its Chairperson; (b) a Member (Customs), the National Board of Revenue, who shall also be its Member Secretary; and (c) one representative from each of the certificate, license and permit issuing agencies or bodies, as the case may be. (7) The Standing Committee formed under sub-section (6) shall supervise and coordinate the activities of the Bangladesh Single Window Commissionerate and give necessary advice to it. (8) The Board may, by rules, prescribe the procedure, fees and other charges for the use of Bangladesh Single Window.”।Act No. IV of 1969 এর FIRST SCHEDULE এর প্রতিস্থাপন
১৫। উক্তAct এর FIRST SCHEDULE এর পরিবর্তে এই আইনের তফসিল-১ এ উল্লিখিত “FIRST SCHEDULE” (পৃথকভাবে মুদ্রিত) প্রতিস্থাপিত হইবে। [The Customs Act, 1969 (Act no. IVof 1969), অতঃপর উক্ত Act বলিয়া উল্লিখিত, এর FIRST SCHEDULE এ নিম্নলিখিত সংশোধনীগুলি অন্তর্ভুক্ত হইবে:] (১) 88 নং পৃষ্ঠার কলাম (1) এ উল্লিখিত Heading 28.33 এর আওতাভুক্ত কলাম (2) তে বর্ণিত H.S.Code “2833.19.00” এর বিপরীতে কলাম (5) এ উল্লিখিত এন্ট্রি “10%” এর পরিবর্তে এন্ট্রি “15%” প্রতিস্থাপিত হইবে। (২) 114 নং পৃষ্ঠার কলাম (1) এ উল্লিখিত Heading 32.05 এর আওতাভুক্ত কলাম (2) তে বর্ণিত H.S.Code “3205.00.00” এর বিপরীতে কলাম (5) এ উল্লিখিত এন্ট্রি “15%” এর পরিবর্তে এন্ট্রি “5%” প্রতিস্থাপিত হইবে। (৩)131 নং পৃষ্ঠার কলাম (1) এ উল্লিখিত Heading 38.24 এর আওতাভুক্ত কলাম (2) তে বর্ণিত H.S.Code “3824.99.50” এবং উহার বিপরীতে কলাম (3), (4), (5) ও (6) তে উল্লিখিতি এন্ট্রিসমূহের পর নিম্নবর্ণিত H.S.Code “3824.99.60” এবং উহার বিপরীতে কলাম (3), (4), (5) ও (6) তে উল্লিখিতি এন্ট্রিসমূহ সন্নিবেশিত হইবে, যথা:- “3824.99.60 --- Calcium Chloride based container kg 10% Free”। desiccant (৪) 274 নং পৃষ্ঠার কলাম (1) এ উল্লিখিত Heading 84.03 এর বিপরীতে কলাম (3) এ উল্লিখিত “Central heading boilers other than those of heading 84.02.” শব্দগুলি, সংখ্যাগুলি ও চিহ্নগুলির পরিবর্তে “Central heating boilers other than those of heading 84.02.” শব্দগুলি, সংখ্যাগুলি ও চিহ্নগুলি প্রতিস্থাপিত হইবে।Ordinance No. XXXVI of 1984 এর section 2 এর সংশোধন
১৬। Income-tax Ordinance, 1984 (Ordinance No. XXXVI of 1984), অতঃপর উক্ত Ordinance বলিয়া উল্লিখিত, এর section 2 এর— (ক) clause (30) এর— (অ) প্রারম্ভে উল্লিখিত “in relation to capital asset” শব্দগুলির পর “or a business or undertaking” শব্দগুলি সন্নিবেশিত হইবে; এবং (আ) sub-clause (a) তে উল্লিখিত “the price which such asset” শব্দগুলির পর “or such business or undertaking” শব্দগুলি সন্নিবেশিত হইবে; এবং (খ) clause (35) এর প্রারম্ভে উল্লিখিত ““income year” means” শব্দগুলি ও উদ্ধৃতি চিহ্নগুলির পরিবর্তে ““income year” means financial year immediately preceding the assessment year and includes” শব্দগুলি ও উদ্ধৃতি চিহ্নগুলি প্রতিস্থাপিত হইবে।।Ordinance No. XXXVI of 1984 এ section 16G এর পর নূতন section 16H এর সন্নিবেশ
১৭। উক্ত Ordinance এর section 16G এর পর নিম্নরূপ নূতন section 16H সন্নিবেশিত হইবে, যথা:— “16H. Charge of tax on the difference of investment, import and export.— Where, in any income year, the assessee has, in the statements submitted by him, (a) claimed to have carried on any import or export, and the amount paid or received for such import or export respectively, as shown in the statement, is found to be different from the actual transaction value, or (b) claimed to have made any investment and the actual of investment is found to be lower than the amount of investment disclosed in the statement, tax, without prejudice to any other provisions of this Ordinance, shall be payable at the rate of fifty percent (50%) on the amount of the difference as mentioned in clause (a) or on the difference between the disclosed and the actual amount of investment as mentioned in clause (b), as the case may be.”Ordinance No. XXXVI of 1984 এ নূতন sections 19AAAA এবং 19AAAAA এর সন্নিবেশ
১৮। Ordinance No. XXXVI of 1984 এ নূতন sections 19AAAA এবং 19AAAAA এর সন্নিবেশ।— উক্ত Ordinance এর বিলুপ্ত section 19AAA এর পর নিম্নরূপ নূতন sections 19AAAA এবং19AAAAA সন্নিবেশিত হইবে, যথা:— “19AAAA. Special Tax Treatment in respect of investment in Securities.— (1) Notwithstanding anything contained in this Ordinance or any other law for the time being in force, no question as to the source of any sum invested in securities by an individual assessee during the period between the first day of July, 2020 and the thirtieth day of June, 2021 (both days inclusive) shall be raised by any authority if the assessee pays tax at the rate of ten percent (10%) on such investment within thirty days from the date of such investment. (2) In respect of such investment, a declaration in the prescribed form and manner shall be made and submitted to the respective Deputy Commissioner of Taxes. (3) Where any such sum invested is withdrawn from the capital market within one years from the day of such investment, such sum shall be deemed to be income of the assessee for that income year classifiable under the head “Income from other sources.” (4) The provisions of this section shall not apply to cases where any proceeding under any provision of this Ordinance or any other law has been drawn on or before the day of making such investment. **Explanation.—**For the purpose of this section ‘securities’ mean stocks, shares, mutual fund units, bonds, debentures and other securities of the companies listed in and approved by the Bangladesh Securities and Exchange Commission and all other government securities and bonds tradable in the capital market. 19AAAAA. Special Tax Treatment in respect of undisclosed property, cash, etc.—(1) Notwithstanding anything contained in this Ordinance or any other law for the time being in force, no question as to the source of any undisclosed movable property and immovable property shall be raised by any authority if an individual assessee pays, before the submission of return or revised return of income during the period between the first day of July, 2020 and the thirtieth day of June, 2021 (both days inclusive), tax at the rate specified in the following tables:Table- 1

৫২। (১) উপ-ধারা (৩) এর বিধানাবলি সাপেক্ষে, ২০২০ সালের ১ জুলাই তারিখে আরদ্ধ কর বৎসরের জন্য কোনো কর নির্ধারণের ক্ষেত্রে এই আইনের তফসিল-২ এর প্রথম অংশে নির্দিষ্ট কর হার অনুযায়ী আয়কর ধার্য হইবে। (২) যে সকল ক্ষেত্রে Income-tax Ordinance, 1984 (Ordinance No. XXXVI of 1984) এর SECOND SCHEDULE (লটারী আয় সংক্রান্ত) প্রযোজ্য হইবে, সেই সকল ক্ষেত্রে আরোপণযোগ্য কর উক্ত SCHEDULE অনুসারেই ধার্য করা হইবে, কিন্তু করের হার নির্ধারণের ক্ষেত্রে উপ-ধারা (১) এর বিধান প্রয়োগ করিতে হইবে। (৩) Income-tax Ordinance, 1984 (Ordinance No. XXXVI of 1984) এর Chapter VII অনুসারে কর কর্তনের নিমিত্ত তফসিল-২ এ (আয়কর হার সংক্রান্ত) বর্ণিত হার ২০২০ সালের ১ জুলাই তারিখে আরদ্ধ এবং ২০২১ সালের ৩০ জুন তারিখে সমাপ্য বৎসরের জন্য প্রযোজ্য হইবে। (৪) এই ধারায় এবং এই ধারার অধীন আরোপিত আয়কর হারের উদ্দেশ্যে ব্যবহৃত “মোট আয় (total income)” অর্থ Income-tax Ordinance,1984 (Ordinance No. XXXVI of 1984) এর বিধান অনুসারে নিরূপিত মোট আয় (total income)। (৫) কোনো স্কুল, কলেজ, বিশ্ববিদ্যালয় বা এনজিওতে সেবা গ্রহণকারী প্রতিবন্ধী ব্যক্তিদের সেবাস্থলে গম্যতার ক্ষেত্রে এবং সেবা প্রদানে দেশে বলবৎ আইনি বিধান অনুযায়ী উপযুক্ত ব্যবস্থা না রাখিলে ২০২০ সালের ১ জুলাই তারিখে আরদ্ধ কর বৎসর হইতে উক্ত প্রতিষ্ঠানের ক্ষেত্রে প্রযোজ্য করের পাঁচ শতাংশ (৫%) অতিরিক্ত কর ধার্য করা হইবে। (৬) কোনো করদাতা নিয়োগকারী কর্তৃপক্ষ হিসাবে প্রতিষ্ঠানে কর্মরত মোট জনবলের ন্যূনতম দশ শতাংশ (১০%) প্রতিবন্ধী ব্যক্তিদের নিয়োগ করিলে উক্ত করদাতাকে প্রদেয় করের পাঁচ শতাংশ (৫%) কর রেয়াত প্রদান করা হইবে।সারচার্জ
৫৩। Income-tax Ordinance, 1984 (Ordinance No. XXXVI of 1984) এর আওতায় ২০২০ সালের ১ জুলাই হইতে আরদ্ধ কর বৎসরের জন্য কোনো কর নির্ধারণের ক্ষেত্রে তফসিল-২ এর দ্বিতীয় অংশে নির্দিষ্ট হার অনুযায়ী সারচার্জ ধার্য হইবে।২০১২ সনের ৪৭ নং আইনের ধারা ২ এর সংশোধন
**৫৪।**মূল্য সংযোজন কর ও সম্পূরক শুল্ক আইন, ২০১২ (২০১২ সনের ৪৭ নং আইন), অতঃপর উক্ত আইন বলিয়া উল্লিখিত, এর ধারা ২ এর— (১) দফা (১৭) এর পরিবর্তে নিম্নরূপ দফা (১৭) প্রতিস্থাপিত হইবে, যথা:— “(১৭) “আমদানিকৃত সেবা” অর্থ বাংলাদেশের বাহির হইতে সরবরাহকৃত সেবা;”; (২) দফা (১৮) এর পর নিম্নরূপ নূতন দফা (১৮ক) সন্নিবেশিত হইবে, যথা:— (১৮ক) “উপকরণ” অর্থ সকল প্রকার কাঁচামাল, ল্যাবরেটরী রি-এজেন্ট, ল্যাবরেটরী ইকুইপমেন্ট, ল্যাবরেটরী এক্সেসরিজ, জ্বালানী হিসাবে ব্যবহৃত যে কোন পদার্থ, মোড়ক সামগ্রী, সেবা, যন্ত্রপাতি ও যন্ত্রাংশ; তবে নিম্নবর্ণিত পণ্য বা সেবাসমূহ উপকরণ হিসাবে বিবেচিত হইবে না, যথাঃ- (ক) শ্রম, ভূমি, ইমারত, অফিস ইকুইপমেন্ট ও ফিক্সচার, দালানকোঠা বা অবকাঠামো বা স্থাপণা নির্মাণ, সুষমীকরণ, আধুনিকীকরণ, প্রতিস্থাপন, সম্প্রসারণ, সংস্কারকরণ ও মেরামতকরণ; (খ) সকল প্রকার আসবাবপত্র, অফিস সাপ্লাই, স্টেশনারী দ্রব্যাদি, রেফ্রিজারেটর ও ফ্রিজার, এয়ারকন্ডিশনার, ফ্যান, আলোক সরঞ্জাম, জেনারেটর ক্রয় বা মেরামতকরণ; (গ) ইন্টেরিয়র ডিজাইন, স্থাপত্য পরিকল্পনা ও নকশা; (ঘ) যানবাহন ভাড়া ও লিজ গ্রহণ; (ঙ) ভ্রমণ, আপ্যায়ন, কর্মচারীর কল্যাণ, উন্নয়নমূলক কাজ ও উহার সহিত সংশ্লিষ্ট পণ্য বা সেবা; এবং (চ) ব্যবসা প্রতিষ্ঠানের প্রাঙ্গন, অফিস, শো-রুম বা অনুরূপ ক্ষেত্র, যে নামেই অভিহিত হউক না কেন, ভাড়া (Rent) গ্রহণ: তবে শর্ত থাকে যে, এই আইনের তৃতীয় তফসিলের অনুচ্ছেদ (৩) এ উল্লিখিত “ব্যবসায়ী” কর্তৃক ব্যবসায় পরিচালনার ক্ষেত্রে বিক্রয়, বিনিময় বা প্রকারান্তে হস্তান্তরের উদ্দেশ্যে আমদানিকৃত, ক্রয়কৃত, অর্জিত বা অন্যকোনভাবে সংগৃহীত পণ্য “উপকরণ” হিসাবে গণ্য হইবে; (৩) দফা (১৯) এর পরিবর্তে নিম্নরূপ দফা (১৯) প্রতিস্থাপিত হইবে, যথা:— “(১৯) “উপকরণ কর” (Input Tax) অর্থ কোন নিবন্ধিত ব্যক্তি কর্তৃক উপকরণ হিসাবে আমদানিকৃত পণ্য বা সেবার বিপরীতে আমদানি পর্যায়ে পরিশোধিত মূল্য সংযোজন কর (আগাম কর ব্যতীত) এবং স্থানীয় উৎস হইতে উপকরণ হিসাবে ক্রয়কৃত বা সংগৃহীত পণ্য বা সেবার বিপরীতে পরিশোধিত মূল্য সংযোজন কর;”; (৪) দফা (২৮) এর পরিবর্তে নিম্নরূপ দফা (২৮) প্রতিস্থাপিত হইবে, যথা:— “(২৮) “কর নির্ধারণ” অর্থ একাদশ অধ্যায় এর অধীন যথোপযুক্ত কর্মকর্তা কর্তৃক কর নির্ধারণ (determination) ;”। (৫) দফা (৩৮) এর পরিবর্তে নিম্নরূপ দফা (৩৮) প্রতিস্থাপিত হইবে, যথা:— “(৩৮) “কোম্পানি” অর্থ বাংলাদেশ বা অন্য কোন দেশের বিদ্যমান কোন আইনের অধীন কোম্পানি হিসাবে নিগমিত কোন প্রতিষ্ঠান;”; (৬) দফা (৪০) এর পরিবর্তে নিম্নরূপ দফা (৪০) প্রতিস্থাপিত হইবে, যথা:— “(৪০) “চালানপত্র” অর্থ পণ পরিশোধের দায় সংক্রান্ত কোন দলিল;”; (৭) দফা (৫৭) এর প্রান্তঃস্থিত সেমিকোলন চিহ্নের পরিবর্তে কোলন চিহ্ন প্রতিস্থাপিত হইবে এবং অতঃপর নিম্নরূপ শর্তাংশ সংযোজিত হইবে, যথা:— “তবে শর্ত থাকে যে, ধারা ৪ এর উপ-ধারা (২) এর দফা (ঘ) এর অধীন কোন ব্যক্তিকে নিবন্ধিত করিবার ক্ষেত্রে এই নিবন্ধনসীমা প্রযোজ্য হইবে না;”; (৮) দফা (৬২) এর উপ-দফা (ক) তে উল্লিখিত “পণ্য বা সেবার উপকরণ” শব্দগুলির পরিবর্তে “পণ্য বা সেবা” শব্দগুলি প্রতিস্থাপিত হইবে; (৯) দফা (৭৪) এর উপ-দফা (ঙ) এবং (চ) এর পরিবর্তে নিম্নরূপ উপ-দফা (ঙ), (চ) এবং (ছ) প্রতিস্থাপিত হইবে, যথা:¾ “(ঙ) কোন আন্তঃ দেশীয় ও আন্তর্জাতিক সংগঠন; (চ) সম্পত্তি উন্নয়নে যৌথ উদ্যোগ বা অনুরূপ কোন উদ্যোগ; বা (ছ) অন্যান্য ব্যবসা প্রতিষ্ঠান;” (১০) দফা (৮২) তে উল্লিখিত “পণ্য” শব্দটি বিলুপ্ত হইবে; (১১) দফা (৯২) এর ১ম পঙক্তিতে অবস্থিত “সমম্বিত কর চালানপত্র এবং” শব্দগুলি বিলুপ্ত হইবে;”। (১২) দফা (১০৩) এর পরিবর্তে নিম্নরূপ দফা (১০৩) প্রতিস্থাপিত হইবে, যথা:— “(১০৩) “হ্রাসকারী সমন্বয়” অর্থ নিম্নবর্ণিত কোন হ্রাসকারী সমন্বয়, যথা:— (ক) আগাম কর হিসাবে পরিশোধিত অর্থের হ্রাসকারী সমন্বয়; (খ) সরবরাহকারী কর্তৃক প্রদত্ত সরবরাহের বিপরীতে উৎসে কর্তিত করের হ্রাসকারী সমন্বয়; (গ) বাৎসরিক পুনঃহিসাব প্রণয়ন বা নিরীক্ষার ফলে প্রযোজ্য হ্রাসকারী সমন্বয়; (ঘ) ক্রেডিট নোট ইস্যুর কারণে হ্রাসকারী সমন্বয়; (ঙ) রপ্তানির ক্ষেত্রে পরিশোধিত উপকরণ করের হ্রাসকারী সমন্বয়; (চ) মূসক হার হ্রাস পাইবার ক্ষেত্রে হ্রাসকারী সমন্বয়; (ছ) পূর্ববর্তী কর মেয়াদ হইতে নেতিবাচক অর্থের পরিমাণ জের টানার নিমিত্ত হ্রাসকারী সমন্বয়; (জ) পূর্ববর্তী কর মেয়াদে অতিরিক্ত পরিশোধিত মূসক হ্রাসকারী সমন্বয়; বা (ঝ) নির্ধারিত অন্য কোন হ্রাসকারী সমন্বয়।”।২০১২ সনের ৪৭ নং আইনের ধারা ৫ এর সংশোধন
**৫৫।**উক্ত আইনের ধারা ৫ এর— (ক) উপ-ধারা (১) এ উল্লিখিত “নির্ধারিত পদ্ধতিতে” শব্দগুলির পরিবর্তে “নির্ধারিত শর্ত ও পদ্ধতিতে” শব্দগুলি প্রতিস্থাপিত হইবে; এবং (খ) উপ-ধারা (১) এর শর্তাংশের প্রান্তঃস্থিত দাঁড়ি চিহ্নের পরিবর্তে কোলন চিহ্ন প্রতিস্থাপিত হইবে এবং অতঃপর নিম্নরূপ শর্তাংশ সংযোজিত হইবে, যথা:— “আরও শর্ত থাকে যে, কেন্দ্রীয় নিবন্ধন গ্রহণ ও কর পরিশোধের লক্ষ্যে বোর্ড বিধিমালা প্রণয়ন করিতে পারিবে।”।২০১২ সনের ৪৭ নং আইনের ধারা ৮ এর সংশোধন
**৫৬।**উক্ত আইনের ধারা ৮ এর উপ-ধারা (১) এ উল্লিখিত “নির্ধারিত শর্ত ও পদ্ধতিতে” শব্দগুলি বিলুপ্ত হইবে।২০১২ সনের ৪৭ নং আইনের ধারা ১২ এর সংশোধন
**৫৭।**উক্ত আইনের ধারা ১২ এর— (ক) উপান্তটীকায় উল্লিখিত “কমিশনার কর্তৃক” শব্দগুলি বিলুপ্ত হইবে; (খ) দুইটি স্থানে উল্লিখিত “কমিশনার” শব্দটির পরিবর্তে, উভয়স্থানে, “সংশ্লিষ্ট কর্মকর্তা” শব্দগুলি প্রতিস্থাপিত হইবে।২০১২ সনের ৪৭ নং আইনের ধারা ৩১ এর সংশোধন
**৫৮।**উক্ত আইনের ধারা ৩১ এর— (ক) উপ-ধারা (২) এর পরিবর্তে নিম্নরূপ উপ-ধারা (২) প্রতিস্থাপিত হইবে, যথা:— “(২) করযোগ্য আমদানির উপর মূসক যে সময় ও পদ্ধতিতে আদায় করা হয় সেই একই সময় ও পদ্ধতিতে করযোগ্য আমদানির মূসক আরোপযোগ্য ভিত্তিমূল্যের উপর বোর্ড কর্তৃক নির্ধারিত শর্ত ও পদ্ধতিতে পণ্য উৎপাদনের লক্ষ্যে আমদানিকৃত উপকরণের ক্ষেত্রে ৪ (চার) শতাংশ হারে এবং অন্যান্য ক্ষেত্রে ৫ (পাঁচ) শতাংশ হারে আগাম কর প্রদেয় হইবে।”; (খ) উপ-ধারা (৩) এ উল্লিখিত “দুইটি কর মেয়াদের” শব্দগুলির পরিবর্তে “চারটি কর মেয়াদের” শব্দগুলি প্রতিস্থাপিত হইবে।২০১২ সনের ৪৭ নং আইনের ধারা ৩২ এর সংশোধন
**৫৯।**উক্ত আইনের ধারা ৩২ এর উপ-ধারা (২) এর পরিবর্তে নিম্নরূপ উপ-ধারা (২) প্রতিস্থাপিত হইবে, যথা:— “(২) আমদানিকৃত সেবার করযোগ্য সরবরাহের পণ হইবে সরবরাহের মূল্য বা সরবরাহকারী এবং সরবরাহগ্রহীতা পরস্পর সম্পর্কযুক্ত হইলে ন্যায্য বাজার মূল্য।”।২০১২ সনের ৪৭ নং আইনের ধারা ৩৩ এর সংশোধন
**৬০।**উক্ত আইনের ধারা ৩৩ এর উপ-ধারা (৩) এ উল্লিখিত “৬০ (ষাট)” সংখ্যা, বন্ধনী ও শব্দের পরিবর্তে “৯০ (নব্বই)” সংখ্যা, বন্ধনী ও শব্দ প্রতিস্থাপিত হইবে।২০১২ সনের ৪৭ নং আইনের ধারা ৪৬ এর সংশোধন
**৬১।**উক্ত আইনের ধারা ৪৬ এর— (ক) উপ-ধারা (১) এর— (অ) দফা (গ) তে উল্লিখিত “দুইটি কর মেয়াদের” শব্দগুলির পরিবর্তে “চারটি কর মেয়াদের” শব্দগুলি প্রতিস্থাপিত হইবে; (আ) দফা (ঙ) তে উল্লিখিত “ক্রয় হিসাব পুস্তকে” শব্দের পর “বা ক্রয়-বিক্রয় হিসাব পুস্তকে” শব্দগুলি সন্নিবেশিত হইবে; (ই) দফা*(ড)*এর প্রান্তঃস্থিত দাঁড়ি চিহ্নের পরিবর্তে সেমিকোলন চিহ্ন প্রতিস্থাপিত হইবে এবং অতঃপর নিম্নরূপ নূতন দফা সংযোজিত হইবে, যথা:— (ঢ) মোট উপকরণ মূল্য ৭.৫ (সাত দশমিক পাঁচ) শতাংশের অধিক পরিবর্তনের ক্ষেত্রে নূতন উপকরণ-উৎপাদ সহগ প্রদান না করিলে অতিরিক্ত বর্ধিত উপকরণ কর।”; (খ) উপ-ধারা (২) এর-দফা (ঘ) এর পরিবর্তে নিম্নরূপ দফা (ঘ) প্রতিস্থাপিত হইবে,যথা:— “(ঘ) উক্ত অর্জন পণ্য পরিবহন সেবা সংক্রান্ত ব্যয়ের ৮০ (আশি) শতাংশের অধিক হয়।”; (গ) উপ-ধারা (৩) এর— (অ) দফা (ঘ) তে উল্লিখিত “(৫)” বন্ধনী ও সংখ্যার পরিবর্তে “(২)” বন্ধনী ও সংখ্যা প্রতিস্থাপিত হইবে; (আ) দফা (ঘ) এর প্রান্তঃস্থিত দাঁড়ি চিহ্নের পরিবর্তে সেমিকোলন চিহ্ন প্রতিস্থাপিত হইবে অতঃপর নিম্নরূপ নূতন দফা (ঙ) সংযোজিত হইবে, যথা:— “(ঙ) গ্যাস, পানি, বিদ্যুৎ ও টেলিফোন সেবার উপর পরিশোধিত মূসক রেয়াত গ্রহণের ক্ষেত্রে সংশ্লিষ্ট প্রতিষ্ঠান কর্তৃক ইস্যুকৃত বিল, যাহা চালানপত্র হিসাবে গণ্য হইবে।”।২০১২ সনের ৪৭ নং আইনের ধারা ৪৮ এর সংশোধন
**৬২।**উক্ত আইনের ধারা ৪৮ এর পরিবর্তে নিম্নরূপ ধারা ৪৮ প্রতিস্থাপিত হইবে, যথা:— “**৪৮।সমন্বয়।**— (১) নির্ধারিত পরিমাণ, শর্ত, সময়সীমা ও পদ্ধতিতে করদাতা নিম্নবর্ণিত ক্ষেত্রে বৃদ্ধিকারী সমন্বয় সাধন করিতে পারিবেন, যথা:— (ক) উৎসে কর্তিত করের বৃদ্ধিকারী সমন্বয়; (খ) বাৎসরিক পুনঃহিসাব প্রণয়নের ফলে বৃদ্ধিকারী সমন্বয়; (গ) ব্যাংকিং চ্যানেলে অর্থ পরিশোধ না করিবার ফলে বৃদ্ধিকারী সমন্বয়; (ঘ) ব্যক্তিগত উদ্দেশ্যে ব্যবহৃত (private use) পণ্যের ক্ষেত্রে বৃদ্ধিকারী সমন্বয়; (ঙ) নিবন্ধিত হইবার পর বৃদ্ধিকারী সমন্বয়; (চ) নিবন্ধন বাতিলের কারণে বৃদ্ধিকারী সমন্বয়; (ছ) মূসক হার পরিবর্তিত হইবার কারণে বৃদ্ধিকারী সমন্বয়; (জ) সুদ, জরিমানা, অর্থদণ্ড, ফিইত্যাদি পরিশোধ সংক্রান্ত বৃদ্ধিকারী সমন্বয়; বা (ঝ) নির্ধারিত অন্য কোন বৃদ্ধিকারী সমন্বয়। (২) নির্ধারিত পরিমাণ, শর্ত, সময়সীমা ও পদ্ধতিতে করদাতা নিম্নবর্ণিত ক্ষেত্রে হ্রাসকারী সমন্বয় সাধন করিতে পারিবেন, যথা:— (ক) আগাম কর হিসাবে পরিশোধিত অর্থের হ্রাসকারী সমন্বয়; (খ) সরবরাহকারী কর্তৃক প্রদত্ত সরবরাহের বিপরীতে উৎসে কর্তিত করের হ্রাসকারী সমন্বয়; (গ) বাৎসরিক পুনঃহিসাব প্রণয়ন বা নিরীক্ষার ফলে প্রযোজ্য হ্রাসকারী সমন্বয়; (ঘ) ক্রেডিট নোট ইস্যুর কারণে হ্রাসকারী সমন্বয়; (ঙ) রপ্তানির ক্ষেত্রে পরিশোধিত উপকরণ করের হ্রাসকারী সমন্বয়; (চ) মূসক হার হ্রাস পাইবার ক্ষেত্রে হ্রাসকারী সমন্বয়; (ছ) পূর্ববর্তী কর মেয়াদ হইতে নেতিবাচক অর্থের পরিমাণ জের টানিবার নিমিত্ত হ্রাসকারী সমন্বয়; (জ) পূর্ববর্তী কর মেয়াদে অতিরিক্ত পরিশোধিত মূসক হ্রাসকারী সমন্বয়; বা (ঝ) নির্ধারিত অন্য কোন হ্রাসকারী সমন্বয়।”।২০১২ সনের ৪৭ নং আইনের ধারা ৪৯ এর সংশোধন
৬৩।উক্ত আইনের ধারা ৪৯ এর— (ক) উপ-ধারা (১) এর প্রারম্ভে উল্লিখিত “উপ-ধারা” শব্দের পূর্বে “ধারা ৩৩ এর বিধানাবলী সত্ত্বেও,” শব্দগুলি, সংখ্যা এবং কমা সন্নিবেশিত হইবে; (খ) উপ-ধারা (২) এ উল্লিখিত “সমন্বিত কর চালানপত্র এবং উৎসে কর কর্তন সনদপত্র” শব্দগুলির পরিবর্তে “কর চালানপত্র” শব্দগুলি প্রতিস্থাপিত হইবে; (গ) উপ-ধারা (৪) এর পর নিম্নরূপ নূতন উপ-ধারা (৫) সংযোজিত হইবে, যথা:— “(৫) কোন প্রকল্পের আওতায় কোন সেবা গ্রহণকারী কর্তৃক প্রদেয় মূল্য সংযোজন কর যদি সেবা গ্রহণকারী বা, ক্ষেত্রমত, সেবার মূল্য বা কমিশন পরিশোধকারী ব্যক্তি সেবার মূল্য বা কমিশন পরিশোধকালে নির্ধারিত পদ্ধতিতে উৎসে আদায় বা কর্তনপূর্বক সরকারি ট্রেজারিতে জমা করেন এবং উক্ত সেবা সরবরাহকারী ব্যক্তি কর্তৃক উক্ত সমুদয় সেবার অংশবিশেষ সরবরাহের লক্ষ্যে কোন সাব-কন্ট্রাক্টর, এজেন্ট বা অন্যকোন সেবা সরবরাহকারী ব্যক্তিকে নিয়োগ করেন, সেইক্ষেত্রে উক্ত সেবা সরবরাহকারীর সাব-কন্ট্রাক্টর, এজেন্ট বা নিয়োগকৃত অন্যকোন সেবা সরবরাহকারী ব্যক্তির নিকট হইতে, উক্ত সেবার উপর প্রাথমিক পর্যায়ে প্রযোজ্য মূল্য সংযোজন কর আদায় বা কর্তন এবং সরকারি ট্রেজারিতে জমা প্রদানের দালিলিক প্রমাণাদি উপস্থাপন সাপেক্ষে পুনরায় উৎসে মূল্য সংযোজন কর আদায় করা যাইবে না; তবে, প্রকল্পের আওতায় পণ্য ক্রয়ের ক্ষেত্রে এই বিধান প্রযোজ্য হইবে না।”।২০১২ সনের ৪৭ নং আইনের ধারা ৫০ এর সংশোধন

৬৫। উক্ত আইনের ধারা ৫৩ এর পরিবর্তে নিম্নরূপ ধারা ৫৩ প্রতিস্থাপিত হইবে, যথা:— “৫৩**।**উৎসে কর কর্তন সনদপত্র**।**— কোন নিবন্ধিত ব্যক্তির নিকট হইতে উৎসে কর কর্তনকারী সত্তা কোন সরবরাহ গ্রহণের ক্ষেত্রে, উক্ত উৎস কর কর্তনকারী সত্তা তৎকর্তৃক উক্ত সরবরাহের বিপরীতে মূল্য পরিশোধের সময় বোর্ড কর্তৃক নির্ধারিত পদ্ধতিতে উৎসে কর কর্তন সনদপত্র ইস্যু করিবেন।”২০১২ সনের ৪৭ নং আইনের ধারা ৬৪ এর সংশোধন
৬৬। উক্ত আইনের ধারা ৬৪ এর— (ক) উপ-ধারা (১) এর প্রান্তঃস্থিত দাঁড়ি চিহ্নের পরিবর্তে কোলন চিহ্ন প্রতিস্থাপিত হইবে এবং অতঃপর নিম্নরূপ শর্তাংশ সংযোজিত হইবে; যথা:— “তবে শর্ত থাকে যে, ১৫ (পনেরো) তম দিবসে সরকারি ছুটি থাকিলে তৎপরবর্তী কার্যদিবসে দাখিলপত্র পেশ করিতে হইবে।”; (খ) উপ-ধারা (১) এর পর নিম্নরূপ নূতন উপ-ধারা (১ক) ও (১খ) সংযোজিত হইবে; যথা:— “(১ক) এই আইনের অন্যান্য বিধানে ভিন্নতর যাহা কিছুই থাকুক না কেন, প্রাকৃতিক দুর্যোগ, মহামারী, দৈব-দুর্বিপাক বা যুদ্ধের কারণে জনস্বার্থে, বোর্ড, সরকারের পূর্বানুমোদনক্রমে, আদেশ দ্বারা, উক্তরূপ আপৎকালীন সময়ের জন্য সুদ ও জরিমানা আদায় হইতে অব্যাহতি প্রদানপূর্বক দাখিলপত্র পেশের সময়সীমা বৃদ্ধি করিতে পারিবে। (১খ) উপ-ধারা (১ক) এ উল্লিখিত আদেশ ভূতাপেক্ষভাবে কার্যকরতা প্রদান করা যাইবে।”।২০১২ সনের ৪৭ নং আইনের ধারা ৬৮ এর প্রতিস্থাপন
৬৭। উক্ত আইনের ধারা ৬৮ এর পরিবর্তে নিম্নরূপ ধারা ৬৮ প্রতিস্থাপিত হইবে, যথা:— “৬৮। ঋণাত্মক নীট অর্থ জের টানা ও ফেরত প্রদান।— (১) যদি কোন কর মেয়াদে উপকরণ কর এবং প্রাপ্য হ্রাসকারী সমন্বয়ের সমষ্টি, উৎপাদ কর, সম্পূরক শুল্ক এবং বৃদ্ধিকারী সমন্বয়ের সমষ্টিকে অতিক্রমের কারণে উক্ত কর মেয়াদে প্রদেয় নীট অর্থের পরিমাণ ঋণাত্মক হয়, তাহা হইলে অতিরিক্ত পরিমাণ অর্থ জের টানিতে হইবে এবং পরবর্তী ছয়টি কর মেয়াদে উক্ত অর্থ বিয়োজন করা যাইবে, তৎপরবর্তীতে অবশিষ্ট অর্থ এই ধারা অনুসারে ফেরৎ প্রদান করিতে হইবে। (২) কোন নিবন্ধিত ব্যক্তিকে পূর্ববর্তী কর মেয়াদ হইতে জের টানা অতিরিক্ত অর্থ নিম্নবর্ণিত পদ্ধতিতে হ্রাসকারী সমন্বয় প্রদান করিতে হইবে— (ক) সকল উৎপাদ করের পরিমাণ এবং এই ধারার অধীন প্রদত্ত সমন্বয় ব্যতীত অন্যান্য সমুদয় সমন্বয় হিসাবে লইয়া পরবর্তী কর মেয়াদে উক্ত মেয়াদের জন্য প্রদেয় করের পরিমাণ নির্ধারণ করিতে হইবে; (খ) যদি নিরূপিত অর্থের পরিমাণ ধনাত্মক হয়, তবে পূর্বের কর মেয়াদ হইতে জের টানা অতিরিক্ত অর্থের এমন অংশ হ্রাসকারী সমন্বয় প্রদান করিতে হইবে যাহাতে প্রদেয় অর্থের পরিমাণ শূন্যে হ্রাস পায়; (গ) পূর্বের কর মেয়াদ হইতে জের টানা যে পরিমাণ অর্থ দফা (খ) এর অধীন সমন্বয় করা যাইবে না, উহা ততক্ষণ পর্যন্ত জের টানিতে হইবে, যতক্ষণ না— (অ) কোন কর মেয়াদের জন্য জের টানা সমুদয় অতিরিক্ত অর্থ বিয়োজিত হয়; বা (আ) নির্দিষ্ট মেয়াদের জন্য জের টানা অতিরিক্ত অর্থের আংশিক বা সমুদয় পরিমাণ ছয়টি কর মেয়াদ পর্যন্ত জের টানা হয়। (৩) যদি ছয়টি কর মেয়াদ যাবৎ জের টানিবার পর অতিরিক্ত অর্থ অবশিষ্ট থাকে, তাহা হইলে— (ক) অতিরিক্ত অর্থের পরিমাণ ৫০,০০০.০০ (পঞ্চাশ হাজার) টাকার অধিক না হইলে উক্ত পরিমাণ শূন্যে হ্রাস না পাওয়া পর্যন্ত উহার জের টানিতে হইবে; বা (খ) অন্যান্য ক্ষেত্রে, উক্ত পরিমাণ অর্থ নির্ধারিত শর্ত ও পদ্ধতিতে আবেদন প্রাপ্তির ৩ (তিন) মাসের মধ্যে ফেরৎ প্রদান করিতে হইবে।”।২০১২ সনের ৪৭ নং আইনের ধারা ৭১ এর সংশোধন

৬৯। উক্ত আইনের ধারা ৭৩ এর— (ক) একাদশ অধ্যায়ের শিরোনামে উল্লিখিত“কমিশনার কর্তৃক” শব্দগুলি বিলুপ্ত হইবে এবং উপ-ধারা (১) এ দুইবার উল্লিখিত “কমিশনার” শব্দটির পরিবর্তে উভয়স্থানে “কমিশনার বা ধারা ৮৬ এর সারণীতে বর্ণিত যথোপযুক্ত কর্মকর্তা” শব্দগুলি ও সংখ্যা প্রতিস্থাপিত হইবে; (খ) উপ-ধারা (১) এর দফা (ক) এর উপ-দফা (অ) এর “, বা অনিয়মিতভাবে উপকরণ কর রেয়াত বা হ্রাসকারী সমন্বয় গ্রহণ করিয়াছেন” কমা ও শব্দগুলি বিলুপ্ত হইবে; (গ) উপ-ধারা (২) এ উল্লিখিত “কমিশনার” শব্দের পরিবর্তে “কমিশনার বা ধারা ৮৬ এর সারণীতে বর্ণিত যথোপযুক্ত কর্মকর্তা” শব্দগুলি ও সংখ্যা প্রতিস্থাপিত হইবে; (ঘ) উপ-ধারা (৩) এ উল্লিখিত “কমিশনার” শব্দের পরিবর্তে “কমিশনার বা ধারা ৮৬ এর সারণীতে বর্ণিত যথোপযুক্ত কর্মকর্তা” শব্দগুলি ও সংখ্যা প্রতিস্থাপিত হইবে; (ঙ) উপ-ধারা (৪) এ উল্লিখিত “কমিশনারকে” শব্দের পরিবর্তে “কমিশনার বা ধারা ৮৬ এর সারণীতে বর্ণিত যথোপযুক্ত কর্মকর্তাকে” শব্দগুলি প্রতিস্থাপিত হইবে; (চ) উপ-ধারা (৪) এর পর নিম্নরূপ নূতন উপ-ধারা (৫) সংযোজিত হইবে, যথা:— “(৫) দাখিলপত্র পরীক্ষায় উপকরণ কর রেয়াত বা হ্রাসকারী সমন্বয় গ্রহণের অনিয়ম উদঘাটিত হইলে সহকারী কমিশনারের নিম্নে নহেন এমন কর্মকর্তা উপ-ধারা (২) তে বর্ণিত পদ্ধতি অনুসরণ করিয়া প্রদেয় করের পরিমাণ নির্ধারণ করিতে পারিবেন।”।২০১২ সনের ৪৭ নং আইনের ধারা ৭৬ এর সংশোধন
৭০। উক্ত আইনের ধারা ৭৬ এর উপ-ধারা (১) এর পরিবর্তে নিম্নরূপ উপ-ধারা (১) প্রতিস্থাপিত হইবে, যথা:— “(১) যদি কোন ব্যক্তি এই আইনের কোন বিধানের অপব্যাখ্যা বা অপব্যবহার করিয়া কোন পরিকল্পের (scheme) মাধ্যমে কোন কর সুবিধা গ্রহণ করেন বা গ্রহণ করিবার চেষ্টা করেন, তাহা হইলে কমিশনার করদাতাকে শুনানি প্রদান করিয়া নির্ধারিত ক্ষেত্র ও পদ্ধতিতে এমনভাবে কর সুবিধার যথার্থতা নিরূপণ, নির্ধারণ, রদকরণ বা হ্রাসকরণের জন্য যুক্তিযুক্ত আদেশ প্রদান করিতে পারিবেন এবং সুবিধা লাভকারী ব্যক্তির করদায়িতা নিরূপণ করিতে পারিবেন যেন বিশেষ প্রস্তাবটি গৃহীত হয় নাই বা কার্যকর হয় নাই।”।২০১২ সনের ৪৭ নং আইনের ধারা ৭৮ এর সংশোধন

৭৩। উক্ত আইনের ধারা ৮৬ এর উপ-ধারা (২) এর পর নিম্নরূপ নূতন উপ-ধারা (৩) সংযোজিত হইবে; যথা:— (৩) যদি কোন ব্যক্তি তৎকর্তৃক ব্যর্থতা বা অনিয়মের ক্ষেত্রে সংক্ষিপ্ত ন্যায় নির্ণয়ন এর আবেদন করেন, তবে সে ক্ষেত্রে ন্যায় নির্ণয়নকারী কর্মকর্তা কারণ দর্শানো নোটিশ জারি ও শুনানী গ্রহণ ব্যতিরেকে উক্ত ক্ষেত্রে ন্যায় নির্ণয়ন কার্যক্রম সম্পন্ন করিতে পারিবেন।২০১২ সনের ৪৭ নং আইনের ধারা ৯৫ এর সংশোধন

৭৬। উক্ত আইনের ধারা ১২২ এর**—** (ক) উপ-ধারা (২) এর পরিবর্তে নিম্নরূপ উপ-ধারা (২) প্রতিস্থাপিত হইবে, যথা: — (২) মূসক কর্মকর্তা ব্যতীত, অন্য কোনো ব্যক্তি কর্তৃক উপ-ধারা (১) এর অধীন আপীল দায়ের করিবার ক্ষেত্রে, তাহাকে উক্ত আপীল দায়েরকালে তর্কিত আদেশে উল্লিখিত দাবীকৃত করের ২০ (বিশ) শতাংশ পরিমাণ অর্থ পরিশোধ করিতে হইবে: তবে উপ-ধারা (১) অনুযায়ী কমিশনার (আপীল) কর্তৃক প্রদত্ত আদেশের বিরুদ্ধে কাস্টমস, এক্সাইজ ও ভ্যাট আপীলাত ট্রাইব্যুনাল এ আপীল দায়ের করা হইলে সংক্ষুব্ধ ব্যক্তিকে তাহার উপর দাবীকৃত কর বা আরোপিত অর্থদণ্ডের কোনো অংশ জমা প্রদান করিতে হইবে না; (খ) উপ-ধারা (৫) এর পরিবর্তে নিম্নরূপ উপ-ধারা (৫ক) এবং (৫খ) সন্নিবেশিত হইবে, যথা: — (৫ক) এই আইনের অন্যান্য বিধানে ভিন্নতর যাহা কিছুই থাকুক না কেন, প্রাকৃতিক দূর্যোগ, মহামারী, দৈব-দূর্বিপাক বা যুদ্ধের কারণে জনস্বার্থে সরকার উক্তরূপ আপৎকালীন সময়ের জন্য আপীলাত ট্রাইব্যুনাল কর্তৃক আপীল নিষ্পত্তির সময়সীমা আদেশ দ্বারা বৃদ্ধি করিতে পারিবে। (৫খ) উপ-ধারা (৫ক) এ উল্লিখিত সময়সীমা বৃদ্ধির আদেশ ভূতাপেক্ষভাবে কার্যকরতা প্রদান করা যাইবে।২০১২ সনের ৪৭ নং আইনের ধারা ১২৬ এর সংশোধন

৭৯। উক্ত আইনের প্রথম তফসিল এর**—** (ক) প্রথম খন্ডের টেবিলের প্রথম কলামে উল্লিখিত**—** (অ) শিরোনামা সংখ্যা ০২.০৭ এর বিপরীতে দ্বিতীয় কলামে উল্লিখিত সামঞ্জস্যপূর্ণ নামকরণ কোড “০২০৭.১৩.৯০” ও “০২০৭.১৪.৯০” বিলুপ্ত হইবে; (আ) শিরোনামা সংখ্যা “০৪.০৯” এবং তৎবিপরীতে দ্বিতীয় ও তৃতীয় কলামে উল্লিখিত এন্ট্রিসমূহ বিলুপ্ত হইবে; (ই) শিরোনামা সংখ্যা “২৫.০৫” এবং তৎবিপরীতে দ্বিতীয় ও তৃতীয় কলামে উল্লিখিত এন্ট্রিসমূহের পর, যথাক্রমে, নিম্নরূপ নূতন শিরোনামা সংখ্যা ও এন্ট্রিসমূহ সন্নিবেশিত হইবে, যথা:— “২৫.০৮ ২৫০৮.৪০.০০ মাটি”; (খ) দ্বিতীয় খন্ডের**—** (অ) অনুচ্ছেদ ৩ (সংস্কৃতি সংশ্লিষ্ট সেবা) এর দফা (খ) এর পরিবর্তে নিম্নরূপ দফা (খ) প্রতিস্থাপিত হইবে, যথা:— “(খ) পুস্তক, সংবাদপত্র, ম্যাগাজিন, সরকারি গেজেট ছাপা, প্রকাশনা ও বিক্রয় (ছাপাখানা ও বাধাই সংস্থা ব্যতীত);”; (আ) অনুচ্ছেদ ৪ (অর্থ ও আর্থিক বিষয় সংশ্লিষ্ট সেবা) এর দফা (গ) এর পর নিম্নরূপ নূতন দফা (ঘ) সংযোজিত হইবে, যথা:— “(ঘ) শেয়ার ক্রয়-বিক্রয় নিষ্পত্তি সংক্রান্ত কার্যক্রম।”; (ই) অনুচ্ছেদ ৫ (পরিবহন সেবা) এর দফা (ঘ) এর পর নিম্নরূপ নূতন দফা (ঙ) সংযোজিত হইবে, যথা:— “(ঙ) এয়ার অ্যাম্বুলেন্স সেবা সংক্রান্ত কার্যক্রম।”।২০১২ সনের ৪৭ নং আইনের দ্বিতীয় তফসিলের সংশোধন
৮০।উক্ত আইনের দ্বিতীয় তফসিল এর— (ক) টেবিল-১ (আমদানি পর্যায়ে সম্পূরক শুল্ক আরোপযোগ্য পণ্যসমূহ) এর পরিবর্তে নিম্নরূপ টেবিল-১ প্রতিস্থাপিত হইবে, যথা:—২০১২ সনের ৪৭ নং আইনের তৃতীয় তফসিলের সংশোধন
৮১। ২০১২**সনের**৪৭**নং**আইনে**র**তৃতীয়**তফসিলের**সংশোধন**।****—**উক্ত আইনের তৃতীয় তফসিল এর—রহিতকরণ ও হেফাজত
৮২**।**(১) এই আইন কার্যকর হইবার সঙ্গে সঙ্গে— (ক) মূল্য সংযোজন কর ও সম্পূরক শুল্ক (সংশোধন) অধ্যাদেশ, ২০২০ (২০২০ সনের ২ নং অধ্যাদেশ); এবং (খ) Income-tax (Amendment) Ordinance, 2020 (২০২০ সনের ৩ নং অধ্যাদেশ); এতদ্দ্বারা রহিত করা হইল। (২) উক্তরূপ রহিতকরণ সত্ত্বেও রহিতকৃত অধ্যাদেশ দুইটির অধীন কৃত কোন কার্য বা গৃহীত কোন ব্যবস্থা বা জারীকৃত কোন আদেশ এই আইনের অধীন কৃত বা গৃহীত বা জারীকৃত হইয়াছে বলিয়া গণ্য হইবে।Footnotes
